EXPLANATORY STATEMENT
The international audiovisual landscape has undergone a transformation over the last twenty years notably because of the impact of technological developments such as multi-channel digital television, IPTV and WebTV, digital cinema projection as well as video on demand (VOD). In some foreign markets this has created strong financial growth, promising investments and consequently, a growing demand for more audiovisual content. However, structural weaknesses affecting the circulation of European works on foreign markets and inadequate financing of European audiovisual companies are preventing the industry from benefiting fully from this expansion of global opportunities.
The European audiovisual industry has increased and improved quite significantly during the recent years while facing many new challenges and changes relating to the emergence of the digital environment. However, the circulation of European audiovisual works on international market still remains limited. Audiovisual works from third countries other than those from Hollywood studios face a similar problem of limited circulation on European markets, although there is a demand for more diverse audiovisual content.
It has become clear that the priority should be therefore given to increasing the competitiveness of the EU audiovisual industry on the global market as well as increasing consumer choice and cultural diversity on the European and international markets especially with the current opportunities offered by digital and online technologies, appearing unlimited.
MEDIA 2007
Like the previous generation of MEDIA programmes, the MEDIA 2007 programme focuses on preproduction and post-production activities, in particular distribution and promotion. With a budget of €755 million over seven years (2007- 2013), this programme aims to support the European audiovisual sector whilst adapting to new challenges. The MEDIA 2007 programme has therefore been adapted to take into account the latest developments in technology and on the EU market resulting from the digital revolution and the EU enlargements, and thus reflects the consequences of digitisation and addresses specific problems of audiovisual professionals in the new Member States.
Its objectives of preserving European cultural diversity and heritage, of increasing the circulation of European audiovisual works and of strengthening the competitiveness of the European audiovisual sector are being achieved and films supported by this programme have known remarkable success[1]. However the international dimension of the supporting of distribution of audiovisual works was not contained within its remit.
In order to tackle new problems and challenges arising from the internationalisation of markets affecting the European audiovisual sector, the European Parliament adopted, on 13 December 2007, for the 2008 budget, a Preparatory Action MEDIA International focusing on developing European Union relations with third-country audiovisual markets in order to satisfy the immediate needs of third countries and to improve the overall effectiveness of MEDIA 2007. This was necessary as the legal basis of MEDIA 2007 did not allow the implementation of actions in cooperation with third countries.
Preparatory action MEDIA international
With a budget of €2 million for actions in 2008, MEDIA International has been planned to operate for up to three years in order to explore efficient ways of structuring and strengthening relations and networks between the EU and third countries' professionals in the audiovisual sector, for the mutual benefit of the European industry and the third countries involved. This preparatory action falls under the aegis of the Convention of UNESCO on cultural diversity, the MEDIA 2007 programme and the provisions on cultural cooperation in the free trade agreements and other existing or currently negotiated agreements. Operating on the basis of reciprocity, the actions which have been envisaged, to achieve international cooperation in the audiovisual sector include continuous training, promotion of cinematographic works by encouraging the reciprocal circulation of cinematographic works and support of international cinema networks.
The first call for project proposals was launched in spring 2008. Eighteen projects have been selected. Among these selected projects the "Cartoon Connection" project, organising a joint training on developing and financing international co-produced cartoons for professionals from the EU, Latin America and Canada or the "European Producers' Club", supporting the promotion and distribution of audiovisual works helping companies to access foreign funding.
On 18 December 2008, the European Parliament approved a budget of €5 million for the second year of activity of the Preparatory Action MEDIA International (2009). Calls for proposals launched in February 2009 cover different areas aiming to support training, promotion, distribution of cinematographic works through long-term cooperation between European and non-European professionals, screening of cinematographic works in cinemas and increasing potential audiences for audiovisual/cinematographic works.
This preparatory action has paved the way for a broader EU support programme for global cooperation in the audiovisual industry sector and lead to the adoption by the Commission in January 2009 of a proposal to establish the MEDIA Mundus programme. The initial success of the Preparatory Action MEDIA International has actually revealed the importance of the strong demand worldwide for cooperation with the European film industry. The structure of the proposed programme is quite similar to this preparatory action.
The proposal on the establishment of the MEDIA Mundus programme
In the context of the globalisation of audiovisual services, the external dimension of audiovisual policy is taking on increasing importance. The Commission’s proposal on the establishment of the Media Mundus programme therefore represents a real commitment to effective multilateralism in the audiovisual sector and to engaging EU professionals with international partners, to the mutual benefit of the audiovisual sectors. Intensified exchange and cooperation with non-European third countries will strengthen the competitiveness of the European audiovisual sector and create further added value in terms of promotion, market access, distribution, dissemination and exhibition of European works in third countries. This proposal also constitutes a significant step in the context of the UNESCO Convention on cultural diversity as it will be the first programme at the international level which implements directly the Convention on the Protection and Promotion of the Diversity of Cultural Expressions.
With a budget of €15 million of funding for the period 2011-2013 for projects submitted by audiovisual professionals from Europe and third countries, the programme will offer new opportunities for international cooperation in the audiovisual industry and will increase consumers’ choices, bringing more culturally diverse products to European and international markets. Cooperation with third countries could help in particular some cultural industries and professionals in developing countries which face difficulties in improving their knowledge and infrastructure regarding distribution, marketing, promotion and exhibition facilities whilst the limited circulation of cultural works and services prevent the development of markets for cultural industries in those countries.
The programme is open to projects based on partnerships consisting of a minimum of three partners, each partnership being coordinated by an EU professional and including at least one non-EU partner (Article 2 to Article 4). The programme aims at increasing the competitiveness of the European audiovisual industry as well as consumer choice and cultural diversity, and enabling Europe to play its cultural and political role in the world (Article 5). To this respect the proposal describes three specific objectives for the programme ie. to increase information exchange, training and market intelligence, to improve competition and distribution on the one hand and circulation on the other part. These three objectives are themselves supported by operational objectives (described in Article 6 to Article 8) and actions to be implemented (described in Annex).
Rapporteur's position
The Rapporteur has continually expressed her support for the implementation of such a programme and has always expressed her willingness to ensure regular funding for this international cooperation in the audiovisual sector. The Rapporteur therefore welcomes the Commission proposal as it may provide the appropriate cultural answer to the specific needs of audiovisual industries, as well as to global technological challenges, whilst paving the way to a more effective implementation of the UNESCO Convention on Cultural Diversity.
However, a number of points still require further clarification. To make the text more coherent and consistent, the Rapporteur proposes a set of amendments aiming at improving the overall structure of the proposal in order to make it clearer and more efficient.
For instance, Article 5 dealing with the general and specific objectives of the programme has been deleted (Am. 12). For better consistency, the general objectives of the programme have been included in Article 1 (Am. 10) and the three specific objectives of the programme have been respectively included in Article 6, Article 7 and Article 8 (Am. 15, Am. 17 and Am.19).
Article 9 dealing with the implementation of the operational objectives has also been deleted (Am. 20) and merged with Article 11 "the implementation of Decision" (Am. 21) for more coherence.
Some terms have been specified (Am. 2). The Rapporteur prefers the term "general" objectives to "global" objectives, which is more relevant (Am. 10), and the concept of "international networking" to "international networking effect" (Am. 11).
Unless further clarified and detailed in the legislative act, the general guidelines and the selection criteria mentioned in Article 11, paragraph 2, points (c) and (d), designed to amend non-essential elements of this Decision, should be adopted in accordance with the regulatory procedure with scrutiny provided for in Article 5a of Decision 1999/468/EC (Am. 3, Am. 4, Am. 22, Am. 23, Am. 24 and Am. 28).
