DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION
on the proposal for a Council regulation amending Council Regulation (EC) No 104/2000 on the common organisation of the markets in fishery and aquaculture products

The European Parliament,
– having regard to the Commission proposal to the Council (COM(2006)0233)[1],
– having regard to Article 37 of the EC Treaty, pursuant to which the Council consulted Parliament (C6‑0202/2006),
– having regard to Rule 51 of its Rules of Procedure,
– having regard to the report of the Committee on Fisheries (A6‑0311/2006),
1. Approves the Commission proposal;
2. Calls on the Council to notify Parliament if it intends to depart from the text approved by Parliament;
3. Asks the Council to consult Parliament again if it intends to amend the Commission proposal substantially;
4. Instructs its President to forward its position to the Council and Commission.

EXPLANATORY STATEMENT
The new European Agricultural Guarantee Fund (EAGF) laid down in Council Regulation (EC) No 1290/2005 on the financing of the common agricultural policy will replace the EAGGF Guarantee Section from 16 October 2006 in accordance with Article 3(2) of that Regulation. The EAGF will finance measures relating to fisheries markets.
Up to now the Commission has implemented the budget related to this expenditure by shared management with the Member States. The expenditure incurred in the implementation of Council Regulation (EC) No 104/2000 on the common organisation of the markets in fishery and aquaculture products has been financed by the Guarantee Section of the European Agricultural Guidance and Guarantee Fund (EAGGF) laid down in Council Regulation (EC) No 1258/1999 on the financing of the common agricultural policy. This expenditure comprises:
- aid to producers' organisations to offset costs linked to operational programmes for the fishing year;
- financial compensation for withdrawal;
- carry-over aid;
- autonomous withdrawal and carry-over by producers' organisations;
- aid for private storage;
- allowances for producers for tuna destined for the processing industry.
The budget for these measures amounts to around EUR 15 million per year.
From the entry into force of this amendment to Council Regulation (EC) No 104/2000, these measures relating to fisheries markets will be managed on a centralised basis by the Directorate-General for Fisheries.
It is necessary to amend Council Regulation (EC) No 104/2000 in order to enable the application of the EAGF as regards the financing of the expenditure relating to fisheries markets.
