DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the proposal for a directive of the European Parliament and of the Council amending Council Directive 67/548/EEC in order to adapt it to Regulation (EC) of the European Parliament and of the Council concerning the registration, evaluation, authorisation and restriction of chemicals

The European Parliament,

–   having regard to the Commission proposal to the European Parliament and the Council (COM(2003)0644)[1],

–   having regard to Articles 251(2) and Article 95 of the EC Treaty, pursuant to which the Commission submitted the proposal to Parliament (C6-0531/2003),

–   having regard to Rule 51 of its Rules of Procedure,

–   having regard to the report of the Committee on the Environment, Public Health and Food Safety and the opinion of the Committee on Legal Affairs (A6-0285/2005),

1.  Approves the Commission proposal as amended;

2.  Calls on the Commission to refer the matter to Parliament again if it intends to amend the proposal substantially or replace it with another text;

3.  Instructs its President to forward its position to the Council and Commission.

Amendment 1

ARTICLE 1, POINT 1

Article 1, paragraph 1 (Directive 67/548/EEC)

(1) In Article 1, paragraph 1, points (a), (b) and (c) are deleted;

“1. The purpose of this Directive is to approximate the laws, regulations and administrative provisions of the Member States on the classification, packaging and labelling of substances dangerous to man and the environment, and of articles containing such substances, where such substances or articles are placed on the market in the Member States.”

Justification

Extends the scope of the directive to include articles that contain dangerous substances.

Amendment 2

ARTICLE 1, POINT 6

Article 23 (Directive 67/548/EEC)

(6) In Article 23, paragraph 2, the following point (g) is added:

 

“(g) the registration number, when available.”

“5. In the case of articles containing substances authorised under Article 57 of Regulation (EC) No of the European Parliament and of the Council [REACH]*, the label shall include a warning symbol. That symbol shall be defined by the Commission by …** in accordance with the procedure referred to in Article 29, and shall be included in the list contained in Annex II.

Justification

Introduces the requirement to affix an appropriate label on articles that contain dangerous chemical substances to make these safer for use by consumers.

This Directive shall enter into force on the twentieth day following its publication in the Official Journal of the European Union.

Justification

This is necessary to avoid a gap for new substances as the current regime will have to be applied until the obligation to register under REACH has to be applied.

EXPLANATORY STATEMENT

The Commission proposal aims to amend Directive 67/548/EEC relating to the classification, packaging and labelling of dangerous substances in order to adapt it to the new provisions concerning chemicals that will be adopted under the REACH Regulation, which is the subject of a separate Commission proposal (COM(2003) 644 - C5-0530/2003 - 2003/0256(COD)), submitted in parallel to this one.

In particular, the REACH Regulation will introduce for new chemicals the same registration obligations to which existing chemicals are subject. It is therefore necessary to repeal the corresponding rules laid down in Directive 67/548/EEC as well as the provisions on the obligations relating to information and the test methods to be used, which will be governed by the provisions of the REACH Regulation. Rules on the classification, packaging and labelling of dangerous substances are not, on the other hand, currently included in the REACH system and the relevant parts of Directive 67/548/EEC will therefore continue to be applicable.

Your rapporteur has confined himself to making few amendments to the proposal relating to Directive 67/548/EEC. These relate, in particular, to the introduction of a specific symbol on labels for articles containing chemical substances authorised under the REACH Regulation.

SHORT JUSTIFICATION

The purpose of the Commission proposal is to adapt Council Directive 67/548/EEC on the classification, packaging and labelling of dangerous substances to Regulation (EC) of the European Parliament and of the Council concerning the registration, evaluation, authorisation and restriction of chemicals (REACH).

The committee welcomes these adaptations, which are necessary to ensure uniform procedures for the registration of substances which are already on the Community market in connection with REACH.
