By letter of 21 January 2004 the Council consulted Parliament, under Articles 71 and 300 (2) and (3) first subparagraph, of the EC Treaty, on the proposal for a Council decision on the conclusion by the European Community of the Agreement on the Accession of the European Community to the Convention concerning International Carriage by Rail (COTIF) of 9 May 1980, as amended by the Vilnius Protocol of 3 June 1999 (COM(2003) 696 – 2003/0269(CNS)).
At the sitting of 28 January 2004 the President of Parliament announced that he had referred the proposal to the Committee on Regional Policy, Transport and Tourism as the committee responsible (C5‑0041/2004).
At its meeting of 17 February 2004 the Committee on Regional Policy, Transport and Tourism decided, on a proposal from the Chairman, to apply the simplified procedure under Rule 158(1), and the Chairman was thus appointed rapporteur.

The European Parliament,
– having regard to the Commission proposal to the Council (COM(2003) 696)[1],
– having regard to Articles 71 and 300 (2) and (3) first subparagraph, of the EC Treaty, pursuant to which the Council consulted Parliament (C5‑0041/2004),
– having regard to Rule 67 and 158(1) of its Rules of Procedure,
– having regard to the report of the Committee on Regional Policy, Transport and Tourism (A5‑0070/2004),
1. Approves the conclusion of the agreement;
2. Instructs its President to forward its position to the Council and Commission and the governments and parliaments of the Member States.
