on the draft Council decision on the conclusion, on behalf of the European Union and its Member States, of the Third Additional Protocol to the Agreement establishing an association between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part, to take account of the accession of the Republic of Croatia to the European Union

The European Parliament,
– having regard to the draft Council decision (06750/2017),
– having regard to the Third Additional Protocol to the Agreement establishing an association between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part, to take account of the accession of the Republic of Croatia to the European Union (06905/2017),
– having regard to the request for consent submitted by the Council in accordance with Article 217 and point (a)(i) of the second subparagraph of Article 218(6) of the Treaty on the Functioning of the European Union (C8-0225/2017),
– having regard to Rule 99(1) and (4) and Rule 108(7) of its Rules of Procedure,
– having regard to the recommendation of the Committee on International Trade (A8-0277/2017),
1. Gives its consent to conclusion of the protocol;
2. Instructs its President to forward its position to the Council, the Commission and the governments and parliaments of the Member States and of Chile.
EXPLANATORY STATEMENT
The conclusion of a Third Protocol to the Agreement establishing an association between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part[1][1] (‘AA) signed on 18 November 2002, is being proposed by Council to take into account the accession of Croatia to the EU. By this means, Croatia becomes a Contracting Party to the AA.
Council had authorised the Commission to open negotiations with the third countries in view of the accession of Croatia to the EU on 14 September 2012. The negotiations with Chile were concluded with the initialling of the Protocol on 9 July 2015 in Brussels, and it was signed on behalf of the Union and its Member States on 29 June 2017. The Protocol is now being referred to Parliament for consent before it can be finally concluded in accordance with Article 218(6), second subparagraph, point (a). It must be noted that provisional application was foreseen pending the completion of the procedures for its conclusion on the basis of Article 218(5) TFEU and that the Protocol is applied with effects from 1 July 2013.
From a technical point of view, this Protocol adds a maximum of 1000 metric tonnes of pig meat to the existing 8400 tonnes (following standard calculations on compensations), updates to the schedule on services for integrating the schedule for Croatia and adjusts public procurement to integrate Croatian entities.
The Rapporteur for this procedure, Ms Inmaculada Rodriguez-Piñero, would like to recommend granting consent to the Protocol so Croatia can fully become a contracting party to the AA.
However, the Rapporteur would like to call for:
(i) Enhanced information sharing with the Committee on International Trade (INTA) throughout full life-cycle of international agreements, including as regards the negotiations of so called ‘technical’ agreements, as those linked to the accessions to the EU.
(ii) Written summaries with factual information accessible (and intended) for the public and stakeholders from the relevant Commission services explaining the effects of international agreements such as this, so that all operators and civil society can understand and benefit from the changes.
(iii) Restrained use of provisional application prior to EP’s consent, as according to Article 218(5) such provisional application is only foreseen ‘if necessary’.
