In paragraph 56 of its resolution of 11 September 2012 on alleged transportation and illegal detention of prisoners in European countries by the CIA: follow-up of the EP TDIP Committee report[1], Parliament instructs its Committee on Civil Liberties, Justice and Home Affairs, together with the Subcommittee on Human Rights, to address Parliament in plenary on the matter a year after the adoption of this resolution and considers it essential now to assess the extent to which the recommendations adopted by Parliament have been followed.

Given the developments since the adoption of the report and in view of this mandate the LIBE Committee would like the Commission to answer the following questions.

1.  Which recommendations have been followed and implemented by the Commission, and how has this been done?

In particular:

  has the Commission investigated whether EU provisions, in particular those on asylum and judicial cooperation, have been breached by collaboration with the CIA programme?

  did the Commission facilitate and support human-rights-compliant mutual legal assistance and judicial cooperation between investigating authorities and cooperation between lawyers involved in accountability work in Member States?

  has the Commission adopted a framework, including reporting requirements for Member States, for monitoring and supporting national accountability processes?

  has the Commission adopted measures aimed at strengthening the EUs capacity to prevent and redress human rights violations at EU level and to provide for the strengthening of Parliaments role?

  has the Commission put forward proposals for developing arrangements for democratic oversight of cross-border intelligence activities in the context of EU counter-terrorism policies?

2.  What measures does the Commission intend to take in order to improve follow-up in respect of these recommendations?
