on the discharge to the European Agency for Reconstruction for the financial year 2003

SUGGESTIONS
The Committee on Foreign Affairs calls on the Committee on Budgetary Control, as the committee responsible, to incorporate the following suggestions in its motion for a resolution:
1. Recognises that the creation of the European Agency for Reconstruction (EAR) was a confirmation of the European Union's intention of playing a leading role in reconstruction efforts in Kosovo, and welcomes the subsequent geographical extension of its mandate to Serbia and Montenegro (in 2000) and to the Former Yugoslav Republic of Macedonia (in 2001);
2. Is pleased to learn that the EAR has successfully made the shift from tangible emergency rehabilitation works towards longer-term sustainable development, promoting a market economy and supporting good governance and social development;
3. Notes that in 2003 the total portfolio overseen by the EAR was EUR 1.9 billion of which 81% was contracted and 67.5% disbursed for assistance programmes across its four operational centres (Belgrade, Podgorica, Pristina and Skopje), and that the EAR's total budget for 2003 was EUR 358.6 million, the bulk of which was for assistance programmes, and that out of the EUR 327.8 million of new EC credits received by the EAR in 2003, EUR 62.3 million was for Kosovo, EUR 200 million for Serbia, EUR 12 million for Montenegro and EUR 33.5 million for the Former Yugoslav Republic of Macedonia;
4. Is pleased to note that the average time taken by the EAR to make payments for assistance programmes in 2003 was 9 days;
5. Recognises the fact that the presence of the EAR's Director before the Committee on Budgetary Control, and on a later occasion before the Committee on Foreign Affairs, has been helpful in clarifying certain issues and providing explanations for certain situations which had been of genuine concern to the committee, in particular, the question of the allocation of tasks between the Commission's "deconcentrated" delegations in the region and the EAR's operational centres;
6. Takes note of the report by the Committee on Budgetary Control and endorses its remarks, in particular those with regard to the EAR's failure to observe the principle of non-differentiated appropriations as pointed out in the 2003 report by the European Court of Auditors (ECA); notes that, in the EAR's answers to the ECA's report, it states that it has now taken steps to clarify the financial presentation of its operation and that the problem should be resolved by the time the 2004 discharge procedure is due; encourages the EAR in its efforts to make speedy progress in this direction;
7. Endorses the position of the Committee on Budgetary Affairs encouraging the Commission and the ECA to reinforce their cooperation with the EAR in order to guarantee correctness and efficiency in the implementation of the EAR budget;
8. Reminds the EAR of the criteria applied by the ECA, namely the reliability of the accounts and the legality and regularity of the underlying transactions. The implementation of these criteria should be the basis of the 2004 discharge;
9. Notes, too, the remarks in the ECA report concerning problems - and the subsequent rectification thereof by the EAR - with the accounting system (single-entry book-keeping), as well as the response of the EAR to other perceived shortcomings; notes the reinforcement by the EAR of its accounting staff and instruments and the improvements due to take place in 2004, and the major changes made by the EAR to the tender system - which had been the object of criticism in the 2003 ECA report;
10. Welcomes the prompt action taken by the Director of the EAR when irregularities were discovered in the conclusion of one of the major infrastructure contracts and trusts that this practice of immediate and judicious response as well as of continued vigilance and appropriate risk analysis will be maintained;
11. Welcomes, too, the efforts of the EAR to reduce the number of authorising officers - as called for by the ECA - within a relatively short time;
12. Fully endorses the conclusion of the Committee on Budgetary Control in its expectation that the EAR "will undertake all the necessary actions to achieve a fully sound financial management".

SUGGESTIONS
The Committee on the Environment, Public Health and Food Safety calls on the Committee on Budgetary Control, as the committee responsible, to incorporate the following suggestions in its motion for a resolution:
EEA:
1. Expresses its satisfaction with the effective implementation of the 2003 budget;
2. Considers the European Environment Agency as a source of important environmental information for all EU institutions and policy-making; notes with satisfaction that the Agency has been able to transform some complicated technical data into user-friendly information and communicate its conclusions to the public; encourages the Agency to continue its efforts to further improve its communication methods;
3. Underlines the fact that the impact of environment programmes is often hampered by the lack of assessment of environmental impacts of other Community legislation and programmes; believes that the EEA could provide support for policy-making by further developing its work in the field of environmental impact assessment;
4. Emphasises the role of the EEA in the evaluation of the implementation of EU environmental legislation both within the EU and within prospective Member States;
EMEA:
5. Notes with satisfaction that the implementation of both the operating and the administrative budget has remained at a high level;
6. Notes that the European-wide pharmacovigilance reporting system (EudraVigilance database) is still not fully operational; calls on the Agency and the national authorities involved to finalise the work without further delay;
EFSA:
7. Notes that 2003 was the first operational year for the EFSA; expresses its satisfaction with the full implementation of both the operating and the administrative budget.

1. Is pleased to note that the Court of Auditors has been able to obtain reasonable assurance that the annual accounts for the financial year ended 31 December 2003 are reliable and that the underlying transactions, taken as a whole, are legal and regular;
2. Calls on Eurojust to take into account the observations made by the Court of Auditors and, in general, to ensure the sound financial management of its considerably increased budget;
3. Requests, in light of the serious difficulties to ensure appropriate funding for the growing number of independent agencies, the Dutch authorities as hosts of this prestigious institution to increase considerably the logistical support for Eurojust.
