Le traité de Nice n’a préparé l’Union européenne que partiellement aux importants élargissements de 2004 et de 2007 vers l’est et le sud. À la suite des questions posées dans la déclaration de Laeken, la Convention sur l’avenir de l’Europe s’est donc efforcée d’élaborer une nouvelle base juridique pour l’Union sous la forme du traité établissant une Constitution pour l’Europe. En raison des résultats négatifs des référendums organisés dans deux États membres, ce traité n’a pas été ratifié.
