DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council position at first reading with a view to the adoption of a regulation of the European Parliament and of the Council amending Council Regulation (EC) No 812/2004 laying down measures concerning incidental catches of cetaceans in fisheries

The European Parliament,

–       having regard to the Council position at first reading (06103/1/2014 – C7-0100/2014),

–       having regard to the opinion of the European Economic and Social Committee of 14 November 2012(1),

–       having regard to its position at first reading(2) on the Commission proposal to Parliament and the Council (COM(2012)0447),

–       having regard to Article 294(7) of the Treaty on the Functioning of the European Union,

–       having regard to Rule 72 of its Rules of Procedure,

–       having regard to the recommendation for second reading of the Committee on Fisheries (A7-0272/2014),

1.      Approves the Council position at first reading;

2.      Notes that the act is adopted in accordance with the Council position;

3.      Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;

4.      Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;

5.      Instructs its President to forward its position to the Council, the Commission and the national parliaments.

EXPLANATORY STATEMENT

Following the adoption of Parliament’s first reading position by the plenary on 16 April 2013, contacts were established with the Greek Presidency with a view to reaching an early second reading agreement. After one round of trilogue on 30 January 2014, Parliament’s and Council’s negotiating team reached agreement on the file. The text of the agreement was presented to the PECH Committee for a vote of approval on 11 February 2014, and approved unanimously. On the basis of the committee’s approval, the Chair of the committee undertook in his letter to the Chair of Coreper to recommend to plenary that it approve the Council’s position at first reading without amendments. Following legal-linguistic verification, on 4 March 2014 the Council adopted its first reading position confirming the agreement of 30 January 2014.

As the Council’s first reading position tallies with the agreement reached in the trilogues, your rapporteur recommends that the committee accept it without further amendments. Your rapporteur would like to highlight in particular the following elements of the compromise:

Given the shortcomings of the regulation identified by the Commission, the appropriateness and effectiveness of the provisions of the regulation for protecting cetaceans are to be reviewed by the end of 2015. On the basis of that review, and if appropriate, the Commission is to consider submitting an overarching legislative proposal to the European Parliament and the Council to guarantee effective protection for cetaceans, including through regionalisation.

The Commission will be empowered to adopt delegated acts updating the technical specifications and conditions for the use of acoustic deterrent devices, in particular the signal characteristics and the corresponding implementation characteristics, in order to adapt the regulation to technical and scientific progress. The Commission will allow adequate time for these adaptations to be carried out.

The power to adopt delegated acts conferred on the Commission is limited to four years.
