By letter of 19 January 2004 the Commission submitted to Parliament, pursuant to Articles 251(2) and 175(1) of the EC Treaty, the proposal for a European Parliament and Council directive on the quality of fresh waters needing protection or improvement in order to support fish life (codified version) (COM(2004) 19 – 2004/0002(COD)).
At the sitting of 28 January 2004 the President of Parliament announced that he had referred the proposal to the Committee on Legal Affairs and the Internal Market as the committee responsible and the Committee on the Environment, Public Health and Consumer Policy for its opinion (C5‑0038/2004).
The Committee on Legal Affairs and the Internal Market appointed Sir Neil MacCormick rapporteur at its meeting of 19 February 2004.
At its meeting of 6 April 2004 the Committee on Legal Affairs and the Internal Market decided, on a proposal from the chairman, to apply the simplified procedure under Rule 158(1), and the chairman was thus appointed rapporteur.
The following were present for the decision on the chairman's proposal: Willi Rothley, Ioannis Koukiadis and Bill Miller (vice-chairmen), Uma Aaltonen, Ward Beysen, Bert Doorn, Janelly Fourtou, Marie-Françoise Garaud, Evelyne Gebhardt, Fiorella Ghilardotti, Malcolm Harbour, Sir Neil MacCormick, Hans-Peter Mayer (for Kurt Lechner), Manuel Medina Ortega, Elena Ornella Paciotti (for Carlos Candal), Anne-Marie Schaffner, Ian Twinn (for Lord Inglewood), Diana Wallis and Stefano Zappalà.
The Committee on the Environment, Public Health and Consumer Policy decided on 16 February 2004 not to deliver and opinion.
The report was tabled on 7 April 2004.
DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION
on the proposal for a European Parliament and Council directive on the quality of fresh waters needing protection or improvement in order to support fish life (codified version)
(COM(2004) 19 – C5‑0038/2004 – 2004/0002(COD))
(Codecision procedure)The European Parliament,
– having regard to the Commission proposal to the European Parliament and the Council (COM(2004) 19)[1],
– having regard to Articles 251(2) and 175(1) of the EC Treaty, pursuant to which the Commission submitted the proposal to Parliament (C5‑0038/2004),
– having regard to Rules 67, 89 and 158(1) of its Rules of Procedure,
– having regard to the report of the Committee on Legal Affairs and the Internal Market (A5‑0252/2004),
1. Approves the Commission proposal;
2. Calls on the Commission to refer the matter to Parliament again if it intends to amend its proposal substantially or replace it with another text;
3. Instructs its President to forward its position to the Council and Commission.
