Auf der einen Seite wurden eindeutig erhebliche Anstrengungen unternommen, um diesen Bericht vorzubereiten und die Informationen auf transparente Weise zu vermitteln. Auf der anderen Seite sind Umfang und Detailtiefe des Dokuments nicht immer für eine klare Analyse der Problemstellung und eine klare Erläuterung der Methodik zuträglich. Die Kommission hat zwar umfassende Konsultationen zum Problem der Barrierefreiheit durchgeführt und externes Fachwissen hinzugezogen, doch die zugrunde gelegten Daten scheinen nicht sehr aktuell zu sein. Außerdem sind die Ansichten von Bürgerinnen und Bürgern mit Behinderungen – eigentlich die wichtigsten Endbegünstigten des Vorschlags – nicht eindeutig nachvollziehbar und hätten in der Folgenabschätzung insgesamt stärker berücksichtigt werden können. Eine genauere Untersuchung sozialer Überlegungen als Gegengewicht zu der überwiegend wirtschaftlich geprägten Analyse wäre trotz des auf den Binnenmarkt gerichteten Schwerpunkts zu begrüßen gewesen.

This note seeks to provide an initial analysis of the strengths and weaknesses of the European Commission's Impact Assessment accompanying the Commission proposal for a Directive on single-member private limited liability companies. The context of the initiative is well presented. Efforts have been made to substantiate the problems identified and the various options considered are clearly described. Research and consultation appears to have been wide-ranging, although a breakdown of stakeholder views on each option would have been useful. The scope of the IA could have been broader, however. In particular, a more quantified and targeted cost-benefit analysis, especially with regard to costs for Member States and SMEs, and more data on how efficient different Member State measures have been in ensuring the smooth functioning of similar systems, would have strengthened the arguments. More specific evidence would also have been helpful with regard to the potential uptake of this initiative by the beneficiaries targeted.

This note seeks to provide an initial analysis of the strengths and weaknesses of the European Commission's Impact Assessment (IA) accompanying the proposal on the aid scheme for the supply of fruit and vegetables, bananas and milk in the educational establishments. Overall, the IA appears to be well documented and researched. However, potential downsides to the various options could have been more fully examined and stakeholder positions and concerns more adequately presented and taken into consideration. More generally, the conclusion that there is a necessity to act now, before the changes brought by the CAP 2020 agreement are implemented and evaluated, would have benefited from further explanation and evidence. This note, prepared by the Ex-Ante Impact Assessment Unit for the Committee on Agriculture of the European Parliament, analyses whether the principal criteria laid down in the Commission’s own Impact Assessment Guidelines, as well as additional factors identified by the Parliament in its Impact Assessment Handbook, appear to be met by the IA.

Zweck dieses Dokuments ist eine erste Analyse der Stärken und Schwächen der Folgenabschätzung der Europäischen Kommission, die am 1. April 2014 als Begleitunterlage zum Vorschlag der Kommission für eine Verordnung des Europäischen Parlaments und des Rates über den Visakodex der Union vorgelegt wurde. Die Erklärung der zu lösenden Probleme ist sehr übersichtlich, ebenso wie die Darstellung der Optionen. Unsicherheiten wurden erkannt und es wurden erhebliche Anstrengungen unternommen, die Folgenabschätzung durch konkrete Belege zu untermauern, obwohl sich dies aus klar erläuterten Gründen als schwierig erwiesen hat. Die Bedenken der Mitgliedstaaten in Bezug auf Sicherheitsfragen, die mit den obligatorischen Mehrfachvisa mit einer langen Gültigkeitsdauer oder der neuen „Rundreise-Genehmigung“ verbunden sind, hätten jedoch besser erklärt werden können. Auch die Tatsache, dass der vorliegende Vorschlag eine verkürzte Frist für die Bearbeitung von Anträgen vorsieht, erscheint angesichts des Hinweises in der Folgenabschätzung, dass dies keine effektive Lösung wäre, überraschend. Abgesehen davon, dass in der Folgenabschätzung die Schaffung von zwei separaten Rechtsinstrumenten nicht in Erwägung gezogen wird, ist nicht klar, wieso die Folgenabschätzung, angesichts der Tatsache, dass sie den gesamten Bereich Visumpolitik behandelt, nicht mit beiden Vorschlägen als Paket vorgelegt wurde.
