Обосновка

The Commission proposal only partially aligns the comitology provisions of the Directive 2003/37/EC to the RPS procedure and maintains the (old) regulatory procedure for the application of Articles 15(2) and 19(2). Whereas the former concerns safeguard clauses of individual Member States, the latter concerns adaptation of the Annexes. Similarly to Article 39 of the recently adopted Directive 2007/46 on type-approval of vehicles, such provisions should come under the regulatory procedure with scrutiny.

Article 7 of Regulation (EC) No 1161/2005 is not modified at all by the Commission proposal, although it refers for a second time to the powers already conferred in Articles 2(2), 2(4), 3(3) and 6(1), and submits them via Article 8(2) to the (old) regulatory procedure. Moreover, modified provisions of Articles 2(2), 2(4), 3(3) and 6(1) submit the same powers to the regulatory procedure with scrutiny referred to in the new Article 8(3). At the same time, Article 7 does not contain a reference to Article 3(4), for which the regulatory procedure remains. Article 7 should therefore be deleted.

Обосновка

Only Article 61 is not aligned to the RPS procedure in the Commission proposal. This article provides for a general derogation clause for Member States and the Commission's margin of discretion is large. Such derogation can be regarded as a temporary modification of the Directive's scope of application, and as such (in line with the jurisprudence of the Court of Justice that indicated in Case C-168/93 that derogations to a basic act are in themselves measures of general scope) should also be adapted to the regulatory procedure with scrutiny.

EXPLANATORY STATEMENT

Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission[1] was amended by Council Decision 2006/512/EC of 17 July 2006[2]. Article 5a of amended Decision 1999/468/EC introduced the new 'regulatory procedure with scrutiny' (RPS) for measures of a general scope which seek to amend non-essential elements of a basic instrument adopted in accordance with codecision, inter alia by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements.

Following the screening of the existing legislation and on-going procedures[3], the European Commission presented inter alia this proposal, covering 59 legislative acts to be adapted to the new regulatory procedure with scrutiny (RPS).

In its decision of 12 December 2007 the Conference of Presidents designated the Committee on Legal Affaires as the lead Committee to deal with this 'comitology alignment' and the specialised committees as opinion-giving committees. The Conference of Committees Chairs agreed on 15 January 2008 on the modalities of cooperation between JURI and other committees involved.

The Rapporteur proposed to other committees that the alignment packages should be adopted as soon as possible, in order for the RPS procedure to start applying to the existing acquis before the entry into force of the Treaty of Lisbon (which contains important provisions on delegated acts, which will replace RPS, but which will take time to be adopted via codecision). The present Report contains a limited number of amendments that were suggested by other committees in their opinions, received in form of letters. One amendment is of a technical character, aiming at deletion of a superfluous Article in one of the regulations.

Regarding Omnibus - Part I

Regulation (EC) No 184/2005 of the European Parliament and of the Council of 12 January 2005 on Community statistics concerning balance of payments, international trade in services and foreign direct investment COM(2007)0741 – 2007/0262 (COD)

Regulation 184/2005 has three instances whereby comitology is used. In the Omnibus proposal, the Commission proposes the regulatory procedure with scrutiny for two of those instances, namely when setting of quality standards of statistics in the field, as well as the content and periodicity of the quality reports and when updating of data requirements and updating of definitions.

The regulatory procedure (without scrutiny, article 5 of the comitology decision) will continue to apply with regard to establishing the format and procedure for the transmission of data from the Member States to the Commission.

The only instance whereby the regulatory procedure with scrutiny will not apply cannot be considered to be a measure of general scope designed to amend non-essential elements of the Regulation or to supplement it since it only concerns decisions on "format" and "transmission" of data. For this reason, there are no strong arguments for a further use of the regulatory procedure with scrutiny procedure in the above mentioned Regulation. Therefore, it is the opinion of the International Trade Committee that no amendments to the Omnibus proposal are required in this regard.

Dear Rapporteur,

The Economic and monetary affairs committee (ECON) has looked at the three first "omnibus proposals[1]. We have noted that only the first text (COM(2007)0741) deals with some of our competencies in the points 5.1 and 5.8.

Point 5.1 Council regulation (EEC) No 696/93 of 15 March 1993 on statistical units for the observation and analysis of the production system in the Community

In general the proposal appears to be compatible with Decision 1999/468/EC as amended by Decision 2006/512/EC.

More precisely the proposal does the necessary adaptation by replacing the management procedure with the regulatory procedure with scrutiny in Article 6 concerning the adaptation of annexes.

The scope of the power in Article 5 is not entirely clear and should in an ideal situation be clarified in order to make sure no amendment of any elements of the basic acts are modified. However, in view of the very strict deadlines applicable to the present proposal, this does not seem indispensable.

Point 5.8 regulation (EC) No 1161/2005 of the European Parliament and of the Council of 6 July 2005 on the compilation of quarterly non-financial accounts by institutional sector

In this case also, the proposal seems to be compatible with Decision 1999/468/EC as amended by Decision 2006/512/EC with the notable exception of Article 7.

Articles 2(2), 2(4), 3(3) and 6(1) all contain provisions that would modify the obligations of the member States under the Regulation, constituting non essential elements of the basic instrument. The regulatory procedure with scrutiny is thus justified.

It is proposed that the power conferred on the Commission in Article 3(4) remain under the (normal) regulatory procedure. This power allows certain derogations for a limited time to the obligations of the Member States if national statistical systems require major adaptation. The measures allowed are thus temporary and transitional. On this basis it is possible to argue that they do not modify any non essential element in the sense of Article 2(2) of Decision 1999/468/EC.

However, a mistake appears to have been made in respect of Article 7 of regulation (EC) 1161/2005. This Article is not modified at all as the proposal stands.

This article refers a second time to the powers already conferred in Articles 2(2), 2(4), 3(3) and 6(1). It could therefore seem to be superfluous.

More important is to note that Article 7 submits these powers to Article 8(2) which refers to the (normal) regulatory procedure. The fact that this provision is not modified thus leads to a contradiction with Articles 2(2), 2(4), 3(3) and 6(1), which submit the same powers to the regulatory procedure with scrutiny. It can be added that Article 7 does not refer to the power of Article 3(4), which indeed is proposed to remain under the normal regulatory procedure.

Article 7 should be deleted. If that would not be agreed upon, it is indispensable to at least change the reference in Article 7 from Article 8(2) to Article 8(3).

We consequently request your committee to introduce an amendment deleting article 7.

On 15 January 2008, the President announced in plenary that he had received the above Commission proposal.

The proposal as a whole was referred to the Committee on Legal Affairs, as the committee responsible, while our Committee on Employment and Social Affairs was asked to deliver an opinion on the following parts of the Annex: point 2.1, point 2.2, point 2.3, point 2.4, point 2.5 point 2.6 and point 5.4.

These points of the Annex to the Commission proposal relate to the adjustment of the following legislative instruments:

Annex 2.1:     Council Directive 89/391/EEC of 12 June 1989 on the introduction of measures to encourage improvements in the safety and health of workers at work;

Annex 2.2:      Council Directive 92/29/EEC of 31 March 1992 on the minimum safety and health requirements for improved medical treatment on board vessels;

Annex 2.3:      Directive 2002/44/EC of the European Parliament and of the Council of 25 June 2002 on the minimum health and safety requirements regarding the exposure of workers to the risks arising from physical agents (vibration) (sixteenth individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC);  

Annex 2.4:     Directive 2003/10/EC of the European Parliament and of the Council of 6 February 2003 on the minimum health and safety requirements regarding the exposure of workers to the risks arising from physical agents (noise) (Seventeenth individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC);

Annex 2.5:     Directive 2004/40/EC of the European Parliament and of the Council of 29 April 2004 on the minimum health and safety requirements regarding the exposure of workers to the risks arising from physical agents (electromagnetic fields) (18th individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC);

Annex 2.6:     Directive 2006/25/EC of the European Parliament and of the Council of 5 April 2006 on the minimum health and safety requirements regarding the exposure of workers to risks arising from physical agents (artificial optical radiation) (19th individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC);

Annex 5.4:     Regulation (EC) No 1177/2003 of the European Parliament and of the Council of 16 June 2003 concerning Community statistics on income and living conditions (EU-SILC).

On 23 January 2008, the Committee on Employment and Social Affairs appointed the undersigned, its chairman, as draftsman of the opinion.

In accordance with the decisions of the Conference of Presidents of 12 December 2007 and the Conference of Committee Chairmen of 15 January 2008, a coordination meeting of the committees concerned took place on 31 January 2008. In the course of that meeting, most of the committees agreed to deliver their respective opinions in the form of a letter.

On 26 February 2008, the Committee on Employment and Social Affairs, on the basis of that agreement, considered the points of the Annex to the Commission proposal listed above.

Our committee considers that:

1.  the Commission proposal accords with the joint statement of the European Parliament, the Council and the Commission (OJ C 255 of 21 October 2006) on Decision 2006/512/EC and adjusts the basic instruments in accordance with the applicable procedures,

2.  the changes in question relate solely to comitology procedures.

The Committee on Employment and Social Affairs decided by 41 votes to 1, with 0 abstentions[1], to adopt the present OPINION in letter form and ask the Committee on Legal Affairs to approve without amendment those points of the Commission proposal on which it had been asked for its opinion.

The Committee on Industry, Research and Energy (ITRE) has scrutinized the instruments pertaining to its fields of competence included in the above mentioned proposals.

Having consulted the coordinators, I provide you in the form of the attached tables the opinion of ITRE on the alignment proposals.

After careful examination we have concluded that three instruments (Regulation 733/2002 on the .eu Top Level Domain, Council Regulation 3924/91 establishing a survey on industrial production and Directive 1999/5/EC on radio and telecommunications terminal equipment) are not correctly aligned, and that a fourth instrument (Directive 2004/8/EC on the promotion of cogeneration) requires a technical adaptation.

Furthermore, the review of the acquis communautaire in the field of telecommunications has revealed that the Radio Spectrum Decision 676/2002/EC (harmonisation measures in the field of spectrum) has been omitted by the Commission in its proposals for alignment. We agree with the rapporteur's approach to group all the omitted acts and under Rule 39 request the Commission to submit further legislative proposals to align these instruments.

Concerns: IMCO Opinions on the Proposals "Adaptation to the Regulatory Procedure with Scrutiny

Dear Colleague,

At its meeting of 18 February 2008, the Committee on the Internal Market and Consumer Protection discussed and adopted three opinions on the legislative proposals adapting the comitology provisions of a list of legislative instruments to the "regulatory procedure with scrutiny" ("RPS"):

- COM (2007)0741 'First Omnibus'

- COM (2007)0824 'Second Omnibus'

- COM (2007)0870 Recast Directive on Textile Names

The three letter opinions were adopted unanimously (by 19 votes).

At the same time, the Committee wishes to register a protest at the excessively tight timetable established and which does not allow adequate time for Committee deliberation on the issues. This is all the more regrettable in view of the number of suggestions the Committee considered necessary for the two omnibus proposals. The IMCO Committee expressed serious concerns about this being indicative of the poor quality of the preparation of the proposals by the Commission, and accordingly asks you to relay this to the European Commission.

I trust that, as agreed at the working level, your Committee will adopt all of the IMCO suggestions without modification.

Dear Mr Gargani, dear colleague,

The Committee on Transport and Tourism at its meeting of 26 February 2008 has examined the proposal referred above pursuant to the decision of the Conference of Presidents (CoP) of 12 December 2007 to designate the Committee on Legal Affaires as the lead Committee to deal with the revision of existing legislative measures to be adapted to the new regulatory procedure with scrutiny and to ensure that the specialised committees are associated by opinions.

The Committee on Transport and Tourism unanimously recommends your Committee, as the committee responsible, to accept the twelve instruments of the Commission's proposal which fall under the remit of the Committee on Transport and Tourism (list in annex).

Monsieur le Président,

Le 15 Janvier 2008, le Président a annoncé en plénière la proposition de règlement citée en objet et la saisine au fond de la commission des affaires juridiques pour l'ensemble de la proposition.

La commission du développement régional a été saisie pour avis en ce qui concerne le point de l'annexe qui se réfère à l'adaptation de l'acte législatif suivant :

§ Annexe point 5.3: Regulation (EC) No 1059/2003 of the European Parliament and of the Council of 26 May 2003 on the establishment of a common classification of territorial units for statistics (NUTS) COM(2007)0741 – 2007/0262 (COD)

En accord avec les décisions de la Conférence des Présidents du 12 Décembre 2007 et de la Conférence des Présidents de Commissions du 15 Janvier 2008, une réunion de coordination des commissions concernées a eu lieu le 31 janvier 2008. Lors de cette réunion la plupart des commissions parlementaires ont accepté de délivrer leur position sous forme de lettre.

Le 26 février 2008, la commission du développement régional m'a nommé, en tant que Président de cette commission, rapporteur pour avis.

En raison de la brièveté des délais impartis, la proposition susmentionnée a été examinée par les coordinateurs de la commission au cours de leur réunion du 12 mars 2008 à Strasbourg.

Au cours de sa réunion du 26 mars 2008, la commission du développement régional a ratifié la proposition de ses coordinateurs de ne pas faire objection à cette proposition de règlement.
