Public Hearing - A European Withholding Tax Framework

On 27 October 2021, from 09:00 to 11:15 (CET), the FISC Subcommittee held a public hearing on “A European Withholding Tax Framework” in order to examine how current withholding tax regimes create opportunities for tax avoidance, while at the same time causing significant barriers for companies and investors operating cross-border. The hearing will divided in two panels.

On the 1st panel, Prof. Dr. Nadine Riedel (University of Münster) and Prof. Dr. Arjan Lejour (CPB, Bureau for Economic Policy Analysis) will look at how current withholding tax regimes facilitate practices of profit-shifting and how to address the tax avoidance in this context. Moreover, Ms Olaya Argüeso Pérez (CORRECTIV) will present the most recent media revelations on cum-ex and cum-cum, known as the "CumEx-Files 2.0". On the 2nd panel, Prof. Dr. Lorenz Jarass (University of Wiesbaden), Mr. Paul Gibsy (Accountancy Europe) and Ms. Marlies de Ruiter (EY) will discuss how withholding tax relief procedures have created a complex system for companies and investors operating cross-border in the EU and how this leads to both double taxation and the use of fraudulent tax schemes such as the cum-ex scheme.

The FISC Subcommittee is currently working on an own-initiative report on the same topic, which will be discussed during the meeting after the public hearing.
