The European Parliament,
– having regard to the Commission proposal to the European Parliament and the Council (COM(2009)0142),
– having regard to Article 251(2) and Article 152 of the EC Treaty, pursuant to which the Commission submitted the proposal to Parliament (C7‑0047/2009),
– having regard to its resolution of 23 September 2008 with recommendations to the Commission on the alignment of legal acts to the new Comitology Decision[1],
– having regard to Rule 55 of its Rules of Procedure,
– having regard to the report of the Committee on Legal Affairs and the opinion of the Committee on the Environment, Public Health and Food Safety (A7‑0036/2009),
1. Approves the Commission proposal as amended;
2. Calls on the Commission to refer the matter to Parliament again if it intends to amend the proposal substantially or replace it with another text;
3. Instructs its President to forward its position to the Council and the Commission.

EXPLANATORY STATEMENT
Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission[1] was amended by Council Decision 2006/512/EC of 17 July 2006[2]. Article 5a of amended Decision 1999/468/EC introduced the new 'regulatory procedure with scrutiny' (RPS) for measures of a general scope which seek to amend non-essential elements of a basic instrument adopted in accordance with codecision, inter alia by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements.
Following the screening of the existing legislation and on-going procedures[3], the European Commission presented four package proposals, covering 225 legislative acts to be adapted to the new regulatory procedure with scrutiny (26 other acts were earlier covered by separate legislative proposals and dealt with by respective Parliament committees).
In its decision of 12 December 2007 the Conference of Presidents designated the Committee on Legal Affairs as the lead committee to deal with the 'general comitology alignment' and the specialised committees as opinion-giving committees. The Conference of Committees Chairs agreed on 15 January 2008 on the modalities of cooperation between JURI and other committees involved.
By the time of finalising the work on the fourth part of the general alignment, the Legal Affairs Committee also asked other committees if they have identified additional existing legal acts that would also require adaptation to the new comitology procedure. Eventually, a resolution was adopted by Parliament on 23 September 2008, calling on the Commission to present an adequate proposal in order to complete the alignment as regards 14 legal acts.
In response to the Parliament's resolution, the European Commission presented this proposal, covering only two legislative acts to be adapted to the new regulatory procedure with scrutiny. Among the remaining 12 acts from the Parliament's list, six were found to have already been aligned, one act not suitable for alignment to RPS as not being covered by codecision, one act adopted after the new comitology procedure was available, and four acts not containing (in the view of the Commission) provisions falling under the regulatory procedure with scrutiny.
The Rapporteur proposed to the Committee on Environment, Public Health and Food Safety that this package should be adopted as soon as possible, in order for the RPS procedure to start applying to the two acts before the entry into force of the Treaty of Lisbon (which contains important provisions on delegated acts, which will replace RPS, but which will take time to be adopted via codecision). The present draft Report thus contains only one amendment, but other amendments will most probably be received separately from the Committee on Environment, Public Health and Food Safety in its formal Opinion. With regard to the other acts from the list annexed to its resolution, the Parliament should reserve its right to verify the findings of the Commission, and act accordingly in the near future.
