Il-Parlament Ewropew,

–   having regard to the initiative by the Kingdom of the Netherlands (6930/2005)[1],

–   having regard to Article 34(2)(c) of the EU Treaty,

–   having regard to Article 39(1) of the EU Treaty, pursuant to which the Council consulted Parliament (C6-0117/2005),

–   wara li kkunsidra l-Artikoli 93 u 51 tar-Regoli ta' Proċedura tiegħu,

–   having regard to the report of the Committee on Civil Liberties, Justice and Home Affairs (A6-0222/2006),

1.  Approves the initiative by the Kingdom of the Netherlands as amended;

2.  Jitlob lill-Kunsill sabiex b'konsegwenza, jemenda t-test;

3.  Jistieden lill-Kunsill sabiex jinforma lill-Parlament jekk ikollu l-ħsieb li jitbiegħed mit-test approvat mill-Parlament;

4.  Calls on the Council to consult Parliament again if it intends to amend the initiative by the Kingdom of the Netherlands substantially;

5.  Instructs its President to forward its position to the Council and Commission, and the government of the Kingdom of the Netherlands.

(3a) The basis for this decision is the Council Conclusions of 13 July 2001 on security at European Council meetings and other comparable events.

Ġustifikazzjoni

The objective of this proposal is to make contacts between the law enforcement authorities in the different Member States as effective as possible, and it has its basis in the Council Conclusions of 13 July 2001.

(3b) This decision builds on the arrangements provided for in Joint Action 97/339/JHA of 26 May 1997 adopted by the Council on the basis of Article K.3 of the Treaty on European Union with regard to cooperation on law and order and security1 and the Council Resolution of 29 April 2004 on security at European Council meetings and other comparable events2.

Ġustifikazzjoni

This proposal builds on the arrangements provided for in the Joint Action of 26 May 1997 and the Council Resolution of 29 April 2004 with a view to making the exchange of information provided for within that framework as effective as possible.

Ġustifikazzjoni

Recital 3b already refers to the Council Resolution. Furthermore, it should be emphasised that the proposed measures may on no account contravene the proportionality and subsidiarity principles or European rules on the protection of privacy.

Artikolu 3, paragrafu 1

If, following the expiry of this deadline, a Member State requests assistance in connection with an unanticipated event, the Presidency shall immediately add the further event to the overview and notify the Council thereof in confidence.

Ġustifikazzjoni

Some international events cannot be planned far in advance, or require special authorisation from the Member State where the event is to be held. In some cases, it is therefore not feasible to provide information concerning such events by 30 October of the respective calendar year. For that reason, the possibility of adding an unanticipated event to the overview of the international assistance expected to be required should be provided for.

Ġustifikazzjoni

Is must be cleared out that this mechanism doesn’t prejudice the activation of national contact points that function directly, in accordance with Action 97/339/JHA, that may continue to be a more effective instrument in what informal meetings are concerned. The reference proposed by the rapporteur to this joint action on the recitals doesn’t seam to be enough to clarify this link.

It seems that a confidential report on the results of the actions developed is contradictory to the fact that it might influence or determine future legislative changes. Therefore it must be rendered public and presented to other Community Institutions, mainly the European Parliament.

2. Member States shall forward the texts of such agreements to the General Secretariat of the Council no later than six months after the entry into force of this Decision.

2. Member States shall forward the texts of existing agreements and of new initiatives or those in the process of being developed to the General Secretariat of the Council.

3. Within one year at the latest, the Council shall discuss, on the basis of the results of the research referred to in the first paragraph,whether the main difficulties observed can be resolved by adapting the relevant European legislation,and in particular the Schengen Convention.

3. On the basis of the information obtained, theCouncil shall discuss the bottlenecks and difficulties observed and whether it is necessary to adapt the relevant European legislation.

Justification

A one-off review of the existing forms of cooperation between different Member States would only give a sketchy picture, as the existing bilateral and multilateral agreements between the different Member States are constantly evolving. In the rapporteur's view, there is little point to research into such forms of cooperation that is limited to a one-off stock-taking exercise. The task of providing assistance and conducting background research as set out in this Article needs to be carried out on an ongoing basis and to cover new initiatives and those in the process of being developed.

NOTA SPJEGATTIVA

Wieħed mill-objettivi fundamentali ta' l-Unjoni Ewropea huwa li toħloq zona ta' libertà, sigurtà u ġustizzja billi tiżviluppa azzjoni komuni fl-oqsma tal-koperazzjoni tal-pulizija u l-ġustizzja fi kwistjonijiet kriminali. Il-moviment ħieles tal-persuni fl-Ewropa jitlob li tittieħed din it-tip ta' azzjoni sabiex tpatti għan-nuqqas ta' kontrolli fuq il-fruntieri.

Diġà jeżistu interazzjoni u koperazzjoni bejn forzi tal-pulizija Ewropej differenti f'numru sostanzjali ta' oqsma. Din l-azzjoni konġunta għandha l-bażi legali tagħha fit-trattati internazzjonali, fil-ftehimiet bilaterali u f'forom ta' koperazzjoni Ewropea li ġejjin mill-objettiv stipulat fl-Artikolu 29 tat-Trattat UE. L-objettiv prinċipali huwa l-ġlieda kontra u l-prevenzjoni ta' reati kriminali.

Din l-inizjattiva proposta mir-Renju ta' l-Olanda bil-ħsieb li tiġi adottata Deċiżjoni tal-Kunsill timmira primarjament għaż-żamma ta' l-ordni u s-sigurtà pubblika, u l-prevenzjoni ta' u l-ġlieda kontra reati kriminali waqt avvenimenti internazzjonali li għalihom jattendu numri kbar ta' nies minn iżjed minn Stat Membru wieħed.

Hija proposta b'ambizzjoni limitata iżda b'daqshekk mhux anqas relevanti. Il-fiduċja, sistemi ta' komunikazzjoni tajbin bejn is-servizzi kkonċernati u l-pussess ta' informazzjoni ta' min jorbot fuqha għandhom irwol kruċjali fil-koperazzjoni internazzjonali. Preparazzjoni tajba hija ta' importanza vitali fil-prevenzjoni u l-kontroll ta' diżastri.

Il-koperazzjoni eżistenti fil-forma ta' ftehimiet bilaterali mhux dejjem twassal sabiex l-għanijiet Ewropej jintlaħqu.

Ir-rapporteur tagħkom għalhekk tappoġġja l-proposta li timmira lejn assistenza transkonfinali kemm jista' jkun effettiva permezz ta' arranġamenti li bihom il-Presidenza tal-Kunsill ta' kull sena għandha tfassal sommarju ta' l-assistenza internazzjonali mistennija li tkun meħtieġa fis-sena kalendarja ta' wara. L-Artikolu 3 tal-proposta jipprovdi li l-informazzjoni relevanti għandha tiġi sottomessa mill-Istati Membri lill-Presidenza sat-30 ta' Ottubru ta' kull sena. Madanakollu, ċerti avvenimenti internazzjonali ma jistgħux jiġu ppjanati sa minn kmieni ħafna, jew jeħtieġu awtorizzazzjoni speċjali mill-Istat Membru fejn l-avveniment ikun se jsir. Għalhekk mhux dejjem ikun possibbli li l-informazzjoni relevanti tkun ipprovduta sa minn kmieni ħafna. Ir-rapporteur tagħkom għalhekk qed tipproponi li tiġi pprovduta l-possibilità li fil-lista jiżdied avveniment li ma jkunx antiċipat.

L-arranġamenti proposti għas-sommarju li għalih jipprovdi l-Artikolu 4 huma wkoll, fl-opinjoni tar-rapporteur, strument utli sabiex il-koperazzjoni bejn il-forzi nazzjonali tal-pulizija jkunu effettivi kemm jista' jkun. Kull sena, qabel il-31 ta' Jannar, il-Kunsill għandu jippreżenta sommarju dwar l-assistenza internazzjonali pprovduta waqt is-sena kalendarja preċedenti. Is-sommarju għandu jinkludi ħarsa ġenerali lejn l-avvenimenti internazzjonali li seħħew, lejn l-assistenza pprovduta u rċevuta u ħarsa ġenerali lejn id-diffikultajiet prinċipali li ġew osservati mill-Istati Membri, kif ukoll rakkomandazzjonijiet dwar kif dawn id-diffikultajiet jistgħu jiġu solvuti.

Ix-xogħol ta' riċerka dwar l-isfond ġenerali u l-għoti ta' assistenza lis-Segretarjat Ġenerali tal-Kunsill skond l-Artikolu 5 ma jistax ikun limitat għal eżerċizzju ta' evalwazzjoni ta' darba biss. Dan għandu jsir fuq bażi kontinwa u jkopri l-inizjattivi bilaterali u multilaterali ġodda kif ukoll dawk li għadhom qed jiżviluppaw.

Fl-aħħarnett, ir-rapporteur tagħkom tixtieq li l-prevenzjoni ta' u l-ġlieda kontra l-kriminalità u l-protezzjoni tal-liġi u l-ordni jaqgħu essenzjalment fil-kompitu ta' l-Istati Membri. Din il-proposta timmira sempliċiment lejn titjib fil-koperazzjoni bejn l-Istati Membri differenti f'dan il-qasam billi jistabbilixxu qafas uniformi, trasparenti u effettiv għall-iskambju ta' informazzjoni. Din il-proposta, għaldaqstant, hija konformi mal-prinċipji tas-sussidjarjetà u l-proporzjonalità.

Għalhekk, ir-rapporteur tagħkom tappoġġja l-objettiv ta' din il-proposta, u l-proċedura li qed tiġi proposta, sakemm ir-responsabiltajiet amministrattivi fir-rigward tad-dmir li jiġu pprovduti l-informazzjoni u s-sommarju kif stipulat mill-proposta, jinżammu fuq livell minimu.

Aħna qegħdin nivvotaw kontra l-kamp ta' applikazzjoni tar-rapport u l-proposta tal-Kunsill għaliex ma joħolqux bilanċ xieraq bejn fuq naħa waħda l-bżonn li ssir ġlieda kontra r-reati serji transkonfinali, u fuq in-naħa l-oħra r-rispett lejn il-prinċipji demokratiċi bħad-dritt li persuni jinġabru f'numru kbir waqt avvenimenti (politiċi).

Il-mod kif inhi miktuba l-proposta preżenti jagħmilha applikabbli għall-avvenimenti u mases ta' nies minn pajjiżi differenti: dawn jistgħu jkunu logħbiet tal-futbol jew avvenimenti sportivi oħra, avvenimenti reliġjużi, żjarat statali jew laqgħat/'summits' politiċi. Il-kamp ta' applikazzjoni huwa sempliċiment wiesa' wisq. Barra minn hekk, fir-realtà ma jħallix id-definizzjoni tal-bżonnijiet għall-assistenza transkonfinali f'idejn l-Istati Membri li jospitaw l-avveniment.

Apparti dan, diġà teżisti ħafna koperazzjoni f'dan il-qasam. Eżempji ċari huma s-'summit' tal-G8 f'Ġenova u l-Logħob Olimpiku f'Ateni. Għalhekk mhux veru meta l-Kunsill jgħid li hemm bżonn li tittejjeb il-koperazzjoni internazzjonali tal-pulizija f'dan il-qasam.
