on the proposal for a decision of the European Parliament and of the Council

establishing a space surveillance and tracking support programme

(COM(2013)0107 – C7‑0061/2013 – 2013/0064(COD))

The European Parliament,

–   having regard to the Commission proposal to Parliament and the Council (COM(2013)0107),

–   having regard to Article 294(2) and Article 189(2) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C7‑0061/2013),

–   having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

–   having regard to Rule 55 of its Rules of Procedure,

–   having regard to the report of the Committee on Industry, Research and Energy and the opinions of the Committee of Foreign Affairs and the Committee on Budgets (A7-0030/2014),

2.  Calls on the Commission to refer the matter to Parliament again if it intends to amend its proposal substantially or replace it with another text;

(5) Space debris has become the most serious threat to the sustainability of space activities. A space surveillance and tracking (hereinafter referred to as 'SST') support programme should therefore be established with the aim to support the setting up and operation of services consisting of monitoring and surveying space objects with a view to preventing damage to spacecraft resulting from collisions, as well as to prevent damage to ground infrastructure or human population as a result of uncontrolled re-entries of entire spacecraft or space debris thereof into the Earth's atmosphere.

(5) Space debris has become a serious threat to the sustainability of space activities, the availability of prime orbital slots and radiofrequency spectrum, and windows of opportunity for the launch of spacecraft. A space surveillance and tracking (hereinafter referred to as 'SST') support programme should therefore be established with the aim to support the setting up and operation of services consisting of monitoring and surveying space objects with a view to preventing damage to spacecraft resulting from collisions. The proliferation of space debris also has an impact on the incidence of hazardous uncontrolled re-entries of space objects. An SST service should therefore be set up so as to forecast trajectories and re-entry paths in order to provide governments and civil protection services with useful information.

(6) The provision of SST services will benefit all public and private operators of space-based infrastructures, including the Union in view of its responsibilities for its EU space programmes – European Geostationary Navigation Overlay Service (EGNOS) and Galileo being implemented by Regulation (EC) No 683/2008 of the European Parliament and of the Council of 9 July 2008 on the further implementation of the European satellite navigation programmes (EGNOS and Galileo)12 and Copernicus/GMES established by Regulation (EU) No 911/2010 Of the European Parliament and of the Council of 22 September 2010 on the European Earth monitoring programme (GMES) and its initial operations (2011 to 2013)13 . Re-entry warnings will also benefit national public authorities concerned with civil protection.

(6) The provision of SST services will benefit all public and private operators of space-based infrastructures, including the Union in view of its responsibilities for its EU space programmes – European Geostationary Navigation Overlay Service (EGNOS) and Galileo being implemented by Regulation (EC) No 683/2008 of the European Parliament and of the Council of 9 July 2008 on the further implementation of the European satellite navigation programmes (EGNOS and Galileo)12 and Copernicus/GMES established by Regulation (EU) No 911/2010 Of the European Parliament and of the Council of 22 September 2010 on the European Earth monitoring programme (GMES) and its initial operations (2011 to 2013)13. Warnings about uncontrolled re-entry and estimated earthfall zones and times will also benefit national public authorities concerned with civil protection. Moreover these services may aid private insurers to estimate potential liabilities resulting from collision during the lifetime of a satellite.

(7) The SST services should be complementary to research activities related to the protection of space-based infrastructure carried out under the Horizon 2020 programme established by [reference to Horizon 2020 Regulation to be added once adopted], as well as to the European Space Agency's activities in this domain.

(7) The SST services should be complementary to research activities related to the protection of space-based infrastructure carried out under the Horizon 2020 programme established by [reference to Horizon 2020 Regulation to be added once adopted] such as the development of optic laser technologies for tracking, as well as the European Space Agency's or other international, existing and future research activities in this domain. Moreover it should also be complementary to the Union's flagship space programmes, i.e. Copernicus and Galileo, its Digital Agenda initiative, and other telecommunication infrastructures which aid the achievement of the information society.

(8) The SST support programme should also be complementary to existing mitigation measures such as the United Nations (UN) guidelines for space debris mitigation or other initiatives, such as the Union proposal for an international Code of Conduct on outer space activities.

(9) Civil-military SSA user requirements were defined in the Commission staff working paper ‘European space situational awareness high-level civil-military user requirements’14 endorsed by the Member States in the Political and Security Committee of the Council on 18 November 201115 . The provision of SST services should serve only civilian purposes. Purely military requirements should not be addressed by this Decision.

(9) Civil-military SSA user requirements were defined in the Commission staff working paper ‘European space situational awareness high-level civil-military user requirements’14 endorsed by the Member States in the Political and Security Committee of the Council on 18 November 201115 . The provision of SST services should serve both civilian and military purposes and this should not restrict the European Defence Agency (EDA) from contributing to the programme. A thorough analysis should be conducted on how Member States' military capabilities will benefit from SST services as well as on SST services' contribution to safeguard the implementation of the Outer Space Treaty.

(10) The operation of SST services should be based on a partnership between the Union and the Member States and use existing as well as future national expertise and assets, such as mathematical analysis and modelling know-how, ground-based radars or telescopes made available by participating Member States. The Member States retain ownership and control over their assets and remain responsible for their operations, maintenance and renewal.

(10) The operation of SST services should be based on a partnership between the Union and the Member States, with the relevant contribution of ESA, Union and national agencies, and use existing as well as future national and European expertise and assets, such as mathematical analysis and modelling know-how, ground-based radars or telescopes made available by participating Member States and ESA. (11) The European Union Satellite Centre (EUSC), an agency of the Union established by Council Joint Action of 20 July 2001 on the establishment of a European Union Satellite Centre (2001/555/CFSP)16 which provides geospatial imagery information services and products with various levels of classification to civil and military users, could be responsible for the operation and provision of SST services. Its expertise in handling confidential information in a secure environment and its tight institutional links with the Member States is an asset facilitating the provision of SST services. A pre-condition for the EUSC participation in the SST support programme is the amendment of the Council Joint Action which does currently not provide for EUSC action in the field of SST.

(12) Precise information on the nature, specifications and location of certain space objects may affect the security of the European Union or its Member States. Adequate security considerations should therefore be taken into account in the establishment and operation of the network of SST sensors, the capacity to process and analyse SST data and the provision of SST services. It is therefore necessary to lay down general provisions on the use and secure exchange of SST data and information between the Member States, the EUSC and the recipients of SST services in this Decision. Furthermore, the European Commission and the European External Action Service should define the coordination mechanisms needed to address matters related to the security of the SST support programme.

(12) Precise information on the nature, specifications and location of certain space objects may affect the security of the European Union or its Member States or third countries. Adequate security considerations should therefore be taken into account in the establishment and operation of the network of SST sensors, the capacity to process and analyse SST data and the provision of SST services. It is therefore necessary to lay down general provisions on the use and secure exchange of SST data and information between the Member States, the EUSC and the recipients of SST services in this Decision. In this respect, existing infrastructure and expertise should be employed to avoid duplication, and create savings and synergies. Furthermore, the European Commission and the European External Action Service should define the coordination mechanisms needed to address matters related to the security of the SST support programme.

(13a) The potential sensitivity of SST data makes it necessary for the SST support programme to foster cooperation based on efficiency and mutual trust, including in the way in which SST data are processed and analysed. The use of open source software allowing the secure access of authorised SST data contributors to the source code for operational modifications and improvements should contribute to that objective.

(15) The SST support programme should be financed by the Union in accordance with Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union18. Union funding for the SST support programme should be drawn from relevant programmes provided for in the multiannual financial framework for 2014-2020.

(15) The SST support programme should be financed by the Union in accordance with Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union 18. The amount of Union funding for the SST support programme should be set at EUR 70 million in current prices and should be drawn from the Copernicus programme established by Regulation (EU) No .../2014 of the European Parliament and the Council18a, the Galileo and EGNOS programmes established by Regulation (EU) No .../2013 of the European Parliament and the Council18b, the Horizon 2020 programme, implemented by Council Decision No […]18c and the Instrument for financial support for police cooperation, preventing and combating crime, and crisis management, established as part of the Internal Security Fund by Regulation (EU) No .../2014 of the European Parliament and the Council18d, whilst ensuring that the objectives of those programmes are not jeopardised.

(15a) For the sake of clarity and accountability, that maximum amount should be broken down into various categories according to the objectives set out in this Regulation. The Commission should be able to reallocate funds from one objective to another and should do so through a delegated act when the deviation exceeds five percentage points. The Commission should also adopt delegated acts detailing the funding arrangements and priorities to be reflected in the work programme.

(17) In order to ensure uniform conditions for the implementation of this Decision as regards the adoption of a multiannual work programme and the compliance by Member States with the criteria for their participation in the SST support programme, implementing powers should be conferred on the Commission. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by the Member States of the Commission's exercise of implementing powers19 .

(17) In order to ensure uniform conditions for the implementation of this Decision as regards the compliance by Member States with the criteria for their participation in the SST support programme, implementing powers should be conferred on the Commission. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by the Member States of the Commission's exercise of implementing powers19 .

(17a) In order to ensure proper planning of the programme, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of the adoption of a multiannual work programme. It is of particular importance that the Commission carry out appropriate consultations during its preparatory work, including at expert level. The Commission, when preparing and drawing up delegated acts, should ensure a simultaneous, timely and appropriate transmission of relevant documents to the European Parliament and to the Council.

Justification

Along the lines of the Galileo and Copernicus programmes, a name should be used instead of an obscure abbreviation. The name is that of the Italian-French Cassini family of astronomers. The change applies wherever reference is made in the proposal for a decision to the 'SST programme'.

Specific objectives

(a) assessing and reducing the risks to in-orbit operations of European spacecraft in terms of collisions, enabling spacecraft operators to more efficiently plan and carry out mitigation measures;

 

(b) reducing the risks relating to the launch of European spacecraft;

 

(c) surveying uncontrolled re-entries of spacecraft or space debris into the Earth's atmosphere and providing more accurate and efficient early warnings with the aim of reducing the potential risks to the safety of Union citizens and mitigating potential damage to critical terrestrial infrastructure.

Objectives of the SST support programme

Main actions of the SST support programme

The objectives of the SST Support Programme shall be to support actions aimed at establishing a SST capability and, in particular:

In order to attain the general and specific objectives laid down in Articles 1a and 2a respectively, the main actions of the SST Support Programme shall consist in:

(a) the establishment and operation of a sensor function consisting of a network of ground-based or space-based existing national sensors to survey and track space objects;

(a) the establishment and operation of a sensor function consisting of a secure network of ground-based or space-based national SST sensors developed at European level, including through the ESA, to survey and track space objects;

(b) the establishment and operation of a processing function to process and analyse the SST data captured by the sensors, including the capacity to detect and identify space objects and to build and maintain a catalogue thereof;

(b) the establishment and operation of a processing function to process and analyse the SST data captured by the sensors in order to produce SST information, including the capacity to detect and identify space objects and to build and maintain a catalogue thereof;

(c) the setting up and operation of a service function to provide SST services to spacecraft operators and public authorities.

(c) the setting up and operation of a service function to provide the SST services defined in Article 4 (1) to the entities referred to in Article 4(2).

2. The Commission shall adopt implementing acts establishing a multiannual work programme for the SST support programme complementing, as appropriate, the work programmes foreseen under the programmes referred to article 11(1). The work programme shall specify the objectives pursued, the expected results, the actions to be financed, the timetable for the implementation of these actions, the method of implementation, the maximum rate of Union co-financing, and the specific conditions applicable to Union grants under the SST support programme. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 14(2).

2. The Commission shall adopt delegated acts in accordance with Article 14a establishing a multiannual work programme for the SST support programme taking account of, as appropriate, the work programmes provided for under the programmes referred to article 11(1). The work programme shall specify the objectives pursued, the expected results, the actions to be financed, the timetable for the implementation of these actions, the method of implementation, the maximum rate of Union co-financing, and the specific conditions applicable to Union grants under the SST support programme.

It states the principles to use outer space for peaceful purposes, the responsibility of subscribing States to take all appropriate measures and cooperate in good faith to prevent harmful interference in outer space activities, as well as their responsability to conduct scientific, civil, commercial and military activities to promote the peaceful exploration and use of outer space and to take all appropriate measures to prevent outer space from becoming an arena of conflict.

Exercise of the delegation

 

1. The power to adopt delegated acts is conferred on the Commission subject to the conditions laid down in this Article.

 

2. The power to adopt delegated acts referred to in Articles 6(2) and 11 shall be conferred on the Commission for an indeterminate period of time from 1 January 2014.

 

3. The delegation of power referred to in Articles 6(2) and 11 may be revoked at any time by the European Parliament or by the Council. A decision to revoke shall put an end to the delegation of the power specified in that decision. It shall take effect the day following the publication of the decision in the Official Journal of the European Union or at a later date specified therein. It shall not affect the validity of any delegated acts already in force.

 

4. As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.

EXPLANATORY STATEMENT

The proposed programme seeks to contribute to building up an independent European capability of space surveillance and tracking (SST) aimed at preventing and monitoring the growing risk of collision between space infrastructures and other spacecraft or space debris. The need for SST is shared at International and national levels, both from public authorities and the industry as a whole depending on space infrastructures. This is also of particular relevance for ensuring the long-term availability of European space assets, like the satellites from Galileo and Copernicus. It is the first attempt at EU level of that kind and the Commission proposes to start by bringing together available assets and skills among the Member States and provide services to users.

The Rapporteur proposes the possibility for ESA know-how to be taken on board via an agreement between ESA and the contributing Member States. ESA is the only skilled body at European level on SST and more globally SSA. Whereas ESA cannot manage or control the programme, it should be able to contribute to it.

The scope of services should include the setting up of a publically available catalogue of orbital elements of space objects to increase general awareness and enable any possible business application from it, as well as be open to any relevant additional services that the EC would propose on a later stage, in order to leave the door open for any future improvement.

The Rapporteur proposes to define a step further the legislative frame of the programme by reminding the general scope and specific objectives at the beginning of the core text (new Articles 1a and 2a). She also proposes to define the establishment of the networking of sensors, of the processing of data and of the SST services in Article 3 as main actions rather than objectives, from which specific actions will be developed by the Commission in its multiannual work programme (Article 5).

The Rapporteur wishes the European Parliament to consider the multiannual work programme prior it comes into effect via a Delegated Act procedure in article 6.

The budget of EUR 70 million is included in the core text (article 11) and would be drawn from the Internal Security Fund, Galileo, Copernicus and H2020.

SHORT JUSTIFICATION

The proposed programme seeks to contribute to building up an independent European capability of space surveillance and tracking ('SST') aimed at preventing and monitoring the growing risk of collision between space infrastructures and other spacecraft or space debris. Member States would contribute with their own sensor assets while the Union would provide a framework and a financial contribution, thereby ensuring three main functions: networking of sensors; data processing; service to the users. Mostly due to the security dimension of the SST system, the programme would be led by the EU rather than by the European Space Agency.

The Rapporteur proposes to support this strategic project which is instrumental in the independence and security of major European assets, not least under the two large scale EU projects EGNOS/Galileo and Copernicus.

However, the main issue identified by the Rapporteur is the financing of the SST support programme. Indeed, the draft Regulation sets out that its funding shall be drawn from other relevant programmes in full compatibility with their legal base. But although Galileo, Horizon 2020, the Internal Security Fund and Copernicus have been flagged for contribution, the draft legal act itself does not yet include Copernicus and does not clarify the extent of these respective contributions. The draft legal act does not even contain the amount mentioned in the Commission's explanatory memorandum, i.e. EUR 70 million over seven years. Finally, it does not lay down precisely the breakdown of the EU funding across the main expected tasks.

The Rapporteur attempts to remedy these shortcomings by inserting a maximum amount and by making sure that both EGNOS/Galileo and Copernicus, who will be among the main beneficiaries of the SST capability, are also its primary contributors - while other programmes should only be subsidiary. The use of the Horizon 2020 envelope, in particular, should be strictly limited to its own remit - space and security research. The Rapporteur also proposes to insert a breakdown of the envelope into the three main functions to be assured by the SST programme. Finally, the Commission should be empowered to adopt delegated acts in order to clarify the funding arrangements and priorities, as well as to deviate significantly from the set breakdown if necessary.

Adequate security considerations should therefore be taken into account in the establishment and operation of the network of SST sensors, the capacity to process and analyse SST data and the provision of SST services. It is therefore necessary to lay down general provisions on the use and secure exchange of SST data and information between the Member States, the EUSC and the recipients of SST services in this Decision. Furthermore, the European Commission and the European External Action Service should define the coordination mechanisms needed to address matters related to the security of the SST support programme.

Any increase in the Union contribution should be sought for among Galileo and Copernicus programmes.

Exercise of the delegation

 

1. The power to adopt delegated acts is conferred on the Commission subject to the conditions laid down in this Article.

 

2. The power to adopt delegated acts referred to in Article 11 shall be conferred on the Commission from the date of entry into force of this Regulation.

 

3. The delegation of power referred to in Article 11 may be revoked at any time by the European Parliament or by the Council. A decision to revoke shall put an end to the delegation of the power specified in that decision. It shall take effect the day following the publication of the decision in the Official Journal of the European Union or at a later date specified therein. It shall not affect the validity of any delegated acts already in force.

 

4. As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.

 

5. A delegated act adopted pursuant to Article 11 shall enter into force only if no objection has been expressed either by the European Parliament or by the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object. That period shall be extended by two months at the initiative of the European Parliament or of the Council.
