The European Commission recently issued a legislative proposal to increase the general safety of vehicles. This briefing provides an initial analysis of the strengths and weaknesses of the impact assessment accompanying this proposal. The IA provides a thorough problem definition and presents measures to tackle it. However, the link between problem definition and the options could have been more straightforward and the analysis, including numerous simulations and quantifications based on four different models, could have been more transparent and clear. While the IA focuses on the cost for manufacturers on the one side and the societal benefits of prevented or mitigated casualties on the other, it excludes (or only touches upon briefly) other aspects, such as macroeconomic or indirect impacts and the privacy of data as regards the use of new technologies.

On 13 September 2017, the Commission adopted a cybersecurity package with new initiatives to further improve EU cyber resilience, deterrence and defence. As part of these, the Commission tabled a legislative proposal to strengthen the European Union Agency for Network Information Security (ENISA). Following the adoption of the Network Information Security Directive in 2016, ENISA is expected to play a broader role in the EU’s cybersecurity landscape but is constrained by its current mandate and resources. The Commission has presented an ambitious reform proposal, including a permanent mandate for the agency, to ensure that ENISA can not only provide expert advice, as has been the case until now, but can also perform operational tasks. The proposal also envisages the creation of the first voluntary EU cybersecurity certification framework for ICT products, where ENISA will also play an important role. Within the European Parliament, the Industry, Research and Energy Committee adopted its report on the proposal in July, together with the decision to start negotiations with the Council. The first trilogue meeting is provisionally scheduled for 13 September, once Parliament approves the mandate during the September plenary session. Second edition. To remedy the situation, the Commission proposed, on 19 December 2017, to strengthen market surveillance rules for non-food products harmonised by EU legislation. The proposal for a compliance and enforcement regulation would increase EU-level coordination of market surveillance, clarify the procedures for the mutual assistance mechanism, and require non-EU manufacturers to designate a natural or legal person responsible for compliance information. In the European Parliament, the rapporteur has presented a draft report which seeks to introduce a more harmonised European approach to market surveillance. Second edition. Security of ID cards and of residence documents issued to EU citizens and their families

In order to strengthen the security features of ID cards and residence documents of EU citizens and their non-EU family members, the European Commission published a legislative proposal. The impact assessment accompanying this proposal clearly explains the problems currently encountered, and proposes adequate solutions. The Commission used different sources to substantiate the impact assessment and also undertook several stakeholder consultation activities. However, it is not systematically indicated which stakeholder group prefers which specific option. At times the impact assessment displays a lack of quantification, about which the Commission is open. More detailed information on the safeguards regarding the fundamental rights impact would have been desirable.
