PROPUNERE DE REZOLUŢIE A PARLAMENTULUI EUROPEAN
privind proiectul de buget rectificativ nr. 1/2007 al Uniunii Europene pentru exerciţiul financiar 2007: acordul rezultat în urma reuniunii tripartite din 28 noiembrie 2006 – Fonduri Structurale, Fondul European pentru Pescuit, Fondul European de Investiţii şi Centrul Comun de Cercetare

Parlamentul European,
– având în vedere Tratatul de instituire a Comunităţii Europene, în special articolul 272 alineatul (4) penultimul paragraf,
– având în vedere Tratatul de instituire a Comunităţii Europene a Energiei Atomice , în special articolul 177,
– având în vedere Regulamentul (CE, Euratom) nr. 1605/2002 al Consiliului din 25 iunie 2002 privind Regulamentul financiar aplicabil bugetului general al Comunităţilor Europene[1], în special articolele 37 şi 38,
– având în vedere bugetul general al Uniunii Europene pentru exerciţiul financiar 2007, adoptat definitiv la 14 decembrie 2006,
– având în vedere Acordul interinstituţional din 17 mai 2006 dintre Parlamentul European, Consiliu şi Comisie privind disciplina bugetară şi buna gestiune financiară[2],
– având în vedere proiectul preliminar de buget rectificativ nr. 1/2007 al Uniunii Europene pentru exerciţiul 2007, prezentat de Comisie la 20 decembrie 2006 (SEC(2006)1776),
– având în vedere proiectul de buget rectificativ nr. 1/2007, pe care Consiliul l-a adoptat la… 2007 (00000/2007 – C6‑0000/2007),
– având în vedere articolul 69 şi anexa IV din Regulamentul său de procedură,
– având în vedere raportul Comisiei pentru bugete (A6-0010/2007);
A. întrucât sunt necesare rectificări tehnice astfel încât rezultatele reuniunii tripartite din 28 noiembrie să fie luate în considerare şi aplicate în bugetul Uniunii Europene pentru 2007;
B. întrucât scopul proiectului de buget rectificativ nr. 1/2007 este acela de a introduce aceste rectificări,
1. salută proiectul de buget rectificativ nr. 1/2007;
2. aprobă proiectul de buget rectificativ nr. 1/2007 nemodificat;
3. încredinţează Preşedintelui sarcina de a transmite prezenta rezoluţie Consiliului şi Comisiei.
EXPUNERE DE MOTIVE
Background
The aim of Preliminary Draft Amending Budget (PDAB) No 1 for the year 2007 is to integrate into the budget 2007 the necessary technical adjustments needed from the Amending Letter No°2/2007, which could not be taken on board during the last phase of the 2007 budget procedure, as accepted during the trialogue of 28 November 2006.
On the basis of the agreement reached at the trialogue meeting of 28 November, the budgetary authority accepted from Amending Letter No 2/2007 only the items concerning the European Global Adjustment Fund (EGF) and Hercule II. Moreover, the appropriations for the International Fund for Ireland were already included in the 1st reading of the 2007 draft budget by the EP and accepted in the Council's 2nd reading. It was agreed at the trialogue that other adjustments necessary to reflect the agreement achieved would be presented via an Amending Budget in view of their integration into the budget 2007 before its publication in the Official Journal foreseen for March 2007.
Draft amending budget No 1/2007 has confirmed the proposal of the Commission without changes and was adopted by the Comité Budgetaire on the 16 January and by COREPER on the 22 January (to be confirmed). As changes proposed in the Draft Amending Budget are indeed either technical or result from the conclusions of the negotiations of 28 November 2006, your rapporteur recommends to adopt the Draft amending budget No 1/2007 without amendments, in one single reading, in view of its final adoption by 1 February 2007.
Some more information on the modifications is provided below.
European Investment Fund
The remarks to budget line (01 04 09 01) which is to finance the Community participation to a planned capital increase of the European Investment Fund are updated and, also, a new revenue line is created which would allow any revenue arising from dividends paid by the Fund to be put back to the line. There is no change to the appropriations on the line (EUR 25 million in reserve approved in the budget procedure).
Revenue from the Swiss Confederation
The adjustments aim to take into account participation of the Swiss Confederation in some Community programmes based on the agreement concluded. They can therefore be accepted as technical.
Structural and Cohesion Funds and the European Fisheries Fund
Adjustments modify the distribution of the overall amount amongst particular budget lines, in line with the adopted legal bases and the figures presented in the Amending Letter no 2. They are budget-neutral, so that the overall envelope for Heading 1b remains unchanged.
Modifications concern, in particular:
- transfer of appropriations to the line of 'Cross Border Cooperation - contribution from Heading 1b' following the adoption of the legal base,
- a minor transfer of appropriations between objectives of the Fisheries Fund in line with the legal base,
- adjusting the breakdown of appropriations amongst different lines of ERDF and ESF, as well as adjusting payments/commitments ratio.
Health and Consumer Protection - update of legal base
The purpose of the adjustments is to take into account the new proposals for legal base and the split into separate lines for Consumer policy and Health therein, the latter one introduced at the request of the Parliament.
Platform of European Social NGOs - change of heading
The purpose of the proposed change is to shift the budgetary line 04 04 09 "Support for the running costs of the Platform of European Social NGOs" from heading 1a into heading 3b (Citizenship). This change is in line with the provisions of the recently adopted legal base.
Adjustments following modernisation of the accounting system
Those adjustments result from the modernisation of Commission's accounting system. Similar adjustments have already been accepted by the European Parliament when it adopted the Amending Budget No 5/2006. Those changes include creating a new budget line for European Development Fund (contribution to common administrative support expenditure).
Joint Research Centre - changes to the establishment plan
Modifications proposed introduce some changes into the establishment plan of the JRC. They are not completely financially neutral, but stay within the margin left by the appropriations for 2007.
The rationale for the changes is applying the same promotion criteria to the Commission's whole staff concerned by different establishment plans and adapting the establishment plan of the JRC to take into account the promotion threshold planned by the Commission for the exercise 2006. Moreover, an increase in the number of AD6 posts (accompanied by reduction of AD5 posts) is requested, as the staff that the JRC wanted to recruit following an AD5/AD6 competition could not be recruited at an AD5 level because of the high qualifications expected from the staff of the JRC (PHD, postgraduate and research experience).
Heading 4
The changes proposed concerning heading 4 can be summarised as follows:
a) Introduction of the references to the adopted legal bases and adjustment of the budget line titles to correspond to the final legal structure adopted.
b) Consolidation of the democracy and human rights lines into two main lines: one for the EIDHR as such (19 04 01), and one separate line for election observation (19 04 02). In this way the Parliament's demand that the agreement to limit election observation to a maximum of 25% of the overall programme is transparent. In addition, a new reference act (remark) to the election line has also been agreed by the Commission to further reflect this fact.
c) Creation of a new line entitled "civil protection interventions in third countries" (19 06 05) given that such actions will not be covered by the stability instrument but, instead, by the legal base on "xxxxxxx". The line would be endowed with EUR 5 million, compensated for by - 4 million for "Actions in the area of non-proliferation of weapons of mass destruction" (19 06 02 01) and -1 million for "Trans-regional actions in the areas of organised crime.....etc" (19 06 03), i.e. all within the same chapter.
d) For the so called "thematic actions", i.e. food security, NGOs, environment, human and social development etc, the AB1 will do away with the separate lines originally foreseen for interventions under the development instrument, on the one hand, and the neighbourhood instrument, on the other hand. Instead, as legally these actions will now all be covered by the development instrument, one single line per action is proposed. However, in order to maintain transparency, the Commission has agreed to introduce remarks specifying how much of these actions are intended for "neighbourhood countries". This ranges from about 3% to 9% depending on the line in question. For cooperation in the field of migration, also a thematic action, the separate lines for the two instruments is kept as, here, significant amounts are going to both of them.
e) With the adoption of the new European Regional Development Fund (ERDF), its contribution to cross-border cooperation under the external instruments was lower than originally foreseen. Therefore, the line for cross-border cooperation under the neighbourhood policy (19 08 02 01) will be reduced by EUR 18, 8 million. This is offset by a proportional increase for the MEDA and Eastern Europe lines (+ 12, 6 m and +6, 2 m respectively). The same operation is carried out under the pre-accession instrument where EUR 24, 7 million is taken from the cross-border element (22 02 04 02) and given to the lines for candidates countries and potential candidate countries respectively (+17, 3 m and + 7,4m).
