DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council common position for adopting a decision of the European Parliament and of the Council establishing for the period 2007-2013 the specific programme "Drug prevention and information" as part of the General programme "Fundamental Rights and Justice"

The European Parliament,

–   having regard to the Council common position (8698/4/2007 – C6-0258/2007),

–   having regard to its position at first reading(1) on the Commission proposal to Parliament and the Council (COM(2006)0230)(2),

–   having regard to Article 251(2) of the EC Treaty,

–   having regard to Rule 67 of its Rules of Procedure,

–   having regard to the recommendation for second reading of the Committee on Civil Liberties, Justice and Home Affairs (A6-0308/2007),

1.  Approves the common position;

2.  Draws attention to the statement made by the Commission at the plenary sitting of ... September 2007 according to which "the Commission confirms its commitment to transmit directly to the Chair of the competent parliamentary Committee (LIBE) the draft annual programme and to inform the European Parliament without delay about any modification being made to it";

3.  Notes that the act is adopted in accordance with the common position;

4.  Instructs its President to sign the act with the President of the Council pursuant to Article 254(1) of the EC Treaty;

5.  Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to have it published in the Official Journal of the European Union;

6.  Instructs its President to forward its position to the Council and Commission.

EXPLANATORY STATEMENT

On 14 December 2006, Parliament adopted its position at first reading regarding the specific programme "Drugs prevention and information" as part of the General Programme "Fundamental Rights and Justice". In its common position forwarded to Parliament and in accordance with the agreement at first reading, the Council accepted Parliament's amendments, but rejected those concerning the possibility for Parliament to block Commission decisions on implementation, notably when annual priorities are chosen.

Following the adoption by Parliament on 11 July 2007 of its position at second reading with regard to the Council common position for adopting a decision of the European Parliament and of the Council establishing for the period 2007-2013 the Specific Programme "Civil Justice" as part of the General Programme "Fundamental Rights and Justice" (2005/0040(COD)) Council decided to apply the agreement reached between the Parliament, the Council and the Commission as regards the committee procedure in the case of the specific programme "Civil Justice" also to the specific programme "Drugs prevention and information" and amended its draft common position accordingly.

The common position to be announced in plenary on Monday, 3 September 2007, therefore already incorporates an amendment comparable to the one adopted by Parliament on 11 July 2007 with regard to the specific programme "Civil Justice". In order to ensure the launch of the specific programme "Drugs prevention and information" and the financing for the year 2007 as soon as possible, the rapporteur proposes that the committee approves the Council common position.

The rapporteur expects the Commission to confirm in plenary its commitment (expressed in recital 13 of the common position) to transmit the necessary information relating to the draft annual work programmes to Parliament. There will be a reference to the statement of the Commission in the legislative resolution as there has been a reference to the Commission's statement in the legislative resolution concerning the specific programme "Civil Justice" adopted by Parliament on 11 July 2007.
