Az Európai Parlament,
– tekintettel az EK-Szerződés 272. cikkére és az Euratom Szerződés 177. cikkére,
– tekintettel az Európai Közösségek[1] általános költségvetésére alkalmazandó költségvetési rendeletről szóló, 2002. június 25-i 1605/2002/EK, Euratom, tanácsi rendeletre, és különösen annak 37. és 38. cikkére,
– tekintettel az Európai Uniónak a 2005-ös pénzügyi évre vonatkozó, 2004. december 16-án véglegesen elfogadott általános költségvetésére[2],
– tekintettel az Európai Parlament, a Tanács és a Bizottság közötti, a költségvetési fegyelemre és a költségvetési eljárás javítására vonatkozó, 1999. május 6-i intézményközi megállapodásra[3],
– tekintettel az Európai Uniónak a Bizottság által 2005. március 30-án előterjesztett, 2005-ös pénzügyi évre vonatkozó, 2/2005. számú költségvetés-módosítási előzetes tervezetére (SEC(2005)0421),
– tekintettel a Tanács által 2005. március 30-án megállapított 2/2005. számú költségvetés-módosítási tervezetére (9491/2005 – C6‑172/2005),
– tekintettel eljárási szabályzata 69. cikkére és IV. mellékletére,
– tekintettel a Költségvetési Bizottság jelentésére (A6‑0190/2005),
A. mivel az állomány 2004-es fizetés-kiegészítése a vártnál alacsonyabb volt,
B. mivel a költségvetési hatóság kérte az intézményeket, hogy a fizetés-kiigazítás eredményeképpen nyújtson be becsléseket az igazgatási kiadásaik kiigazítása céljából,
C. mivel a költségvetés hatóság 2004. november 25-i nyilatkozatában azt kérte, hogy a szóban forgó költségvetési módosításban kizárólag az intézmények fizetések és nyugdíjak éves kiigazításából eredő igazgatási kiadásaira vonatkozó előirányzatai szerepelnek,
D. mivel a bizottsági javaslat a fizetési kiigazításhoz nem kapcsolódó igazgatási kérdéseket is magában foglalt;
1. egyetért az Európai Parlament, a Tanács, a Bíróság, a Számvevőszék, a Gazdasági és Szociális Bizottság, a Régiók Bizottsága, az európai ombudsman és az európai adatvédelmi biztos fizetéskiigazításaival Tanács 2/2005. költségvetési módosítástervezetében elfogadottak szerint;
2. úgy határoz, hogy kiigazítja a Bizottság költségvetését a 2/2005 a költségvetés módosítás előzetes tervezetében javasoltak szerint, és e célból költségvetési módosítást terjesztett elő;
3. egyetért a létszámtervvel (Számvevőszék és európai adatvédelmi biztos) és a nómenklatúra változásaival (Bizottság) a Tanács 2/2005. költségvetési módosítástervezetében elfogadottak szerint;
4. úgy határoz, hogy kiigazítja a bevételi számításokat (gazdasági és szociális Bizottság, valamint a Kiadói Hivatal) a 2/2005 a költségvetés módosítás előzetes tervezetében javasoltak szerint, és e célból két költségvetési módosítást terjesztett elő;
5. utasítja elnökét, hogy továbbítsa ezen állásfoglalást a 2/2005. költségvetés módosítástervezethez fűzött módosításokkal együtt a Tanácsnak és a Bizottságnak, valamint a többi érintett intézménynek és szervnek.
EXPLANATORY STATEMENT
The declaration by the Budgetary Authority of 25 November 2004 requested this amending budget to contain exclusively the reductions of appropriations for administrative expenditure of the institutions resulting from the annual adaptation of the salaries and pensions.
The Commission proposal for the preliminary draft amending budget (PDAB) 2/2005 concerns, however, the salary adjustment of all institutions, and includes some other, minor administrative, issues. The Committee of the Regions has not taken into account the full salary adjustment due to underestimations made in their calculations on the overall salary level.
Proposal for a preliminary draft amendment budget 2/2005
The purpose of this amending budget is to incorporate the decisions taken during the conciliation of 25 November 2004, regarding the adjustment of the administrative appropriations resulting from the annual adaptations of the salaries and pensions.
"The Budgetary Authority invites the Commission to submit not later than March 2005 an amending budget containing exclusively the reductions of appropriations for administrative expenditure of the institutions resulting from the annual adaptation of the salaries and pensions."
In April 2004, when calculating these appropriations for the 2005 budget, the parameter used was 2.6 %. The increase on salaries decided by the Council in December 2004 was only 0.7 %.
The Institutions have proceeded to a mechanical calculation of the related reductions of the appropriations as well as of the revenue, taking into account the cuts that had already been made by the budgetary authority, in anticipation of the reduction of the parameter. Due to some mistakes made in the initial estimates, the Committee of the Regions has not decreased its budget by the full amount relating to the salary adjustment.

– European Data-protection Supervisor: -38 572 EUR
TOTAL -58 513 087 EUR
This amending budget increases the margin of heading 5. Taken into account exclusively the reduction due to the adaptation of the salaries and pensions (EUR -58 513 087) the margin would be EUR 67 313 829.
Due to the uncertainties of the effects of the new staff regulations during the transition period, some Institutions could be confronted, at the end of 2005, with a shortage of appropriations for remunerations. Each Institution will try to cover its needs by transfers. However, the need to present an Amending Budget can not be excluded at this stage.
Additionally, some further modifications related to administrative expenditure are also proposed. These relate to amounts allocated to Commission's temporary support staff in the ex-Phare delegations and in headquarters, establishment plans of the Court of Auditor's and the European Data-protection Supervisor, and revenue-side of the Commission and the Economic and Social Committee.
Council's Draft Amending Budget
In comparison to the proposal presented by the Commission on PDAB 2/2005, the Council adopted in its Draft Amending Budget full salary adjustment for all institutions, including an additional reduction of EUR -8 875 971 in Section III (Commission) and of EUR -318 813 in Section VII (Committee of the Regions).
The Council agreed to the changes proposed by the Court of Auditors and the European Data-protection Supervisor concerning their establishment plans as well as changes in nomenclature. The Council did not agree to the changes proposed in the revenue calculation of the European Economic and Social Committee and the Publications Office.
Recommendation
The Co-Rapporteurs recommend the European Parliament to amend the Council's Draft Amending Budget to take into account the anticipatory cuts made by the Parliament in the 2005 budgetary procedure on the Commission's budget and therefore adopt the amounts proposed for Commission's administrative budget in the PDAB 2/2005. This will avoid double cuts and allow for the Commission to continue its recruitment of enlargement staff.
The Co-Rapporteurs recommend adjusting the revenue calculations of EESC and the Publications Office, as proposed in the PDAB 2/2005.
As regards the Committee of the Regions, Council's position to strictly adhere to salary adjustment and not to include the additional requests can be endorsed. The additional proposals by the Committee of the Regions can be solved through transfers later in the year.
The Co-Rapporteurs therefore recommend that Council's Draft amending budget 2/2005 is adopted with three modifications concerning the salaries of the Commission and revenues of the European Economic and Social Committee and the Publications Office and present the corresponding amendments.
