In recent years Parliament has developed its own instruments to guarantee proper and independent assessment and to support parliamentary committees in their work. The concept of impact assessment is applied throughout the whole policy cycle – on both an ex-ante and an ex-post basis – from the design of legislation through to its implementation, evaluation and revision. The European Parliament also advocates a proper assessment of European added value, in terms of what savings will result from a European solution and if supplementary costs would arise in the absence of a European solution. This briefing provides a look back over five years’ experience in support of better regulation for the benefit of citizens.

Area of freedom, security and justice: Cost of Non-Europe

Substantial progress has been made since creating an area of freedom, security and justice became a major political objective for the EU 20 years ago. Still, there is a lack of consistent monitoring and enforcement of EU values and norms as well as outstanding gaps in the EU’s framework in certain areas. Substantial progress has been made since creating an area of freedom, security and justice became a major political objective for the EU 20 years ago. Still, there is a lack of consistent monitoring and enforcement of EU values and norms as well as outstanding gaps in the EU’s framework in certain areas. These deficiencies have a significant impact at individual level, notably in terms of preventing the effective exercise of fundamental rights by EU citizens and third country nationals alike. They also have a negative effect on budgetary spending, growth and tax revenue, which is estimated at at least €180 billion annually, with the lack of enforcement of EU values still to be assessed in more detail. Further EU action in four main areas: 1. monitoring and enforcement; 2. the creation of safe legal pathways for migrants and asylum seekers to enter the EU; 3. ingraining a European law enforcement culture; and 4. completing the Union’s fundamental rights framework, would have significant benefits. In particular, it could allow individuals to fully enjoy their fundamental rights and make EU society more secure, open, fair and prosperous. Dieser Auszug entstammt einer Studie, in der die laufenden Untersuchungen für ein langfristig angelegtes Projekt zusammengeführt werden, mit dem die „Kosten des Verzichts auf EU-politisches Handeln“ in einer Reihe von Politikfeldern ermittelt und analysiert werden sollen. Dieses Konzept, das das Europäische Parlament erstmals in den 1980er-Jahren entwickelt hat, wird hier verwendet, um die potenziellen Effizienzgewinne in der heutigen europäischen Wirtschaft zu beziffern, die erzielt werden, wenn mehrere politische Initiativen verfolgt werden, für die sich das Parlament in jüngster Zeit ausgesprochen hat – von einem breiter angelegten und vertieften digitalen Binnenmarkt über eine systematischere Koordinierung der nationalen und europäischen Verteidigungspolitik bis hin zu einer verstärkten Zusammenarbeit bei der Bekämpfung von Steuervermeidung durch Unternehmen. Der Nutzen wird in erster Linie anhand des zusätzlich erwirtschafteten BIP oder der rationelleren Nutzung öffentlicher Ressourcen gemessen. Die jüngste Analyse deutet darauf hin, dass der europäischen Wirtschaft (EU-28) ein potenzieller Nutzen von mehr als 2 200 Mrd. Euro zugutekommen könnte, wenn die vom Parlament in einer Reihe von konkreten Bereichen empfohlenen politischen Maßnahmen von den Organen der Union angenommen und dann im Zehnjahreszeitraum 2019 bis 2029 vollständig umgesetzt würden. Dies wäre dann tatsächlich eine „Zwei-Billionen-Euro-Dividende“, was einem Anstieg von rund 14 % des gesamten BIP der EU entsprechen würde (das sich 2017 auf 15,3 Billionen Euro belief). Die Studie soll einen Beitrag zur laufenden Debatte über die politischen Prioritäten der Europäischen Union im kommenden institutionellen Fünf-Jahres-Zyklus von 2019 bis 2024 leisten.

Further EU action in the area of legal migration could address obstacles experienced by Third Country Nationals within the European Union. Depending on the policy option pursued these options could result in up to €21,75 billion in benefits. Further gains could be made by addressing the fragmented national policies in this area, which are currently undermining ability of the EU as a whole to attract the workers and researchers it needs.

European health policy measures taken to date are highly beneficial to and relevant for European citizens, economies and the Member States. The EU does acquit its responsibility and utilises its capacity to act on behalf of EU citizens in this policy area. The study concludes that EU health policy clearly achieves added value.

This in-depth analysis, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the JURI Committee, assesses the European Commission of (EC) Communication of 29 November 2017 on the EU approach to Standard Essential Patents. The report examines the principles identified in the Communication with respect to the Commission’s proposals on (i) increasing transparency on SEPs; (ii) determining valuation of SEPs( Standard Essential Patents) and FRAND ( Fair, Reasonable, and Non-Discriminatory) terms; and (iii) enforcement. The report evaluates the efficient resolution of licensing disputes over FRAND, including via litigation, arbitration and mediation, licensing pools and collective licensing. The current document also puts forward some policy recommendations to, inter alia, enhance the general environment of FRAND licencing in the context of SEPs.

Cohesion policy provides the largest EU financial support, amounting to € 638 billion together with national co-financing for the period 2014-2020. Cohesion policy will help more than 7.4 million people find a job and over 8.9 million people gain new qualifications. 6.8 million children will get access to new or modernised schools and childcare facilities. For the European Parliament it is important that Cohesion Policy remains visible all over Europe.
