DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the proposal for a regulation of the European Parliament and of the Council amending Regulation (EC) No …/… on nutrition and health claims made on foods

The European Parliament,

–   having regard to the Commission proposal to the European Parliament and the Council (COM(2006)0607)[1],

–   having regard to Article 251(2) and Article 95 of the EC Treaty, pursuant to which the Commission submitted the proposal to Parliament (C6‑0338/2006),

–   having regard to Rule 51 of its Rules of Procedure,

–   having regard to the report of the Committee on the Environment, Public Health and Food Safety (A6‑0404/2006),

1.  Approves the Commission proposal as amended;

2.  Calls on the Commission to refer the matter to Parliament again if it intends to amend the proposal substantially or replace it with another text;

3.  Instructs its President to forward its position to the Council and Commission.

(1) In Article 1(2), second subparagraph, Article 3(d), and Article 4(1), first and sixth subparagraphs, “Article 25(2)” is replaced by “Article 25 (3)”.	(1) In Article 1(2), second subparagraph, Article 1(4), Article 3(d), Article 4(1), first and sixth subparagraphs, Article 4(5), Article 8(2), Article 13(3) and (4), Article 17(3), Article 18(4), Article 23(3), Article 28(4)(b) and Article 28(6)(a)(ii), “Article 25(2)” is replaced by “Article 25(3)”.
Justification
National measures considered necessary by a Member State have to be notified 6 months before entering into force. If the Commission wants to prevent such national measures in a comitology procedure, the Parliament should have the right to oppose such a decision.
This specific Article should fall under the "Regulatory procedure with Scrutiny".
Amendment 2 ARTICLE 1, POINT 2 Articles 4, 8, 13 and 17 (Regulation EC No../..)
(2) In Article 4(5), Article 8(2), Article 13(3) and (4), and Article 17(3), “Article 25(2)” is replaced by “Article 25 (4)”.	deleted
Amendment 3 ARTICLE 1, POINT 3 Article 25, paragraph 4 (Regulation EC No../..)
4. Where reference is made to this paragraph, Article 5a(1) to (4) and (5)(b) and Article 7 of Decision 1999/468/EC shall apply, having regard to the provisions of Article 8 thereof.	deleted
The time-limits provided for in Article 5a(3)(c) and 4(b) and (e) of Decision 1999/468/EC shall be set at two months, one month and two months respectively.
