Critical functions and public interest in banking services: Need for clarification?

30-11-2017

Under the EU framework for dealing with banking problems, resolution is seen as an exception to be granted only if liquidation under national insolvency proceedings is not warranted. We look at the recent liquidation of two Italian banks to show how resolution and liquidation differ substantially when it comes to the scope of legislation applicable to the use of public funds. We argue that more clarity would be needed as to the role that the concepts of critical functions and public interest play ...

We look at the recent liquidation of two Italian banks to show how resolution and liquidation differ substantially when it comes to the scope of legislation applicable to the use of public funds. We argue that more clarity would be needed as to the role that the concepts of critical functions and public interest play in Member States’ decision to grant liquidation aid, and that the two-tier system – in which resolution is done at the EU level but insolvency remains a national prerogative – raises issues in the context of Banking Union.

Among issues on the table are the new US Administration's commitment to Europe's security, and the levels of military spending in Europe, which Washington considers too low. President Trump’s early statements created doubts in Europe about the future of transatlantic relations, but he and his officials have since reassured both NATO and the European Union that such ties will remain very important. This note offers links to commentaries, studies and reports by major international think tanks, on NATO, its relations with the EU and the wider issue of European security. More papers on the topics can be found in a previous edition of 'What Think Tanks are thinking', published in December 2016, PE 589.766.

Upon request by the Committee on Budgetary Control (CONT) this study analyses the results, efficiency and effectiveness of the EU investment in rail infrastructure with a special focus on cross border rail projects. Beginning with a discussion of the reasons for the moderate success of EU railway policy it investigates four case studies with a focus on effectiveness of funding schemes and success of removing bottlenecks, particularly at border crossings, to improve attractiveness of the railway mode.
