NACRT ZAKONODAVNE REZOLUCIJE EUROPSKOG PARLAMENTA

o prijedlogu uredbe Europskog parlamenta i Vijeća o izmjeni Uredbe (EZ) br. 1683/1995 od 29. svibnja 1995. o utvrđivanju jedinstvenog obrasca za vize

Europski parlament,

–  uzimajući u obzir prijedlog Komisije upućen Europskom parlamentu i Vijeću (COM(2015)0303),

–  uzimajući u obzir članak 294. stavak 2. i članak 77 stavak 2.a Ugovora o funkcioniranju Europske unije, u skladu s kojima je Komisija podnijela prijedlog Parlamentu (C8-0164/2015),

–  uzimajući u obzir članak 294. stavak 3. Ugovora o funkcioniranju Europske unije,

–  uzimajući u obzir članak 59. Poslovnika,

–  uzimajući u obzir izvješće Odbora za građanske slobode, pravosuđe i unutarnje poslove i mišljenje Odbora za pravna pitanja (A8-0028/2016),

1.  usvaja stajalište u prvom čitanju preuzimajući prijedlog Komisije;

2.  traži od Komisije da predmet ponovno uputi Parlamentu ako namjerava bitno izmijeniti svoj prijedlog ili ga zamijeniti drugim tekstom;

3.  nalaže svojem predsjedniku da stajalište Parlamenta proslijedi Vijeću, Komisiji i nacionalnim parlamentima.

EXPLANATORY STATEMENT

The introduction of a uniform format for visas is an important element of the EU visa policy.

A uniform format for visas should contain all the necessary information and meet very high technical standards, notably as regards safeguards against counterfeiting and falsification. Furthermore it must also be suited to use by all the Member States and bear universally recognizable security features which are clearly visible to the naked eye.

The current security concept for a uniform format for visas dates back to 1995, when it was initially developed under the intergovernmental Schengen cooperation. Regulation (EC) No 1683/1995 on a uniform format for visas took it over into EU law. Since then, it has been modified substantially twice[1].

Over the past few years forged visa stickers have arisen in several Member States. The present sticker is, as far as specialists are concerned, not secure any longer.

The committee established by Article 6 of Regulation (EC) No 1683/1995 has held several meetings over the past years to elaborate a new security concept and design to increase the protection against forgery. Based on the results of this committee, the Commission has presented a Proposal for a Regulation of the European Parliament and of the Council amending Regulation (EC) No 1683/1995 laying down a uniform format for visas in June this year. The amending Regulation is based on Article 77(2)(a) of the TFEU.

Generally, the Commission should propose a recasting of a Regulation after the third substantial amendment. The rapporteur believes that the arguments provided by the Commission for not doing so in this case, are conclusive and comprehensible: The enacting term of the Regulation did not face substantial amendments by the Commission proposal and amendments are only made within the Annex of the Regulation that contains the secret technical specifications to the production of visa stickers. Since forged stickers are circulating, there is urgent need for action to produce new, unforgeable visa stickers. The Commission has furthermore held out the prospect that the Regulation could face a codification after it has been adopted.

According to the Commission, the expense of the introduction of the new visa sticker does not rise above the old ones.

Finally, the rapporteur is therefore persuaded that the Commission proposal should be adopted without any amendments in order to complete swift legislation for unforgeable visa stickers.

SHORT JUSTIFICATION

Council Regulation (EC) No 1683/95 laying down a uniform format for visas took over the design adopted by the Schengen states and sets out in its recitals that these documents have to contain all the necessary information and meet very high technical standards, notably as regards safeguards against counterfeiting and falsification. Since the introductions of the uniform format for visas, two substantial modifications to the initial regulation have been adopted, which have contributed to the issuance of secure documents with very high technical standards. However, serious incidents of counterfeiting and fraud regarding the visa stickers have been detected in several Member States. The Commission considers that the current visa sticker, which has been in circulation for 20 years, has to be considered compromised. Against this background, it has proposed a new model with more security features in order to make the visa sticker more secure and prevent forgery. There are no substantive changes to the enacting terms of this Regulation; the annex is merely replaced to show the image and the general description of the new visa sticker.

In the light of the above, your rapporteur considers that the proposal should be approved without changes.
