DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the proposal for a directive of the European Parliament and of the Council amending Directive 2005/32/EC establishing a framework for the setting of ecodesign requirements for energy-using products, and Council Directive 92/42/EEC and Directives 96/57/EC and 2000/55/EC of the European Parliament and of the Council, as regards the implementing powers conferred on the Commission

The European Parliament,

–   having regard to the Commission proposal to the European Parliament and the Council (COM(2006)0907)[1],

–   having regard to Article 251(2) and Article 95 of the EC Treaty, pursuant to which the Commission submitted the proposal to Parliament (C6‑0034/2007),

–   having regard to Rule 51 of its Rules of Procedure,

–   having regard to the report of the Committee on the Environment, Public Health and Food Safety (A6‑0222/2007),

1.  Approves the Commission proposal as amended;

2.  Calls on the Commission to refer the matter to Parliament again if it intends to amend the proposal substantially or replace it with another text;

3.  Instructs its President to forward its position to the Council and Commission.

Amendment 1

RECITAL 5 A (new)

 

(5a) In particular the Commission should be empowered to adopt implementing measures laying down ecodesign requirements for defined energy-using products, including the introduction of implementing measures during the transitional period, and to adopt guidelines accompanying these implementing measures. Since those measures are of general scope and are designed to supplement this Directive by the addition of new non-essential elements, they should be adopted in accordance with the regulatory procedure with scrutiny provided for in Article 5a of Decision 1999/468/EC.

Justification

The implementing measures laying down ecodesign requirements and the accompanying guidelines should be adapted to the regulatory procedure with scrutiny.

Amendment 2

ARTICLE 1, POINT - 1 (new)

Article 15, paragraph 1 (Directive 2005/32/EC)

 

(-1) In Article 15, paragraph 1 of Directive 2005/32/EC, the words "in accordance with the procedure referred to in Article 19(2)" are replaced by the words "in accordance with the procedure referred to in Article 19(2a)".

Justification

To adapt Directive 2005/32/EC to the regulatory procedure with scrutiny also article 15(1) on the adoption of the implementing measures should be adapted to this procedure.

Amendment 3

ARTICLE 1, POINT - 1 A (new)

Article 15, paragraph 10 (Directive 2005/32/EC)

 

(-1a) In Article 15, paragraph 10 of Directive 2005/32/EC, the words "in accordance with Article 19(2)" are replaced by the words "in accordance with Article 19(2a)".

Justification

To adapt Directive 2005/32/EC to the regulatory procedure with scrutiny also article 15(10) on the guidelines accompanying the implementing measures should be adapted to this procedure.

Amendment 4

ARTICLE 1, POINT - 1 B (new)

Article 16, paragraph 2 (Directive 2005/32/EC)

 

(-1b) In Article 16, paragraph 2 of Directive 2005/32/EC, the words "in accordance with the procedure laid down in Article 19(2)" are replaced by the words" in accordance with the procedure laid down in Article 19(2a)".

Justification

To adapt Directive 2005/32/EC to the regulatory procedure with scrutiny also Article 16(2) on the introduction of implementing measures during the transitional period should be adapted to this procedure.

Amendment 5

ARTICLE 1, POINT - 1 C (new)

Article 17 (Directive 2005/32/EC)

 

(-1c) Article 17 of Directive 2005/32/EC is replaced by the following:

Self-regulation

 

Voluntary agreements or other self-regulation measures presented as alternatives to implementing measures in the context of this Directive shall be assessed at least on the basis of Annex VIII in accordance with the regulatory procedure with scrutiny referred to in Article 19(2a)."

Justification

A reference to the regulatory procedure with scrutiny has been added to the existing article, to adapt Directive 2005/32/EC to the regulatory procedure with scrutiny also Article 17 and any eventual decision to consider a voluntary agreement or self-regulation on an EuP as an alternative to legally binding implementing measure (that the Commission otherwise would be required to propose when an EuP meets the criteria in Article 15).

EXPLANATORY STATEMENT

The Commission Proposal adapts the Ecodesign Directive[1] to the new comitology procedure (regulatory procedure with scrutiny)[2]. The Commission proposal brings new hot-water boilers, household electric refrigerators and freezers, and ballasts for fluorescent lighting (these were regulated under older directives, which were amended under the Ecodesign Directive)[3] under the new comitology procedure, but not the other new Ecodesign provisions (the adoption of implementing measures, the adoption of guidelines to accompany an implementing measure laying down ecodesign requirements and the introduction of implementing measures during the transitional period). The amendments ensure that also the new ecodesign provisions will fall under the regulatory procedure with scrutiny.
