on the proposal for a regulation of the European Parliament and of the Council amending Council Regulation (EC) No 73/2009 establishing common rules for direct support schemes for farmers under the common agricultural policy and establishing certain support schemes for farmers

(COM(2010)0539 – C7-0294/2010 – 2010/0267(COD))

The European Parliament,

–   having regard to the Commission proposal to Parliament and the Council (COM(2010)0539),

–   having regard to Article 294(2) and Article 42 and Article 43(2) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C7-0294/2010),

–   having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

–   having regard to the reasoned opinions submitted, within the framework of Protocol (No 2) on the application of the principles of subsidiarity and proportionality, by the Lithuanian Parliament, the Luxembourg Chamber of Deputies and by the Polish Diet and Senat, asserting that the draft legislative act does not comply with the principle of subsidiarity,

–   having regard to the opinion of the European Economic and Social Committee of 16 February 2011(1),

–   having regard to Rule 55 of its Rules of Procedure,

–   having regard to the report of the Committee on Agriculture and Rural Development (A7-0158/2011),

1.  Adopts its position at first reading hereinafter set out;

2.  Calls on the Commission to refer the matter to Parliament again if it intends to amend its proposal substantially or replace it with another text;

3.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

Amendment

(3) The Commission should have the power to adopt delegated acts in accordance with Article 290 of the Treaty in order to supplement or amend certain non-essential elements of Regulation (EC) No 73/2009. The elements for which that power may be exercised should be defined, as well as the conditions to which that delegation is to be subject.

(3) In order to ensure the proper functioning of the regime established by this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission to supplement or amend certain non-essential elements of Regulation (EC) No 73/2009. It is of particular importance that the Commission carry out appropriate consultations during its preparatory work, including at expert level. The Commission, when preparing and drawing up delegated acts, should ensure a simultaneous, timely and appropriate transmission of relevant documents to the European Parliament and Council.

Justification

Adaptation of legal text in accordance with the Common Understanding on practical arrangements for the use of delegated acts (Article 290 TFUE).

(4) In order to ensure uniform conditions for the implementation of Regulation (EC) No 73/2009, implementing powers should be conferred on the Commission. Those powers, save where explicitly provided otherwise, should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers*

(4a) The Commission should, by means of implementing acts, approve the granting of certain specific support, decide which Member States fulfil certain conditions regarding suckler cow premium and authorise new Member States to complement, subject to certain conditions, any direct payments. Given the special nature of those acts, the Commission should be empowered to adopt them without the assistance of the Committee for Direct Payments.

Justification

In the cases where the Commission is acting 'without the assistance of the Committee referred to in Article 141c', a recital should explain this competence, as this is an exception from the general rule.

However, in the new legislative context, your rapporteur considers that this reservation of implementing powers for the Council is no longer justified.

Justification

The Commission’s proposals in this area are insufficient and still involve a need to carry out 100% follow-up on-the-spot checks. The follow-up on-the-spot checks in the cases of minor infringements lead to a significant increase in the number of compulsory on-the-spot checks. Thereby it creates a significant administrative burden. That is why it is important to abolish the obligation to carry out follow-up controls in the cases of minor infringements; this will reduce the administrative burden.

Justification

The Commission’s proposals in this area are insufficient and still involve a need to carry out 100% follow-up on-the-spot checks. Justification

These measures, adopted in emergency situations could be of the same nature as measures usually adopted under Article 290 TFUE (delegated acts). As there is an urgency procedure foreseen for delegated acts, your rapporteur proposes its employment, in order to ensure the efficiency of the decision-making process.

Exercise of delegation

1. The powers to adopt the delegated acts referred to in this Regulation shall be conferred on the Commission for an indeterminate period of time.

As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.

 

2. The delegation of power referred to in paragraph 1 may be revoked by the European Parliament or by the Council.

The institution which has commenced an internal procedure for deciding whether to revoke the delegation of power shall endeavour to inform the other institution and the Commission within a reasonable time before the final decision is taken, indicating the delegated powers which could be subject to revocation and possible reasons for a revocation.

The decision of revocation shall put an end to the delegation of the powers specified in that decision. It shall take effect immediately or at a later date specified therein. It shall not affect the validity of the delegated acts already in force. It shall be published in the Official Journal of the European Union.

2. The delegation of power referred to in Article 2a, Article 6(3), Article 8(2), Article 9(3), Articles 11a(1) and 11a(2), Article 12(5), Articles 27a(1), 27a(2), 27a(3), 27a(4) and 27a(5), Article 31a, Article 33(5), Article 40(1), Articles 45a(1), 45a(2), 45a(3), 45a(4) and 45a(5), Article 54a, Articles 62a(1), 62a(3) or 62a(4), Article 67a, Article 68(7), Article 76a, Article 77, Article 81(3), Articles 85(4) or 85(5), Articles 87(4), 87(5), 87(6), 87(7) and 87(8), Article 89(3), Article 90(5), Article 91(3), Articles 97(5), 97(6), 97(7), 98(7) and 98(8), Article 103(3), Article 105(6), Article 110(4), Articles 111(7) and 111(8), Article 113(6) new, Articles 115(3) and 115(5)new, Articles 116(5), 116(6) and 116(7), Articles 124(9) and 124(10) and Article 132(9) shall be conferred on the Commission for a period of five years from ...*. The Commission shall draw up a report in respect of the delegated powers no later than nine months before the end of this five years period. The delegation of power shall be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes such extension not later than three month before the end of each period.

3. The European Parliament and the Council may object to the delegated act within a period of two months from the date of notification. At the initiative of the European Parliament or the Council this period shall be extended by one month.

If, on expiry of that period, neither the European Parliament nor the Council has objected to the delegated act, it shall be published in the Official Journal of the European Union and shall enter into force at the date stated therein.

The delegated act may be published in the Official Journal of the European Union and enter into force before the expiry of that period if the European Parliament and the Council have both informed the Commission of their intention not to raise objections.

If the European Parliament or the Council objects to a delegated act, it shall not enter into force. The institution which objects shall state the reasons for objecting to the delegated act.

3. The delegation of power may be revoked at any time by the European Parliament or by the Council. The decision of revocation shall put an end to the delegation of the power specified in that decision. It shall take effect the day following the publication of the decision in the Official Journal of the European Union or on a later date specified therein. It shall not affect the validity of any delegated acts already in force.

 

4. As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.

 

5. A delegated act adopted pursuant to this Regulation shall enter into force only if no objection has been expressed either by the Parliament or the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object. That period shall be extended by two months at the initiative of the European Parliament or the Council.

Committee procedure

To be completed following the adoption of the Regulation laying down the rules and general principles concerning mechanisms for control envisaged in Article 291(2) TFEU, which is currently under discussion before the PE and the Council.

1. The Commission shall be assisted by the Committee for Direct Payments. That committee shall be a committee within the meaning of Regulation (EU) No 182/2011 of the European Parliament and the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers*.

 

2. Where reference is made to this paragraph, Article 5 of Regulation (EU) No 182/2011 shall apply.

EXPLANATORY STATEMENT

The Treaty of Lisbon abolishes the old comitology system, which was based on the classic comitology procedures (advisory, management, regulatory) and the regulatory procedure with scrutiny. This system is now replaced with a two tier structure, consisting of delegated and implementing acts (the former including Parliament's right of veto), which enable the Commission to exert powers in implementation and execution. Thus, the existing body of legislation has to be aligned to this new legal reality.

One of the first proposals is the alignment of the present proposal for proposal for regulation amending Council Regulation (EC) No 73/2009 establishing common rules for direct support schemes for farmers under the common agricultural policy and establishing certain support schemes for farmers.

The proposal contains modifications in terms of alignment, but also provides for simplification of Regulation 73/2009.

Alignment to TFUE provisions on implementing powers

Following the Lisbon Treaty, the powers conferred under Regulation (EC) No 73/2009 upon the Commission need to be aligned to Articles 290 and 291 of the Treaty on the Functioning of the European Union. Articles 290 and 291 of the Treaty on the Functioning of the European Union (TFUE) distinguish two different types of Commission acts:

– Article 290 allows the legislator to delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of a legislative act. Legal acts adopted by the Commission in this way are referred to in the terminology used by the Treaty as "delegated acts" (Article 290(3));

– Article 291 of the TFUE allows Member States to adopt all measures of national law necessary to implement legally binding Union acts. Those acts can confer implementing powers on the Commission where uniform conditions for implementing them are needed. Legal acts adopted by the Commission in this way are referred to in the terminology used by the Treaty as "implementing acts" (Article 291(4)).

Rapporteur proposals on alignment

On balance, the rapporteur supports the proposal of the Commission, which presents a balanced and technically solid text. Based on the criteria defined for each type of act, your rapporteur carefully scrutinized the Commission proposal and identified areas where the conditions for delegated acts were met. Consequently, the rapporteur proposes the use of delegated acts in the following cases:

- in cases where the basic act is amended, in particular with regards to changing annexes to the legal text;

- in cases where rights are conferred to farmers or reversely where negative consequences may be incurred;

- in cases where in order to maintain the consistency of the legal text, a certain type of measure is considered to be taken always via only one of either delegated or implementing act.

In addition, following the recent conclusion of a Common Understanding on practical arrangements for the use of delegated acts (Article 290 TFUE), as well as the conclusion of the procedure on the Regulation of the European Parliament and the Council laying down the rules and general principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers, your rapporteur proposes an updated version of the legal text, including the wording agreed to by Parliament and Council, as well as with regards to other conditions of the delegation (period of delegation, timeframe for objecting to a delegated act, extension of that period, committee procedure, etc.).

With regards to the procedure defined in Article 11 of Regulation 73/2009 (regarding the financial discipline mechanism), your rapporteur considers that it may no longer be applied without the involvement of the European Parliament, in light of the Lisbon Treaty provisions on the Common Agricultural Policy and the budgetary procedure. Maintaining Article 11 unchanged - with the Council acting on a proposal from the Commission - would constitute a continuation of the reservation of Council's implementing powers under the former Article 202 EC. However, in the new legislative context, your rapporteur considers that this reservation of implementing powers for the Council is no longer justified.

Simplification

The proposal also includes a number of provisions aimed at simplifying the current legislative environment and easing the administrative burden for Member States.

These amendments concern cross compliance, as well as the possibility for Member States to exempt farmers not applying for area-related payments and declaring only small areas (less than 1 hectare) from the requirement of an area declaration will mainly concern livestock producers without any eligible land to apply for area-related payments.

It is judged that the number of farmers which could be affected is difficult to foresee, but it can be assumed that it will be limited, keeping in mind the continued decoupling of livestock payments and transfer to area related payments. The amendment however represents a cut of the administrative burden for certain Member States.

Your rapporteur supports the proposed modifications, as well as the provision of definitions, in order to achieve better legal clarity and certainty.
