ORAL QUESTION for Question Time at the part-session in February 2007 pursuant to Rule 109 of the Rules of Procedure by Laima Liucija Andrikienė to the Council

 Subject: Absence of regulatory framework for the implementation of the European Community-Russian Federation agreement on readmission
 Answer 

The readmission agreement between the European Community and the Russian Federation establishes clear obligations and procedures regarding the readmission of illegal residents. Although the Commission considers that the objectives set by the Council in its negotiating directives were attained and that the draft readmission agreement is acceptable to the Community, the European Parliament is worried about the absence of a regulatory framework for implementing the agreement.

What action does the Council plan to take in order to have the regulatory framework in place for the successful implementation of the agreement?

Will the EU-Russia agreement on readmission be in compliance with the Directive of the EP and of the Council on common standards and procedures for returning illegally staying third-country nationals (COM(2005)0391-2005/0167(COD)), which is shortly to come into being and which is subject to codecision?

What measures does the Council plan to apply in order to guarantee full and unconditional implementation of the agreement? What requirements will be laid down in the regulatory framework for the implementation of the agreement in order to ensure respect for human rights at every stage of readmission? What role does the Council foresee for the European Parliament during the implementation of the agreement?
