DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council common position for adopting a regulation of the European Parliament and of the Council establishing a European Training Foundation (recast)

The European Parliament,

–   having regard to the Council common position (11263/4/2008 – C6‑0422/2008),

–   having regard to its position at first reading(1) on the Commission proposal to Parliament and the Council (COM(2007)0443),

–   having regard to the amended Commission proposal (COM(2007)0707),

–   having regard to Article 251(2) of the EC Treaty,

–   having regard to Rule 67 of its Rules of Procedure,

–   having regard to the recommendation for second reading of the Committee on Employment and Social Affairs (A6‑0473/2008),

1.  Approves the common position;

2.  Notes that the act is adopted in accordance with the common position;

3.  Instructs its President to sign the act with the President of the Council pursuant to Article 254(1) of the EC Treaty;

4.  Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to have it published in the Official Journal of the European Union;

5.  Instructs its President to forward its position to the Council and the Commission.

EXPLANATORY STATEMENT

Procedure

On 14 May 2008, the EP reached an agreement with the Council on the text of the new regulation. Due to the fact that, on 22 May 2008, amendments were adopted in plenary that were contrary to this agreement, a second reading became necessary. The Common Position of the Council was announced in Plenary on 20 November 2008 and is identical to the agreement reached in May 2008, besides some linguistic adaptations.

In the meantime, a majority of the political groups in EMPL confirmed their commitment to the agreement reached in May with the Council.

Consequently, the Common Position can be adopted without amendments.

Content

The Common Position includes many of the amendments of the EMPL committee. They main changes compared to the proposal of the Commission concern the scope of the Regulation, the functions of the agency, the general provisions, the Governing Board and the appointment of the ETF Director.

The question how the relation between the EP and the Agency could be strengthened, and how the EP could be represented on the Governing Board has been solved. Article 7 foresees, as part of the Governing Board, "three non-voting experts appointed by the European Parliament". The Parliament is free to nominate either external personalities or Members and it will be Parliament's responsibility to choose its preferred level of representation at the Governing Board. Additionally, the director will be invited to make a statement before the competent committee(s) of the European Parliament and answer questions put by its/their members before his appointment (Article 10).

Furthermore, the agreement largely follows the proposal of the Commission to broaden ETF’s thematic remit, to cover human capital development, in particular education and training in a lifelong perspective, as well as related labour market issues.

Finally, the ETF’s geographical scope has been updated and redefined by reference to the new European Union's external relations policy instruments and priorities. According to the report of Mr Lehideux, a more flexible procedure is possible permitting the Foundation to take action outside the areas specified in Article 1a and 1b.
