Interoperability between EU border and security information systems

To enhance EU external border management and internal security, the European Commission has made several proposals to upgrade and expand European border and security information systems. As part of a broader process to maximise their use, the Commission presented legislative proposals for two regulations in December 2017 (amended in June 2018), establishing an interoperability framework between EU information systems on borders and visas, and on police and judicial cooperation, asylum and migration. After completion of the legislative procedure at first reading in the Parliament and in the Council, the final acts were signed by the co-legislators on 20 May 2019 and published in the Official Journal two days later. Both acts came into force on 11 June 2019. The new rules aim to improve checks at the EU’s external borders, allow for better detection of security threats and identity fraud, and help in preventing and combating irregular migration. In dieser Studie, die von der Fachabteilung für Bürgerrechte und konstitutionelle Angelegenheiten des Europäischen Parlaments auf Ersuchen des Ausschusses für bürgerliche Freiheiten, Justiz und Inneres (LIBE-Ausschuss) des Europäischen Parlaments in Auftrag gegeben wurde, werden hauptsächlich die Vorschläge der Kommission vom Dezember 2017 für eine Verordnung zur Errichtung eines Rahmens für die Interoperabilität zwischen EU-Informationssystemen für Justiz und Inneres bewertet. Zunächst werden in der Studie die Beziehungen zwischen den Informationssystemen bei der aktuellen und der vorgeschlagenen Umsetzung analysiert. Anschließend werden zentrale Elemente in den Vorschlägen der Kommission bewertet, darunter auch der verwendete Interoperabilitätsbegriff, die Problembeschreibung, die Ziele und die vorgeschlagenen Lösungen sowie die Umsetzung und die Folgen für die Grundrechte und die Datensicherheit.

This note seeks to provide an initial analysis of the strengths and weaknesses of the European Commission's impact assessment (IA) accompanying the above proposals on (1) borders and visa; and on (2) police and judicial cooperation, asylum and migration, submitted on 12 December 2017 and referred to Parliament's Committee on Civil Liberties, Justice and Home Affairs. In 2016, the European Commission stressed the need for interoperability between EU border and security information systems. Likewise, the Joint Declaration on the EU's legislative priorities for 2018-2019 identified interoperable EU information systems as a key priority. The initiative aims to make information exchange and data sharing between the various EU information systems more effective and efficient, fully upholding fundamental rights, so as to boost the protection of the EU's external borders, improve migration management and enhance internal security. Interoperability is not a new topic, already in 2004 the European Council called for enhanced interoperability between the Schengen Information System (SIS) II, the Visa Information System (VIS) and Eurodac (the EU asylum fingerprint database).

Die Kommission plant aufgrund der erhöhten Anzahl an Reisenden und der neuen Sicherheitslage seit mehreren Jahren ein integriertes Grenzmanagement. Das vorgeschlagene Einreise /Ausreisesystem zielt auf die Einrichtung einer Datenbank ab, in der die die Ein- und Ausreisedaten von Reisenden aus Drittstaaten erfasst werden. Nach einer politischen Einigung mit dem Rat wird das Parlament voraussichtlich im Oktober über die Texte abstimmen.

Um diese Herausforderungen zu bewältigen, hat die EU Schritte zur Überarbeitung und Weiterentwicklung der Europäischen Informationssysteme unternommen, die zu Verbesserungen in Bezug auf die Erhebung, Verarbeitung und den Austausch von Daten unter den Mitgliedstaaten und den einschlägigen Agenturen der EU führen sollen. Diese Veröffentlichung bietet einen Überblick über die bestehenden und geplanten europäischen Informationssysteme im Bereich Justiz und Inneres. Erörtert werden die rechtliche Grundlage, der Zweck, der Umfang der Daten und des Zugangs sowie die Verwendung und die Änderungsvorschläge für jedes der Informationssysteme, einschließlich der Frage der Interoperabilität.

Recast Eurodac Regulation

Established in 2000 and reviewed in 2013, its main purpose is to facilitate the application of the Dublin Regulation. The 2013 revision broadened the scope to enable law enforcement authorities too to access the Eurodac database. As part of the reform of the Common European Asylum System, the European Commission proposes a recast Eurodac Regulation. The proposal is now with the co-legislators, who need to ensure that the reinforcement of the system is in compliance with the fundamental rights of migrants as well as the principles of data protection. This strengthens Ghana's reputation as one of Africa's most stable democracies and endorses a trend of democratic consolidation in West Africa. The president-elect, a man with strong human rights credentials, may however face difficulties in fulfilling his generous electoral promises given the country's current economic situation.
