DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council position at first reading with a view to the adoption of a regulation of the European Parliament and of the Council amending Regulation (EC) No 471/2009 on Community statistics relating to external trade with non-member countries as regards the conferral of delegated and implementing powers on the Commission for the adoption of certain measures

The European Parliament,

–  having regard to the Council position at first reading (08536/1/2016 – C8‑0226/2016),

–  having regard to its position at first reading(1)on the Commission proposal to Parliament and the Council (COM(2013)0579),

–  having regard to Article 294(7) of the Treaty on the Functioning of the European Union,

–  having regard to Rule 76 of its Rules of Procedure,

–  having regard to the recommendation for second reading of the Committee on International Trade (A8-0240/2016),

1.  Approves the Council position at first reading;

2.  Notes that the act is adopted in accordance with the Council position;

3.  Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;

4.  Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;

5.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

EXPLANATORY STATEMENT

In the light of the changes brought about by the Lisbon Treaty and by the subsequent adoption of Regulation (EU) No 182/2011 (on implementing acts), the Commission was required to adapt the decision making rules in trade policy to the new regime of delegated and implementing acts. Most of the legislation in the field of the Common Commercial Policy has been aligned to the new constitutional regime by means of the Trade Omnibus I and II and several subsequent individual alignments. The Commission committed itself to come up with the second wave of comitology alignments - concerning legislative acts containing the regulatory procedure with scrutiny - by the end of the 7th legislature. In this context, the Commission proposed the amendment to Regulation (EC) No 471/2009 on Community statistics which is the only legislative act in the field of the Common Commercial Policy referring to the regulatory procedure with scrutiny.

Following the adoption of Parliament's first reading position by the plenary on 12 March 2014, informal negotiations started under the Italian Presidency with a view to reaching an early second reading agreement. After several rounds of trilogues the negotiations were suspended while awaiting the adoption of the new Inter-institutional Agreement on Better Law-making which provides, inter alia, for a horizontal solution regarding the consultation of Member States’ experts in preparation of delegated acts.

The adoption of the new Inter-institutional agreement on Better law-making in December 2015 thus enabled the Parliament's and Council's negotiating teams to reach an agreement on the Regulation in question.

The agreed text was presented to the INTA Committee for a vote of approval on 21 April 2016, and was approved by an overwhelming majority. On the basis of the committee's approval, the Chairman of the Committee undertook in his letter of the same day to the chair of COREPER to recommend to the plenary to approve Council's position at first reading without amendment. Following legal-linguistic verification, Council adopted its first reading position confirming the agreement on 16 June 2016.

In the light of the above the Rapporteur proposes to approve without amendment the Council’s first reading position.
