Non-compliance by the Spanish Government with the Racial Equality Directive

Question for written answer E-005077-15
to the Commission
Rule 130
Eider Gardiazabal Rubial (S&D) , Juan Fernando López Aguilar (NI) , Iratxe García Pérez (S&D)

Article 13 of the directive on Racial Equality — Directive 2000/43/EC — obliges Member States to designate a body or bodies for the promotion of equal treatment of all persons without discrimination on the grounds of racial or ethnic origin. These bodies have two main functions: to disseminate information on how the principle of equality should properly be applied and to help victims gain access to justice.

The Spanish Government is failing to comply with its EU obligations in respect of non-discrimination and combating racism, since it has not yet incorporated into its legal system the figure of the ‘anti-discrimination authority’, as the said Directive requires.

Could the Commission say whether there are other countries in the same situation?

Fifteen years after this directive was approved, can the Commission inform us as to how far it has been implemented in the Member States?

What action does the Commission propose to take to oblige countries such as Spain to comply with the EU regulations on this issue?
