The situation in detention centres in Spain

In its answer to Written Question E-001105-17, on breaches of Regulation (EU) No 516/2014 of the European Parliament and the Council, the Commission states that ‘In case allegations of mismanagement of funds are substantiated, the Commission will not hesitate to take the necessary procedural steps.’

In addition to numerous reports from organisations such as Amnesty International, the UN has recently published a statement from its Working Group of Experts on People of African Descent outlining preliminary conclusions following its visit to Spain[1]. In this document, the UN states that these centres function in practice as prisons, jeopardising the mental health of detainees, and that immigrants who have committed crimes are detained, in unsuitable conditions, with immigrants guilty of nothing more than an administrative oversight.

1. Does the Commission still think that Spain is complying with Regulation (EU) No 516/2014 and implementing the safeguards against systematic detention enshrined in the Returns Directive, in spite of the weight of evidence to the contrary that has been provided?

2. Given its aforementioned promise, will the Commission be as good as its word and take procedural steps against Spain?
