on the proposal for a Council regulation setting up a network for the collection of accountancy data on the incomes and business operation of agricultural holdings in the European Community (codified version)

The European Parliament,

–   having regard to the Commission proposal to the Council (COM(2009)0125),

–   having regard to Article 37(2) of the EC Treaty, pursuant to which the Council consulted Parliament (C7‑0005/2009),

–   having regard to the Interinstitutional Agreement of 20 December 1994 – Accelerated working method for official codification of legislative texts[1],

–   having regard to Rules 86 and 55 of its Rules of Procedure,

–   having regard to the report of the Committee on Legal Affairs (A7-0031/2009),

A. whereas, according to the Consultative Working Party of the legal services of the European Parliament, the Council and the Commission, the proposal in question contains a straightforward codification of the existing texts without any change in their substance,

1.  Approves the Commission proposal as adapted to the recommendations of the Consultative Working Party of the legal services of the European Parliament, the Council and the Commission;

2.  Instructs its President to forward its position to the Council and the Commission.

Proposal for a Council regulation on setting up a network fàor the collection of accountancy data on the incomes and business operation of agricultural holdings in the European Community (codified version)

COM(2009)125 of 18.3.2009 – 2009/0040(CNS)

Having regard to the Inter-institutional Agreement of 20 December 1994 on an accelerated working method for official codification of legislative texts, and in particular to point 4 thereof, the Consultative Working Party, consisting of the respective legal services of the European Parliament, the Council and the Commission, met on 25 March 2009 for the purpose of examining, among others, the aforementioned proposal submitted by the Commission.

At that meeting[1], an examination of the proposal for a Council Regulation codifying Regulation No 79/65/EEC of the Council of 15 June 1965 setting up a network for the collection of accountancy data on the incomes and business operation of agricultural holdings in the European Economic Community resulted in the Consultative Working Party’s establishing, by common accord, as follows.

1) In the English language version of the codification proposal, in Article 2(d) the words "with a view to the selection or returning holdings" should be adapted so as to read "with a view to the selection of returning holdings".

2) The wording of Article 5(1) should be adapted so as to read as follows "The field of the survey referred to in Article 1(2)(a) shall cover the agricultural holdings having an economic size equal to, or greater than, a threshold expressed in Euro corresponding to one of the lower limits of the economic size classes as defined in the Community typology".

3) In Article 18(1), the words "consisting of representatives of the Member States and chaired by the Commission representative" should be removed.

4) The entire wording of paragraph 3 of Article 18 should be removed. As a consequence of that change, the three following paragraphs of the same article should be renumbered.

5) In Annex I, in the list relating to Spain item no. 9 should read "Baleares", and at the end of the list relating to Romania the wording "However, Romania constitutes a single division until 31 December 2009" should be removed.

In consequence, examination of the proposal has enabled the Consultative Working Party to conclude, without dissent, that the proposal is a straightforward codification of existing texts, without any change in their substance.

• [1]  The Consultative Working Party had at its disposal 22 language versions of the proposal and worked on the basis of the English version, being the master-copy language version of the text under discussion.
