The European Parliament,

–   having regard to the Commission proposal to Parliament and the Council (COM(2013)0327),

–   having regard to Article 294(2), Article 43(2) and Article 168(4)(b) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C7-0167/2013),

–   having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

–   having regard to the opinion of the European Economic and Social Committee of 16 October 2013[1],

–   after consulting the Committee of the Regions,

–   having regard to Rule 55 of its Rules of Procedure,

–   having regard to the report of the Committee on Agriculture and Rural Development and the opinions of the Committee on Budgets and the Committee on the Environment, Public Health and Food Safety (A7-0424/2013),

1.  Adopts its position at first reading hereinafter set out;

2.  Calls on the Commission to refer the matter to Parliament again if it intends to amend its proposal substantially or replace it with another text;

3.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

(7) Furthermore, in its proposal for a multiannual financial framework for 2014-2020, the Commission suggests the creation of an emergency mechanism to react to crisis situations. Consequently, in case of exceptional circumstances like emergency situations related to animal and plant health, when the appropriations under budget heading 3 are insufficient but emergency measures are necessary, funds from the Reserve for crises in the agricultural sector should be transferred in accordance with the Interinstitutional Agreement of… between the European Parliament, the Council and the Commission on cooperation in budgetary matters and on sound financial management10.

(7) Furthermore, Union-level funding should be provided in order to cope with exceptional circumstances like emergency situations related to animal and plant health, when the appropriations under budget heading 3 are insufficient but emergency measures are necessary. Funding in order to cope with such crises should be mobilised by drawing, for example, on the flexibility instrument, in accordance with the Interinstitutional Agreement of… between the European Parliament, the Council and the Commission on cooperation in budgetary matters and on sound financial management10.

(10) The Union has the responsibility to ensure that funds are properly spent but also to take measures to respond to the need to simplify its spending programmes in order to reduce the administrative burden and the costs for beneficiaries of funds and for all actors involved, in line with the Communication from the Commission to the European Parliament, the Council, the European Economic and Social Committee and the Committee of the Regions – Smart Regulation in the European Union11. For cost effectiveness reasons, both at level of the Commission and of the Member States, grants under a certain ceiling should not be granted anymore.

(22) By way of derogation from Article 86 and as an exception as referred to in Article 130 of Regulation (EU, Euratom) No 966/2012, the costs for the emergency measures covered by Articles 7 and 17 of this Regulation should be eligible as from the date of notification of the occurrence of a disease or the presence of a pest by the Member State to the Commission due to the urgent and unforeseeable nature of those measures. The corresponding budgetary commitments and the payment of eligible expenditure should be made by the Commission, after assessment of the payment applications submitted by the Member States, using, if appropriate and needed, the reserve for crises in the agricultural sector.

(22) By way of derogation from Article 86 and as an exception as referred to in Article 130 of Regulation (EU, Euratom) No 966/2012, the costs for the emergency measures covered by Articles 7 and 17 of this Regulation should be eligible as from the date of notification of the occurrence of a disease or the presence of a pest by the Member State to the Commission due to the urgent and unforeseeable nature of those measures. (28) In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission with regard to the establishment and amendment of the lists of animal diseases and zoonoses which qualify for Union funding, as well as the establishment of work programmes. When amending the list of animal diseases qualifying for emergency measures funding, the Commission should take into account the animal diseases which must be notified in accordance with Council Directive 82/894/EEC of 21 December 1982 on the notification of animal diseases within the Community15. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by the Member States of the Commission's exercise of implementing powers16.

(28) In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission in respect of the implementation of annual work programmes. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by the Member States of the Commission's exercise of implementing powers16.

(28a) In order to supplement or amend certain non-essential elements of the current regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of adding to the lists of animal diseases and zoonoses which qualify for Union funding, the priorities to be reflected in the Commission’s work programme, the essential evaluation criteria for the national programmes and the list of specific tasks of particular importance for the Union which benefit from a rate of Union funding of 100%.

 

When adding to the list of animal diseases qualifying for emergency measures funding, the Commission should take into account the animal diseases which are to be notified in accordance with Council Directive 82/894/EEC of 21 December 1982 on the notification of animal diseases within the Community16a.

Exercise of the delegation

 

1. The power to adopt delegated acts is conferred on the Commission subject to the conditions laid down in this Article.

 

2. The power to adopt the delegated acts referred to in this Regulation shall be conferred on the Commission for a period of seven years from the date of entry into force of this Regulation. The Commission shall draw up a report in respect of the delegation of power not later than nine months before the end of the seven-year period. The delegation of power shall be tacitly extended for periods of an identical duration, unless the European Parliament or the Council oppose such extension no later than three months before the end of each period.

 

3. The delegation of power referred to in this Regulation may be revoked at any time by the European Parliament or by the Council. A decision to revoke shall put an end to the delegation of the power specified in that decision. It shall take effect the day following the publication of the decision in the Official Journal of the European Union or at a later date specified therein. It shall not affect the validity of any delegated acts already in force.

 

4. As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.

 

5. A delegated act adopted pursuant to this Regulation shall enter into force only if no objection has been expressed either by the European Parliament or the Council within a period of two months from the notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object. That period shall be extended by two months at the initiative of the European Parliament or of the Council.

EXPLANATORY STATEMENT

This Regulation is part of the ‘Smarter rules for safer food’ legislative package. The package contains four sectoral pieces of legislation on animal health, plant health, plant reproductive material and official controls, as well as a horizontal regulation bringing together the financial provisions: the expenditure management regulation. As with the whole package, the expenditure management regulation aims to simplify the legislative framework for the safety of the food supply chain.

The new Regulation will repeal and amend accordingly 11 previous acts. It takes over and for the most part brings together existing provisions in a single text. However, three new aspects in particular should be noted.

First, the proposal rationalises the funding rates by creating three maximum rates: a normal maximum rate of 50%, a derogating maximum rate of 75% for cross-border actions and for Member States with a gross GNI per capita below 90% of the European average, and a maximum rate of 100% for actions to control serious health risks, specific actions targeted by the Commission in its work programme and actions carried out in third countries.

As it is currently difficult to evaluate actions carried out in the EU, the Commission is also proposing to establish specific indicators to improve assessment of the impact of policies relating to the safety of the food supply chain.

In addition, survey programmes relating to the presence of pests have been established to prevent the growing threats to plant health.

Budget and minimum amount of grants

The Commission is proposing an overall budget of EUR 1 892 million at current prices. A breakdown should be provided of all expenditure as it indicates the relative priorities given to the different parts of the programme. The budget is only indicative, so as to allow a certain degree of flexibility in the allocation of funds.

On the other hand, for cost-effectiveness reasons the Commission proposal suggests setting a threshold of EUR 50 000, below which no grants would be awarded. Preventive measures (surveillance) are less costly than control measures; this high threshold therefore seems to be dissuasive given that prevention policy is also encouraged. When a measure is presented ​​for a limited geographic area within a Member State this amount may not be reached at a time when there is a risk of a disease spreading. This threshold should therefore be removed.

Access to the crisis reserve

In the current financial framework, the budget lines for food safety have been under the same heading as the Common Agricultural Policy (CAP), but the new structure of the multiannual financial framework 2014-2020 provides for the food safety budget lines to be moved from heading two to heading three. This transfer of appropriations for the 2014 -2020 programming period involves a significant risk of a budget shortfall in the event of a very large-scale outbreak of an animal epidemic. If such an epidemic were to occur, the Union would have to be able to mobilise additional appropriations – and very quickly – to fund emergency veterinary or plant health measures in order to prevent further losses.

In this context, Article 5 of the Commission proposal provides for access to be granted to the agricultural crisis reserve in order to respond to emergency situations in the veterinary or plant health sector. Article 5 of the proposal was linked to the proposal for a horizontal CAP Regulation via an addendum to Article 4(2). The addendum was only received very late and therefore it was not possible to have a thorough debate on access to the crisis reserve and this possibility was rejected during the negotiations on the CAP.

However, a solution needs to be found to boost the budget for food safety in the event of large-scale agricultural crises occurring. Unfortunately, since the overall allocation for the EU budget for 2014-2020 is limited, it is not easy to identify a fund which could be used in such cases.

If the agricultural crisis reserve of EUR 2 800 million for the period 2014-2020 is used, the direct payments received by European farmers could be reduced after the financial discipline mechanism is applied. Yet a serious crisis in the veterinary or plant health areas would probably have a severe impact on the agri-food industry and it would therefore be appropriate to use the crisis reserve to help the affected sector.

Another approach would be to use the flexibility instrument with a maximum value of EUR 3 297 million for the period 2014-2020. This instrument authorises, for a given financial year, the funding of clearly identified expenditure which could not be funded within the ceilings available under one or more headings. The drawback is that this is an instrument which is available to all EU policies and could therefore prove insufficient during a serious health crisis.

Given the complexity of the situation, no amendment to Article 5 (or to Recital 7) has been proposed so as to allow a thorough debate on the matter and to build a consensus within the Committee on Agriculture and Rural Development with a view to identifying a solution to this difficult question.

Lists of animal diseases and zoonoses

The Commission proposes drawing up the list of animal diseases and zoonoses which qualify for a grant by means of an implementing act. However, the list of diseases is an essential element which should be incorporated into the basic act (in an annex). Furthermore, the possibility should be provided to supplement the list of diseases which qualify for a grant, without the procedure being as demanding as for a basic legal act, hence the use of delegated acts.

Criteria and objectives of actions

The Commission proposes that the objectives pursued and the criteria used to evaluate the national programmes should be set by means of their work programme. However, these objectives and criteria should be established in a more transparent way, using delegated acts.

Eligible costs

The Commission proposal for eligible costs corresponds largely to the current regulatory framework. However, some funding that was previously possible has been omitted, and the new expenditure linked to the new guidelines on food safety policy should also be covered. It would be desirable to include costs relating to, in particular, the slaughter of animals, losses resulting from emergency vaccination, the possible strengthening of existing measures, the processing and disposal of carcasses, economic losses suffered as a result of measures ordered in the context of plant protection and the lost value of destroyed plants.

SHORT JUSTIFICATION

The proposal by the Commission provides for the scope and objectives for food and feed expenditure up to a maximum ceiling of EUR 1 891,936 million in current prices. The objectives are a high level of safety of food and food production systems, a higher animal health status and animal welfare, the detection and eradication of pests, to ensure an effective implementation of official controls.

On 29 June 2011, the Commission presented its proposal for a multiannual financial framework for 2014-2020 which was amended on 6 July 2012. Taking into account the conclusions of the European Council of 7/8 February 2013, the Commission is proposing a maximum amount of EUR 1 891,936 million for expenditure in relation to food and feed during the whole period 2014-2020. In accordance with the Council Regulation (EC) No 58/2003 of 19 December 2002 laying down the statute for Executive Agencies to be entrusted with certain tasks in the management of Community programmes, the Commission has entrusted the Executive Agency for Health and Consumers with implementation tasks for the management of the Food and Feed Programme since 2008. The Commission may use, on the basis of a cost-benefit analysis, an existing executive agency for the implementation of this Programme.

In addition, it is proposed that funding rates for grants are rationalised and that the standard funding rate is set at 50% of the eligible costs. However, this rate can be raised under certain conditions up to 75% and 100%.

Regarding plant health, Union financial contribution will also cover survey programmes for the presence of pests and phytosanitary support measures for the outermost territories of Member States.

It is also foreseen for a possibility to support Union reference laboratories and projects aimed at improving the effectiveness and efficiency of official controls. Hence, procedures for submission and evaluation of annual and multiannual control programmes and the procedure for setting or updating the list of animal diseases or plant pests are eligible for co-funding. This will be done in a simplified manner, where the reimbursement decisions will not be taken by the Commission any more.

SHORT JUSTIFICATION

Under the 2014-2020 multiannual financial framework, a total of EUR 1 891.936 million have been earmarked for expenditure relating to the food chain, animal health and animal welfare, plant health and plant reproductive material.

At present, the main legal framework for such matters consists of Council Decision 2009/470/EC for veterinary eradication programmes and veterinary emergency measures, Council Directive 2000/29/EC for plant health measures and Regulation (EC) No 882/2004 concerning official controls. Additional specific financial provisions are set out in other regulations.

Against the background of a comprehensive revision of existing legislation on health and safety in the agricultural food chain, entitled ‘Healthier Animals and Plants for a Safer Food Chain’, the Commission is proposing to replace the existing fragmentary legal bases with new, standard financial provisions that are in keeping with the provisions of the new multiannual financial framework and with the Treaty of Lisbon. The regulation proposed by the Commission will cover all expenditure for controls and for the implementation of all legislation concerning eradication programmes and emergency measures, plant health measures, the financing of official controls, residue levels of pesticides in food and feed of plant and animal origin, the placing of plant protection products on the market and the sustainable use of pesticides.

Your rapporteur welcomes the new Commission proposal, and in particular the aim of streamlining a financial framework that was otherwise too complex and fragmented.

Common and simplified financial provisions will be to the advantage of the planning and financial management of programmes relating to the food chain, animal health and animal welfare, plant health and plant reproductive material; they will therefore certainly be able to contribute to the ultimate aim of achieving a safer food chain whilst respecting animal health and welfare.

The amendments proposed thus seek to supplement the Commission’s effort towards achieving a horizontal Financial Regulation that is clear, flexible and streamlined, whilst at the same time correcting a few problems detected.

More specifically, your rapporteur considers it important to extend the category of programmes that can potentially receive financial assistance from the EU, by deleting the provision regarding a minimum amount of grants, also in consideration of the multi-faceted nature and different sizes of the programmes that may be eligible for co-financing. At the same time, within the individual chapters of the Regulation, the list of the categories of costs that are potentially eligible for funding is extended to include, amongst others: compensation to operators for the value of their animals slaughtered or culled; compensation to operators for the value of any plants and plant products destroyed; compensation for the relevant transport and logistical costs and for other specific measures designed to prevent the further spread of diseases and/or pests.

It was also deemed necessary to clarify, with a view to the possible compensation of operators, the concept of the ‘market value’ of animals, animal products, plants, plant products and other objects that are destroyed or removed in implementing the measures provided for in this regulation.

In addition, it is important to correct some of the time frames regarding the administrative deadlines laid down in the Commission's proposal as regards the submission of national programmes, their approval by the Commission, the submission of intermediate and final reports and the submission of subsequent payment applications.

Lastly, as regards the provisions relating to funding for official controls, your rapporteur considers it important to extend the training programmes already provided for competent national authorities to accredited and representative private operators in the sector, too. This is because it is particularly important to disseminate information and promote uniform standards to ensure consumer protection and a high level of human, animal and plant health throughout the food chain.

Amendment

1. Where appropriate, beneficiaries and Member States concerned shall ensure that suitable publicity is given to financial contributions granted under this Regulation in order to inform the public of the role of the Union in the funding of the measures.
