FORSLAG TIL EUROPA-PARLAMENTETS LOVGIVNINGSMÆSSIGE BESLUTNING

om Rådets holdning ved førstebehandling med henblik på vedtagelse af Europa-Parlamentets og Rådets direktiv om fastsættelse af tekniske forskrifter for fartøjer til sejlads på indre vandveje, om ændring af direktiv 2009/100/EF og om ophævelse af direktiv 2006/87/EF

–  der henviser til Rådets holdning ved førstebehandling (07532/2/2016 – C8-0227/2016),

–  der henviser til udtalelse af 21. januar 2014 fra Det Europæiske Økonomiske og Sociale Udvalg[1],

–  der henviser til udtalelse af 31. januar 2014 fra Regionsudvalget[2],

–  der henviser til sin holdning ved førstebehandling[3] til Kommissionens forslag til Europa-Parlamentet og Rådet (COM(2013)0622),

–  der henviser til artikel 294, stk. 7, i traktaten om Den Europæiske Unions funktionsmåde,

–  der henviser til forretningsordenens artikel 76,

–  der henviser til indstilling ved andenbehandling fra Transport- og Turismeudvalget (A8-0256/2016),

1.  godkender Rådets holdning;

2.  konstaterer, at retsakten er vedtaget i overensstemmelse med Rådets holdning;

3.  pålægger sin formand sammen med Rådets formand at undertegne retsakten, jf. artikel 297, stk. 1, i traktaten om Den Europæiske Unions funktionsmåde;

4.  pålægger sin generalsekretær at undertegne retsakten, efter at det er kontrolleret, at alle procedurer er behørigt overholdt, og efter aftale med Rådets generalsekretær at foranledige, at den offentliggøres i Den Europæiske Unions Tidende;

5.  pålægger sin formand at sende Parlamentets holdning til Rådet, Kommissionen og de nationale parlamenter.

BETÆNKNING

Parlamentets prioriteter

At first reading Parliament supported a uniform application of common technical requirements for inland waterway vessels in the European Union in view of ensuring a high level of safety and efficiency in inland navigation. It was also in favour of a swift adaptation of standards to scientific and technical progress taking into account standards developed by international organisations, in particular by CESNI (European Committee for drawing up standards in inland navigation) to be established within the auspices of the Central Commission for the navigation on the Rhine. Parliament also requested a periodic three-year review of the Directive to assess the mechanisms of cooperation with the international organisations concerned.

In order to ensure coherence with other pieces of EU legislation, in particular with Directive 2014/94/EU on the deployment of alternative fuels, Parliament called for the adoption of delegated acts to introduce technical requirements for vessels powered by liquefied natural gas (LNG).

Main achievements:

Parliament and Council agreed on the overall aim of the Directive, which is to provide a harmonised and coherent framework to ensure the same level of safety for inland waterway vessels. The two institutions both supported a rationalisation of the use of resources to develop technical standards and adapt them to scientific and technical progress making use of standards developed by international organisations in particular CESNI.

Council and Parliament had, however, diverging views on how to adapt the annexes with the technical standards. Parliament could not support the use of a dynamic reference to automatically adapt the annex to the Directive to a European standard developed within CESNI. Such dynamic reference would have given an exclusive decision power to the Council, by-passing the prerogatives of the Parliament as co-legislator. It should be underlined that the international body CESNI is composed only of the EU Member States and Switzerland. It is therefore important that the adaptation of the technical standards through the adoption of delegated acts is maintained. It should also be underlined that the cooperation mechanism with CESNI will have to be reviewed within five years.

Negotiations:

Following the adoption of Parliament’s first reading position on 15 April 2014 and the decision of the Committee on Transport and Tourism (TRAN) to open negotiations on 26 March 2015, informal negotiations with the view to reach an early second reading agreement took place under the Luxembourg and Dutch Presidencies of the Council. Parliament’s and Council’s negotiating teams reached an agreement on the file on 17 March 2016. The outcome text of negotiations was approved by the TRAN Committee on 7 April 2016. On the basis of the Committee’s approval, the Chair of the TRAN Committee, in his letter to the Committee of Permanent Representatives, indicated that he will recommend to the Plenary to approve the Council’s position at first reading without amendments. Following a legal-linguistic verification, Council adopted its first reading position confirming the agreement of 17 March 2016.
