MOTION FOR A EUROPEAN PARLIAMENT RESOLUTION
on Draft amending budget No 4/2009 of the European Union for the financial year 2009, Section III – Commission

The European Parliament,
– having regard to Article 272 of the EC Treaty and Article 177 of the Euratom Treaty,
– having regard to Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities[1], and particularly Articles 37 and 38,
– having regard to the general budget of the European Union for the financial year 2009, as finally adopted on 18 December 2008[2],
– having regard to the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management[3],
– having regard to Preliminary draft amending budget No 4/2009 of the European Union for the financial year 2009, which the Commission presented on 8 April 2009 (SEC(2009)0496),
– having regard to Draft amending budget No 4/2009, which the Council established on 27 April 2009 (9126/2009 – C6‑0156/2009),
– having regard to Rule 69 of and Annex IV to its Rules of Procedure,
– having regard to the report of the Committee on Budgets (A6‑0281/2009),
A. whereas Draft amending budget No 4 to the general budget 2009 covers the revision of the ceilings of the multiannual financial framework for Headings 1a and 2,
B. whereas the purpose of Draft amending budget No 4/2009 is to formally enter these budgetary adjustments into the 2009 budget,
1. Takes note of Preliminary draft amending budget No 4/2009;
2. Approves Draft amending budget No 4/2009 unamended;
3. Instructs its President to forward this resolution to the Council and the Commission.
EXPLANATORY STATEMENT
According to Article 37(1) of the Financial Regulation, the Commission may present preliminary draft amending budgets, if there are "unavoidable, exceptional or unforeseen circumstances".
Content of Commission Proposal
During the trialogue of 2 April held between the budgetary authority and the Commission an agreement was reached on the financing of the European Economic Recovery Plan, namely two regulation proposals, respectively on financing projects in the field of energy and on financing broadband in rural areas and support rural development in the light of the mid term review of the Common Agricultural Policy (Health Check).
Following the agreement, the Commission came up with a PDAB by which it proposes to foresee in budget 2009:
- commitment appropriations of 2bn and payments appropriations of 76,2 million for energy projects to aid economic recovery;
and
- commitment appropriations of 600 million EUR for broadband Internet infrastructure in rural areas and Agricultural policy Health Check.
As for Energy Projects Regulation proposal the lines involved in the PDAB are as follows :

As for Broadband Infrastructure and Agricultural Policy Health Check the increase foreseen by the PDAB 4/2009 is of 600 million EUR on item 05 04 05 01 in commitment appropriations for 2009.
This amending budget is linked with the draft Decision amending the Interinstitutional Agreement on 17 May 2006 as for the Multiannual Financial Framework (Böge Report) by which Heading 1a ceiling shall be increased of 2 bn EUR in 2009 by decreasing the ceiling of Heading 2 by the same amount.
As for the global agreement reached on 2 April on the 5 bn EUR for the Economic Recovery Plan, the budgetary authority agreed that the remaining 2,4 bn EUR would be secured through a compensation mechanism by using all means foreseen in its legal framework and without prejudice to the financial envelopes of the co-decided programmes and the annual budgetary procedure on the occasion of 2010 budgetary procedure negotiations and, if needed, at the latest under 2011 budgetary procedure negotiations.
The Rapporteur recommends to adopt the DAB 4/2009 unamended.
