 ANNEX: OPINION OF THE CONSULTATIVE WORKING PARTY OF THE LEGAL SERVICES OF THE EUROPEAN PARLIAMENT, THE COUNCIL AND THE COMMISSION

DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the proposal for a directive of the European Parliament and of the Council relating to insurance against civil liability in respect of the use of motor vehicles, and the enforcement of the obligation to insure against such liability (codified version)

The European Parliament,

–   having regard to the Commission proposal to the European Parliament and the Council (COM(2008)0098),

–   having regard to Article 251(2) and Article 95(1) of the EC Treaty, pursuant to which the Commission submitted the proposal to Parliament (C6-0144/2008),

–   having regard to the Interinstitutional Agreement of 20 December 1994 - Accelerated working method for official codification of legislative texts(1),

–   having regard to Rules 80 and 51 of its Rules of Procedure,

–   having regard to the report of the Committee on Legal Affairs (A6-0380/2008),

A. whereas, according to the Consultative Working Party of the Legal Services of the European Parliament, the Council and the Commission, the proposal in question contains a straightforward codification of the existing texts without any change in their substance,

1.  Approves the Commission proposal as adapted to the recommendations of the Consultative Working Party of the legal services of the European Parliament, the Council and the Commission;

2.  Instructs its President to forward its position to the Council and Commission.

OF THE LEGAL SERVICES

OPINION

FOR THE ATTENTION OF THE EUROPEAN PARLIAMENT THE COUNCIL

THE COMMISSION

Proposal for a directive of the European Parliament and of the Council relating to insurance against civil liability in respect of the use of motor vehicles, and the enforcement of the obligation to insure against such liability (codified version)

(COM(2008) 98 final of 27.2.2008 - 2008/0049(COD))

Having regard to the Interinstitutional Agreement of 20 December 1994 on an accelerated working method for official codification of legislative texts, and in particular point 4 thereof, on 7 July 2008 the Consultative Working Party consisting of the legal services of the European Parliament, the Council and the Commission held a meeting at which it examined, inter alia, the above proposal presented by the Commission.

On examining(1) the proposal for a directive of the European Parliament and of the Council to codify Council Directive 72/166/EEC of 24 April 1972 on the approximation of the laws of the Member States relating to insurance against civil liability in respect of the use of motor vehicles relating to insurance against civil liability in respect of the use of motor vehicles, and the enforcement of the obligation to insure against such liability, second Council Directive 84/5/EEC of 30 December 1983 on the approximation of the laws of the Member States relating to insurance against civil liability in respect of the use of motor vehicles, third Council Directive of 14 May 1990 on the approximation of the laws of the Member States relating to insurance against civil liability in respect of the use of motor vehicles and Directive 2000/26/EC of the European Parliament and of the Council of 16 May 2000 on the approximation of the laws of the Member States relating to insurance against civil liability in respect of the use of motor vehicles (fourth motor insurance directive), the Working Party, by common consent, established the following.

1) In recital 3, 'necessary' was to be replaced by 'appropriate'.

2) In recital 4, 'of this Directive' should have been arrowed as an adaptation.

3 In recital 24, 'of this Directive' should have been arrowed as an adaptation.

Thus the Working Party was able to establish by common consent that the proposal was indeed a straightforward codification without substantive changes to the acts to which it related.
