Anti-money laundering - reinforcing the supervisory and regulatory framework

On the back of a number of high profile cases and alleged cases of money laundering, this briefing presents current initiatives and actions aiming at reinforcing the anti-money laundering supervisory and regulatory framework in the EU. This briefing first outlines (1) the EU supervisory architecture and the respective roles of European and national authorities in applying anti-money laundering legislation that have been further specified in the 5th AML Directive and (2) ways that have been proposed to further improve the anti-money laundering supervisory and regulatory frameworks, including the 12 September 2018 Commission’s communication, the changes to the European Supervisory Authority (ESA) Regulation adopted by the co-legislators on the basis of a Commission proposal and the most recent Commission’s state of play of supervisory and regulatory landscapes on anti-money laundering. Some previous AML cases are presented in Annex. This briefing updates an EGOV briefing originally drafted in April 2018. On a more prospective note, this briefing also presents (3) some possible additional reforms to bring about a more integrated AML supervisory architecture in the EU. In that respect, President-elect U. von der Leyen’s political declaration stresses the need for further action without specifying at this stage possible additional supervisory and regulatory developments: “The complexity and sophistication of our financial system has opened the door to new risks of money laundering and terrorist financing. We need better supervision and a comprehensive policy to prevent loopholes.”

Umowa UE-Norwegia dotycząca cieśniny Skagerrak, zezwalająca statkom rybackim z Danii, Norwegii i Szwecji na prowadzenie połowów na wodach każdej ze stron, została uaktualniona. Nowa umowa mająca na celu dostosowanie zarządzania rybołówstwem w cieśninie Skagerrak do międzynarodowych zasad jurysdykcji państwa nadbrzeżnego została podpisana w styczniu 2015 r. i jest stosowana tymczasowo do czasu jej wejścia w życie. Zawarcie powyższej umowy wymaga zgody Parlamentu.

Sexual and Reproductive Health and Rights

The Communication focuses on the environment and climate change, sustainable development, and peaceful international cooperation, with overarching support for scientific research. EU Arctic policy has evolved significantly in recent years, culminating in the April 2016 Joint Communication from the European Commission and the HRVP for Foreign Affairs and Security Policy. The Communication focuses on the environment and climate change, sustainable development, and peaceful international cooperation, with overarching support for scientific research. This coincides with most of the priorities of the EU’s Arctic Member States, Denmark, Finland and Sweden. The Communication does not focus on security issues or on hydrocarbon development. Arctic oil and gas are not the primary keys to EU energy security, but do play a role, and are important for the EU’s two main suppliers, Norway and Russia – sustainable management of these resources is in the EU’s interest. While the region has been a model for cooperation – Arctic collaboration with Russia continues via multiple mechanisms, despite wider tensions. That it will remain so cannot be taken for granted. The EU supports peaceful Arctic cooperation via multiple mechanisms, including the Arctic Council, the Barents-Euro Arctic Council, and via multiple cross-border collaboration platforms. As the EU becomes increasingly engaged in Arctic issues, continued focus on policy coherence, engagement with other Arctic stakeholders, and the priorities of the region’s citizens will be essential.

Disenfranchisement of EU citizens resident abroad: Situation in national and European elections in EU Member States

The right to vote is a fundamental one and of utmost importance for the democratic legitimacy of any public power. Six EU Member States deprive their nationals permanently resident abroad of the right to vote in national parliamentary elections. They also deprive such citizens residing in a third country of the vote in European elections, and two of them even when their nationals live in another EU Member State. The right to vote is a fundamental one and of utmost importance for the democratic legitimacy of any public power. Six EU Member States deprive their nationals permanently resident abroad of the right to vote in national parliamentary elections. They also deprive such citizens residing in a third country of the vote in European elections, and two of them even when their nationals live in another EU Member State. Citizens disenfranchised in their country of origin often face exclusion from political life at national level in both their country of origin and of residence. In the case of citizens living in another EU Member State, the disenfranchisement rules could even amount to an infringement of their freedom of movement and residence under EU law. Solutions discussed include a Treaty change to allow EU citizens to vote in national parliamentary elections in their host Member State or to be able to choose between voting there or in their Member State of nationality. A more realistic solution envisages the abolition of disenfranchisement rules in those six Member States concerned, although such calls from EU institutions have found very limited favour in the six concerned. Arctic cooperation seems relatively unaffected by the poor state of Russia's relations with the West. Canada invested much in its AC Chairmanship, but its deliverables have been less significant than those of previous chairs. Canada's two main achievements are the Arctic Economic Council and the framework for action on black carbon and methane. The framework is only a step in the right direction, not a full agreement. The programme of the new AC chair, the USA, has the potential to enhance practical cooperation between the EU and the AC. As Canada and the EU had resolved their differences, it seemed possible that the EU would at last receive formal observer status to the Council at the Iqaluit meeting, but Russia's geostrategic interests led Moscow to block the process. Given the growing number of observers, the US chair may propose that only one third of observers join high-level AC meetings under any one chair.
