 Subject:  Orte-Civitavecchia highway completion project
 Answer(s) 

The Italian Government has ruled that the SS 675 completion project (on the Orte-Civitavecchia state highway, specifically the section running from Monte Romano Est to Strada Statale 1 Aurelia) is environmentally compatible, and it has taken that decision without awaiting the findings of the impact assessment.

The road in question runs through and alongside an SCI, ‘Fiume Mignone (basso corso)’; one stretch, nearly 15 km long, lies within ‘Comprensorio Tolfetano-Cerite-Manziate’, an SPA with priority habitats and species.

The Habitats Directive, according to our understanding, requires impact assessments to be concluded. If a site has priority habitats or species, the unfavourable findings of an impact assessment can be overruled only in very limited cases in which either the Commission has to be informed about the compensatory measures to be taken or — subject to a Commission opinion — which involve imperative reasons of overriding public interest.

— Can a project be deemed to be environmentally compatible when the impact assessment has not been concluded?

— If the answer is yes, has Italy informed the Commission about any regulations or compensatory measures to be imposed? If so, what form will these take? Alternatively, has Italy sought the Commission’s opinion? If so, did the Commission deliver a favourable or an unfavourable opinion (and can it say why it reached its particular conclusion)?

— If the above conditions are not met, what steps will it take?
