Maastrichtská a Amsterdamská zmluva

Maastrichtská zmluva upravila predošlé európske zmluvy a vytvorila Európsku úniu založenú na troch pilieroch: Európske spoločenstvá, spoločná zahraničná a bezpečnostná politika (SZBP) a spolupráca v oblasti spravodlivosti a vnútorných vecí (SVV). S ohľadom na rozšírenie Únie sa Amsterdamskou zmluvou zaviedli úpravy potrebné na zaručenie efektívnejšieho a demokratickejšieho fungovania Únie.

Mapping the 'Future of the EU' debate

Although calls for reform of the EU have increased in recent years, in particular as a consequence of the various challenges the EU has faced, the UK's vote in June 2016 on its EU membership has accelerated this process. In this context, the main EU institutions have all contributed to the debate, while individual Member States or groups of Member States have also brought forward initiatives. The main positions are outlined in this 'at a glance' note.

This Study examines the functioning of EU Justice and Home Affairs (JHA) cooperation in light of the reforms and innovations introduced by the Lisbon Treaty since the end of 2009. It identifies the main challenges and deficits characterising the practical and effective implementation of these transformations and suggests specific ways for the European Parliament to address them. The Study recommends that that any future legislative reform or Treaty change should not promote or enable further differentiation ...

This Study examines the functioning of EU Justice and Home Affairs (JHA) cooperation in light of the reforms and innovations introduced by the Lisbon Treaty since the end of 2009. It identifies the main challenges and deficits characterising the practical and effective implementation of these transformations and suggests specific ways for the European Parliament to address them. The Study recommends that that any future legislative reform or Treaty change should not promote or enable further differentiation in the next generations of EU AFSJ cooperation. It should neither allow for restricting or ‘lowering down’ existing EU rights and freedoms enjoyed by European citizens and residents in EU JHA law. The Parliament should give priority to devising a mutual trust-building agenda for EU AFSJ cooperation based on three main policy actions focused on improving and strengthening: First, implementation and evaluation; Second, accountability, transparency and fundamental rights; and third, the rule of law and fundamental rights.

Nonetheless, the route chosen by the Member States to move forward has a major impact both on the legal certainty around any new instruments and on their democratic oversight. Recent developments in the field of economic and monetary union illustrate very well the difficulties which arise.

They aim at providing unique insights into the major questions of efficiency, effectiveness and legitimacy that the EU governance is currently facing. While dealing with the lessons from the past experiences of the differentiated integration, they put naturally a specific focus on current challenges with the respect to the Economic and Monetary union. They further analyse the impact of those developments on the European institutions and their decision-making processes and mechanisms of its legitimation. The compendium concludes with options for managing this increasing tension towards differentiation within the EU in the future.

In preparation for the discussions on the Committee's draft final report these meetings dealt with key questions of the crisis. The first briefing deals with the different ways of decision-making in the area of European Economic Governance; where six proposals are currently under discussion while economic governance and relative power in the EU are both in a state of flux. The second paper examines the financing of the real economy, in particular problems and policy options as regards investments that are growth-enhancing, generate employment and improve the sustainability of the economy.
