on the draft Council decision on the conclusion, on behalf of the European Union, of the Protocol (2015) amending the Annex to the Agreement on Trade in Civil Aircraft

The European Parliament,
– having regard to the draft Council decision (11018/2016),
– having regard to the Protocol (2015) amending the Annex to the Agreement on Trade in Civil Aircraft (11019/2016),
– having regard to the request for consent submitted by the Council in accordance with Article 207(4) and Article 218(6), second subparagraph, point (a) of the Treaty on the Functioning of the European Union (C8‑0391/2016),
– having regard to Rule 99(1) and (4) and Rule 108(7) of its Rules of Procedure,
– having regard to the recommendation of the Committee on International Trade (A8-0007/2017),
1. Gives its consent to conclusion of the Protocol;
2. Instructs its President to forward its position to the Council, the Commission and the governments and parliaments of the Member States.
SHORT JUSTIFICATION
Signed by 32 parties and entered into force in 1980, the Agreement on Trade in Civil Aircraft (ATCA) eliminates import duties on all aircraft, other than military aircraft, as well as on all other products covered by the agreement - civil aircraft, all components and sub-assemblies of civil aircraft, and flight simulators.
The Agreement contains an Annex (the “Product Coverage Annex”), which lists the products that shall be accorded duty-free treatment. Products in the Annex are classified according to their respective tariff headings under the Harmonized Commodity Description and Coding System (the “Harmonised System”), developed by the World Customs Organisation.
Since the adoption of the ATCA, different versions of Harmonized System have been adopted, in particular in 2007 with a new version of the Harmonized System. Therefore, in November 2015, the Civil Aircraft Committee adopted a protocol amending this Annex of the Agreement, in order to transpose the changes introduced in the 2007 version of the “Harmonized System”.
The protocol covers matters that fall under the common commercial policy and the amendment concerns a technical update of an international agreement; the legal basis for this decision is Article 218(6)(a) which provides the consent of the European Parliament.
The Rapporteur is in favour of approving the proposed Protocol amending the Product Coverage Annex of the Agreement on Trade in Civil Aircraft.
