DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the draft Council regulation (EU, Euratom) laying down implementing measures for the system of own resources of the European Union

(05600/2014 – C7-0047/2014 – 2011/0184(APP))

(Special legislative procedure – consent)

The European Parliament,

–       having regard to the draft Council regulation (05600/2014),

–       having regard to the request for consent submitted by the Council in accordance with the fourth paragraph of Article 311 of the Treaty on the Functioning of the European Union (C7-0047/2014),

–       having regard to its resolution of 29 March 2007 on the future of the European Union’s own resources(1),

–       having regard to its resolution of 8 June 2011 on investing in the future: a new Multiannual Financial Framework (MFF) for a competitive, sustainable and inclusive Europe(2),

–       having regard to its resolution of 13 June 2012 on the Multiannual Financial Framework and own resources(3),

–       having regard to its resolution of 23 October 2012 in the interest of achieving a positive outcome of the Multiannual Financial Framework approval procedure(4),

–       having regard to its resolution of 13 March 2013 on the European Council conclusions of 7-8 February 2013 concerning the Multiannual Financial Framework(5),

–       having regard to its resolution of 3 July 2013 on the political agreement on the Multiannual Financial Framework 2014-2020(6),

–       having regard to the fact that for the first time the Treaty requires Parliament's consent to implementing measures for the system of the Union's own resources,

–       having regard to Rule 81(1), first and third subparagraphs, of its Rules of Procedure,

–       having regard to the recommendation of the Committee on Budgets (A7-0269/2014),

1.      Gives its consent to the draft Council regulation;

2.      Instructs its President to forward its position to the Council, the Commission and the national parliaments.

EXPLANATORY STATEMENT

The Implementing Regulation is part of the global package on the reform of the system of own resources presented by the Commission in June 2011 (and revised in November 2011). It contains provisions on determining the own resources, control and supervision and reporting requirements for national authorities. As outlined in the draft Council decision on the system of own resources the implementing regulation contains provisions of a general nature applicable to all types of own resources and which require appropriate parliamentary oversight.

Article 311 (4) TFEU gives the possibility to adopt a Council regulation laying down implementing measures for the system of own resources of the European Union in so far as this is provided in the Own Resources Decision. For the first time, under the Lisbon Treaty, the consent of the Parliament is required for the Council to adopt this Regulation. In its conclusions of 7/8 February 2013 on the MFF, the European Council confirmed that “On the basis of Art. 311(4) TFEU, a Council Regulation laying down implementing measures will be established”.

In the present draft Council regulation laying down implementing measures for the system of own resources of the European Union the Council adapted the Commission's proposal from 2011to the outcome of negotiations on the MFF/Own Resources, omitting the parts on the reform of the VAT own resource and the introduction of an FTT own resource that did not obtain Council's support. Regrettably, the Council also decided to transfer the provisions related to the calculation of the GNI resources back to the Own Resources Decision, as is currently the case, missing thus the opportunity to regroup all provisions of implementing nature in a single legal text.

The Rapporteurs welcome this first occasion of applying the provisions of the Lisbon Treaty regarding the implementing regulation and endorse the existence of this regulation. Therefore, they recommend that the Parliament gives its consent to the draft text proposed by the Council.
