NACRT ZAKONODAVNE REZOLUCIJE EUROPSKOG PARLAMENTA

o prijedlogu Uredbe Europskog parlamenta i Vijeća o smjernicama za transeuropske telekomunikacijske mreže i stavljanju izvan snage Odluke br. 1336/97/EZ

Europski parlament,

–   uzimajući u obzir prijedlog Komisije upućen Europskom parlamentu i Vijeću (COM(2013)0329) i izmijenjeni prijedlog (COM(2013)0329),

–   uzimajući u obzir članak 294. stavak 2. i članak 172. Ugovora o funkcioniranju Europske unije, u skladu s kojima je Komisija podnijela prijedlog Parlamentu (C7‑0149/2013),

–   uzimajući u obzir članak 294. stavak 3. Ugovora o funkcioniranju Europske unije,

–   uzimajući u obzir mišljenje Europskog gospodarskog i socijalnog odbora od 22. svibnja 2012.(1),

–   uzimajući u obzir mišljenje Odbora regija od 7. srpnja 2012.(2),

–   uzimajući u obzir članak 55. Poslovnika,

–   uzimajući u obzir izvješće Odbora za industriju, istraživanje i energetiku i mišljenja Odbora za okoliš, javno zdravlje i sigurnost hrane, Odbora za unutarnje tržište i zaštitu potrošača, Odbora za regionalni razvoj i Odbora za kulturu i obrazovanje (A7‑0272/2013),

1.  usvaja sljedeće stajalište u prvom čitanju;

2.  poziva Komisiju da predmet ponovno uputi Parlamentu ako namjerava znatno izmijeniti svoj prijedlog ili ga zamijeniti drugim tekstom;

3.  nalaže svojem predsjedniku da stajalište Parlamenta proslijedi Vijeću, Komisiji i nacionalnim parlamentima.

(1) Telekomunikacijske mreže i usluge sve više postaju infrastrukture temeljene na internetu što dokazuju međusobno usko povezane širokopojasne mreže i digitalne usluge. Internet postaje dominantna platforma u području komunikacija, usluga i poslovanja. Stoga je opća dostupnost pristupa brzom internetu i digitalnim uslugama diljem Europe nužna za gospodarski rast i jedinstveno tržište.

(1) Digitalne mreže i usluge sve više postaju infrastrukture temeljene na internetu što dokazuju međusobno usko povezane širokopojasne mreže i digitalne usluge. Internet postaje dominantna platforma u području komunikacija, usluga, obrazovanja, sudjelovanja u društvenom i političkom životu i poslovanja. Stoga je opća dostupnost pristupa raširenom, brzom i sigurnom internetu i digitalnim uslugama diljem Europe nužna za društveni i gospodarski rast, konkurentnost, društvenu uključenost i jedinstveno tržište.

(4a) Zbog razvoja širokopojasnih i brzih širokopojasnih mreža i digitalnih usluga doći će do pojačane potrebe za europskim tehničkim standardima. Programi istraživanja i razvoja Europske unije i pojačani nadzor standardizacijskih postupaka nužni su da bi Unija imala središnju ulogu u telekomunikacijskoj industriji.

(5) Opsežna pilot-istraživanja među državama članicama sufinancirana iz Programa za konkurentnost i inovacije, poput PEPPOL-a, STORK-a, epSOS-a, eCODEX-a ili SPOCS-a, potvrdila su ključne prekogranične digitalne usluge na unutarnjem tržištu, na temelju zajedničkih obrazaca. Te su usluge već postigle, ili će tek postići, razinu zrelosti koja je nužna za njihovo uvođenje. Postojeći projekti od zajedničkog interesa već su jasno potvrdili kako djelovanje na razini Europe znači dodanu vrijednost, na primjer, u području kulturne baštine (Europeana), zaštite djece (Program za sigurniji internet - eng. Safer Internet), socijalne zaštite (EESSI), dok su predloženi i drugi projekti, poput onih o zaštiti potrošača (ODR).

Što se tiče infrastruktura digitalnih usluga, obrasci imaju prednost pred ostalim infrastrukturama digitalnih usluga, jer su oni preduvjet za potonje. Infrastrukture digitalnih usluga trebale bi, među ostalim, stvoriti europsku dodanu vrijednost i zadovoljiti provjerene potrebe. Trebale bi biti dovoljno zrele za uvođenje, tehnički i operativno, što je dokazano naročito kroz uspješnu provedbu pilot-istraživanja. Trebale bi se temeljiti na konkretnom planu održivosti radi osiguravanja dugoročnog rada platformi za osnovne usluge izvan Instrumenta za povezivanje Europe (CEF-a). Stoga bi financijsku pomoć u skladu s ovom Uredbom trebalo vremenom postupno ukidati, gdjegod je to moguće, a mobilizirati financiranje iz izvora izvan Instrumenta za povezivanje Europe.

Što se tiče infrastruktura digitalnih usluga, obrasci i infrastrukture digitalnih usluga s elementima koje mogu koristiti drugi pružatelji usluga imaju prednost pred ostalim infrastrukturama digitalnih usluga, jer oni čine osnovu na koju se potonji nadovezuju. Infrastrukture digitalnih usluga trebale bi, među ostalim, stvoriti europsku dodanu vrijednost i zadovoljiti provjerene potrebe. Trebale bi biti dovoljno zrele za uvođenje, tehnički i operativno, što je dokazano naročito kroz uspješnu provedbu pilot-istraživanja. Trebale bi se temeljiti na konkretnom planu održivosti radi osiguravanja dugoročnog rada platformi za osnovne usluge izvan Instrumenta za povezivanje Europe (CEF-a). (8) Infrastrukture digitalnih usluga koje su potrebne kako bi se ispunile zakonske obveze u skladu sa zakonodavstvom Europske unije i/ili razvili ili osigurali obrasci, s mogućim snažnim učinkom na razvoj paneuropskih javnih usluga, trebale bi imati prednost pri financiranju radi podržavanja višestrukih infrastruktura digitalnih usluga i postupne izgradnje europskog ekosustava interoperabilnosti. U ovom se kontekstu pod zakonskim obvezama podrazumijevaju posebne odredbe kojima se zahtijeva bilo razvijanje ili uporaba infrastruktura digitalnih usluga, bilo rezultati koji se mogu ostvariti jedino kroz europske infrastrukture digitalnih usluga.

(11) Digitalnim planom za Europu propisano je da bi do 2020. svi Europljani trebali imati brzinu pristupa internetu veću od 30 Mbps i da bi 50 % ili više europskih kućanstava trebalo biti pretplaćeno na internetske veze brže od 100 Mbps.

Europsko tržište s gotovo 500 milijuna ljudi spojenih na brzu širokopojasnu mrežu djelovalo bi poticajno na razvoj unutarnjeg tržišta. To bi tržište imalo globalno jedinstvenu kritičnu masu korisnika i pružalo svim regijama nove mogućnosti, a svakom korisniku povećanu vrijednost, dok bi Uniji osiguralo mogućnost da bude vodeće svjetsko gospodarstvo koja se temelji na znanju. Brzo uvođenje brzih širokopojasnih mreža presudno je za razvoj europske produktivnosti i nastanak novih i malih poduzeća koja mogu biti vođe u različitim sektorima, na primjer u zdravstvu, proizvodnji i uslužnim industrijama.

(11c) Dok je uporaba optičkih i ultrabrzih širokopojasnih veza u Uniji i dalje na nezadovoljavajućoj razini, druga gospodarstva u svijetu preuzimaju globalno vodstvo ponudom znatno većih kapaciteta i brzina od 1 Gbps i više. Ključno je ulagati u optičke veze, i u kućanstvima i u pasivnoj infrastrukturi sporedne mreže, ako je cilj Unije postati središte inovativnosti, znanja i usluga.

(13b) Osigurati da potrošači mogu lako pristupiti sadržaju, uslugama i aplikacijama prema svom izboru i dijeliti ih putem jedinstvene internetske pretplate od ključne je važnosti kako bi se zaokružilo jedinstveno digitalno tržište Unije. U tom kontekstu, rezultati BEREC-ovog istraživanja iz svibnja 2012. pokazuju da se barem 20 % korisnika mobilnog interneta u Europi suočava s određenim oblikom ograničene mogućnosti pristupa VoIP uslugama. Iako se očekuje da će natjecanje disciplinirati operatore, napredak je vrlo spor pa bi javno financiranim telekomunikacijskim mrežama na koje se odnosi ova Uredba trebalo zabraniti blokiranje zakonitih usluga.

(19a) Postoji potreba za prikupljanjem informacija i statističkih podataka o javnim radovima za koje je vjerojatno da će se koristiti, djelomice ili u potpunosti, za instaliranje mreža nove generacije, i za uspostavom baze podataka za nadzor tih radova i izrade europskog registra telekomunikacijskih mreža, uz nadopunu, gdje je to moguće, sličnim informacijama o energetskim i prometnim mrežama.

S tim ciljem, stručna skupina sudjeluje u strukturiranoj suradnji sa subjektima uključenim u planiranje, razvoj i upravljanje telekomunikacijskim mrežama i uslugama poput, između ostalog, lokalnih i regionalnih tijela, nacionalnih regulatornih tijela i Tijela europskih regulatora za elektroničke komunikacije (BEREC), pružatelja usluga pristupa internetu, administratora javnih mreža i proizvođača komponenti.

 

Komisija i Europska investicijska banka posebnu pozornost posvećuju primjedbama stručne skupine i javno opravdavaju sve slučajeve u kojima takve primjedbe nisu uzete u obzir. Komisija obavještava stručnu skupinu, na svakom od svojih sastanaka, o napretku ostvarenom u provedbi radnog programa.

SHORT JUSTIFICATION

The purpose of this Regulation is to establish, in the context of the Connecting Europe Facility, which forms part of the Europe 2020 strategy, a series of guidelines covering the objectives and priorities for broadband networks and digital service infrastructures in the field of telecommunications.

The regulation identifies projects of common interest for the deployment of broadband networks and digital service infrastructures, aimed at improving the competitiveness of the European economy, promoting the interconnection and interoperability of national networks and supporting the development of a Digital Single Market, in addition to helping reduce greenhouse gas emissions and protect the environment.

The establishment of cross-border access to a digital public service interoperable infrastructure is an area where the EU can contribute high added value. Such public administration services include the cross-border delivery of eHealth services, which is particularly relevant to the remit of the Committee on the Environment, Public Health and Food Safety.

Interoperable cross-border eHealth services would allow interaction between citizens and health operators, data transfers between institutions, access to electronic health records and electronic prescription services and remote health/assisted living tele-services. eHealth services would help improve patient safety, reduce medical costs, modernise national healthcare systems and increase their efficiency.

The rapporteur agrees and endorses the Commission proposal and, at the same time, wishes to put forward a number of amendments to make the projects of common interest in the field of electronic public administration more effective.

Interoperable cross-border eHealth services, in particular, should provide for health and hospital services to adopt a harmonised standard for electronic data and document presentation, including codification systems common to the Member States to establish a standard terminology for individual health services. A common minimum set of electronic data and documents should also be established as the basic record for patients covered by interoperable eHealth services (e.g. blood factor, anamnesis, discharge letters, etc.).

More generally, it is to be hoped that electronic public administration projects will result in a single European identification code which ordinary citizens and businesses can use in their relations with public administration services in all Member States.

(10) Substantial economic and social benefits, which cannot be captured nor monetised by investors, are associated with higher broadband speeds. Fast and ultra-fast broadband is the key enabling infrastructure for the development and deployment of digital services, which rely on the availability, speed, reliability and resilience of the physical networks. The deployment and take-up of faster networks opens the way for innovative services exploiting higher speeds. Action at Union level is necessary to maximise the synergies and interactions between those two components of digital telecommunications networks.

Fast and ultra-fast broadband is the key enabling infrastructure for the development and deployment of digital services, which rely on the availability, speed, reliability and resilience of the physical networks. The deployment and take-up of faster networks opens the way for innovative services exploiting higher speeds. Action at Union level is necessary to maximise the synergies and interactions between those two components of digital telecommunications networks. Universal access to broadband networks is essential for the growth of modern economies and for individual wellbeing and digital inclusion. Extension of broadband networks in rural and economically and socially less-favoured areas will facilitate better communications, particularly for persons with reduced mobility or living in isolated conditions, as well as improving access to services and encouraging the development of SMEs in rural areas, thereby helping to create new jobs and develop new services in these localities;

The establishment of a single European identification code for online services, which can be used by all citizens and businesses in every Member State, would make relations with the public administration significantly easier and provide a more effective guarantee of genuine interoperability.

Justification

To enable the eHealth service to operate effectively, a ‘European health record’ should be adopted, using a single data presentation standard and, in particular, clearly indicating the data which will form the patient’s basic record (e.g. blood factor, anamnesis, discharge letters following recovery, emergency service reports, etc.).

SHORT JUSTIFICATION

The rapporteur congratulates the Commission which has proposed guidelines for trans- European telecommunications networks, thereby helping to honour the commitments made in the Europe 2020 Strategy and the Digital Strategy for Europe.

This proposal draws up guidelines for trans-European telecommunications networks. In so doing, it proposes objectives and priorities for projects of common interest aimed at eliminating bottlenecks by providing network connectivity and access, including across borders, to digital public service infrastructures.

At this period of austerity measures and low economic growth, your rapporteur hopes that the new tools proposed by the Commission in the interconnection mechanism for Europe will give a fresh market impetus to help achieve the Digital Single Market.

The internet economy and its importance for employment are capital and will be worth more than EUR 800 billion in 2016, more than 5% of the GDP of the European Union. The internet has changed our way of life and work, how we access information and how individuals interact and has considerable potential to change many other aspects of our lives, such as access to knowledge and education. The internet has also transformed the way we compare, sell or buy products and services, or seek or make available information, and manage our payments and our data. E-commerce and more generally digital services are now central to the lives of consumers, businesses and citizens in general.

But a number of obstacles are now blocking the completion of Digital Single Market: a lack of investment in broadband infrastructure, particularly in rural areas of the EU, and the lack of a European strategy for the development of digital cross-border services infrastructure. The cost of this deficit is estimated at at least 4.1% of GDP by 2020, or EUR 500 billion or EUR 1 000 per citizen(1).

Your rapporteur considers that this situation is particularly problematic for SMEs, which, lacking connection to a network of sufficient quality and speed, are unable to benefit from new technologies like 'cloud computing' which allow an innovative commercial approach and significant economies of scale.

Your rapporteur is also concerned that the lack of access to ultra-fast broadband internet harms the most vulnerable consumers. Without this, they are deprived of access to a whole range of new applications or services, for example comparing prices online, and the most advantageous offers pass them by.

Your rapporteur therefore wishes to stress the importance of the objective of the Digital Agenda for Europe: securing lasting economic and social benefits through a Single Digital Market based on ultra-fast broadband.

Your rapporteur would like to emphasize the importance of cyber-security in ensuring that consumers are protected. Digital services play an ever-increasing role in our daily lives, and in this connection use a volume of personal or public data that is constantly increasing. A safe and secure online environment is therefore an imperative.

Your rapporteur endorses the Commission's analysis that the failure to complete the Digital Single Market is due to a supply problem, but also to problem of demand. Thus one of the objectives of projects of common interest should be to stimulate demand for fast and ultra-fast broadband, in particular through e-government services.

The European Union must act above all to remedy market failures. In order to strengthen its territorial cohesion, the EU must ensure that even the most sparsely populated or isolated areas have good access to telecommunications infrastructure.

Other organisations which have SMEs and citizens as their key customers should play a greater role.

(3) On 17 June 2010, the European Council endorsed the Digital Agenda for Europe and called upon all institutions to engage in its full implementation. The Digital Agenda aims to chart a course to maximise the social and economic potential of information and communication technologies, in particular through the deployment of high-speed broadband networks by seeking to ensure that by 2020 all Europeans have access to internet speeds of above 30 Mbps and 50% or more of European households subscribe to internet connections above 100 Mbps. The Digital Agenda aims to establish a stable legal framework to stimulate investments in an open and competitive high speed internet infrastructure and in related services; a true single market for online content and services; active support for the digitisation of Europe's rich cultural heritage, and the promotion of internet access and take-up by all, especially through support of digital literacy and accessibility. In addition, Member States should implement operational national plans for high speed internet, targeting public funding on areas not fully served by private investments in internet infrastructures and promote deployment and usage of modern accessible online services.

SHORT JUSTIFICATION

This regulation on guidelines for trans-European telecommunications networks forms part of the Europe 2020 strategy for smart, sustainable and inclusive growth.

The regulation provides a framework for developing broadband networks in line with the targets set for the Digital Agenda for Europe flagship initiative and lays down relevant objectives and priorities for this purpose.

This flagship initiative sets some rightly ambitious targets for the EU in the field of digital infrastructures. The aim is to provide universal coverage at 30Mbps or to ensure that at least 50% of European households are subscribing to speeds of above 100Mbps by 2020.

These plans, as set out in the section entitled 'Purpose of the proposal' will help to boost our economy and to improve the competitiveness of European businesses, which include a very large number of SMEs.

Fast and ultra-fast broadband will give to our businesses and public administrations a tangible advantage over their counterparts in the new emerging global powers. If Europe is to go about meeting the challenges of becoming a leader in the application of cutting-edge technologies and to do so properly and systematically, then Member States must coordinate their efforts in the development of broadband networks.

However, in order to achieve real and meaningful results, it is essential to recognise the importance of culture as a vehicle for development in the EU.

Culture, starting with basic education and going right through to high-level scientific research, is the cornerstone of all development processes. Investment in this area must be in keeping with the Europe 2020 targets to ensure that the major advances expected in the field of research and innovation are mirrored by equivalent advances in European society as a whole. Any failure to take the role of culture seriously would be extremely damaging and would be a severe brake on progress within the EU.

The Digital Agenda aims to chart a course to maximise the social and economic potential of information and communication technologies, in particular through the deployment of high-speed broadband networks by seeking to ensure that by 2020 all Europeans have access to internet speeds of above 30 Mbps and 50% or more of European households subscribe to internet connections above 100 Mbps. The Digital Agenda aims to establish a stable legal framework to stimulate investments in an open and competitive high speed internet infrastructure and in related services; a true single market for online content and services; active support for the digitisation of Europe's rich cultural heritage, and the promotion of internet access and take-up by all, especially through support of digital literacy and accessibility. In addition, Member States should implement operational national plans for high speed internet, targeting public funding on areas not fully served by private investments in internet infrastructures and promote deployment and usage of modern accessible online services.

In the projects to be financed, account should be taken of the principle of technological neutrality, which is vital for an open Internet.

The benefits of a safer environment online should be for all citizens, yet need to respect the principle of an open Internet.

5. Actions contributing to projects of common interest shall be eligible for EU financial support under the conditions and instruments available under the Regulation establishing the Connecting Europe Facility [REF]. Financial support shall be provided in accordance with the relevant rules and procedures adopted by the Union, funding priorities and the availability of resources.

Actions contributing to projects of common interest and necessary to ensure the provision of broadband services shall be eligible for EU financial support under the conditions and instruments available under the Regulation establishing the Connecting Europe Facility [REF]. Financial support shall be provided in accordance with the relevant rules and procedures adopted by the Union, funding priorities and the availability of resources. This support shall come on top of assistance provided under other Community programmes and initiatives, including the Structural Funds. The Commission shall make sure that measures to support projects of common interest do not act as a disincentive to the implementation of public- and/or private-sector initiatives which are already under way or are being prepared and may not receive funding under other Community and national instruments.

1. The Union may establish contacts, discuss, exchange information and cooperate with public authorities or any other organisations in third countries to achieve any objective pursued by these guidelines where such cooperation gives rise to a European added value. Among other objectives, this cooperation shall seek to promote the interoperability between the trans-European telecommunication networks and telecommunication networks of third countries.
