on the proposal for a regulation of the European Parliament and of the Council on certain procedures for applying the Stabilisation and Association Agreement between the European Union and the European Atomic Energy Community, of the one part, and Kosovo(1)* of the other part

The European Parliament,

–  having regard to the Commission proposal to Parliament and the Council (COM(2016)0460),

–  having regard to Article 294(2) and Article 207 of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C8‑0327/2016),

–  having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

–  having regard to the letter from the Committee on Foreign Affairs,

–  having regard to Rule 59 of its Rules of Procedure,

–  having regard to the report of the Committee on International Trade (A8-0361/2016),

1.  Adopts its position at first reading hereinafter set out;

2.  Calls on the Commission to refer the matter to Parliament again if it intends to amend its proposal substantially or replace it with another text;

3.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

(3)  In order to ensure uniform conditions for the implementation of the Agreement, implementing powers should be conferred on the Commission. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council5. Given that the implementing acts form part of the common commercial policy, the examination procedure should be used for their adoption. Where the Agreement provides for the possibility, in exceptional and critical circumstances, to apply urgent measures necessary to deal with the situation, the Commission should adopt such implementing acts immediately. For measures concerning agricultural and fishery products, the Commission, in cases of duly justified imperative grounds of urgency, should adopt such implementing acts immediately.

In accordance with that Regulation, the examination procedure applies, in particular, for the adoption of implementing acts relating to the common commercial policy. However, the advisory procedure may apply in duly justified cases. Where the Agreement provides for the possibility, in exceptional and critical circumstances, to apply forthwith measures necessary to deal with the situation, the Commission should adopt such implementing acts immediately. For measures concerning agricultural and fishery products, the Commission, in cases of duly justified imperative grounds of urgency, should adopt such implementing acts immediately.

Surveillance

 

For the purposes of implementing Article 34 of the Agreement, a Union surveillance of imports of goods listed in Annex V of Protocol 3 to the Agreement shall be established. The procedure laid down in Article 308(d) of Commission Regulation (EEC) No 2454/93 7 shall apply.

ANNEX: LETTER FROM THE COMMITTEE ON FOREIGN AFFAIRS

Dear Chair,

I am writing to you regarding the Proposal for a Regulation of the European Parliament and of the Council on certain procedures for applying the Stabilisation and Association Agreement (SAA) between the European Union and the European Atomic Energy Community, of the one part, and Kosovo of the other (COM(2016)0460 – C8-0327/2016 – 2016/0218(COD)). Considering the specificity of the file, and that it is an ordinary legislative procedure, I would like to express the political support of the Committee on Foreign Affairs (AFET) for the swift conclusion of the abovementioned regulation.

The EU-Kosovo Stabilisation and Association Agreement entered into force on 1 April 2016, following the ratification by the European Parliament and the Kosovo National Assembly. During the consent procedure, we had highlighted our support to the conclusion of this Agreement, and welcomed that Kosovo would finally have, like the other countries of the Western Balkans, contractual relations with the EU. The entry into force of the SAA also prompted the establishment of the Stabilisation and Association Parliamentary Committee, which promptly adopted its rules of procedure and has held two meetings.

The Proposal for a Regulation that your Committee will be voting on contains important rules for the implementation of certain provisions of the Agreement, as well as the procedures for the adoption of detailed rules of implementation. We encourage you to proceed in a swift manner to ensure that Kosovo can fully benefit from the SAA, while at time keeping in mind that the prerogatives of the Parliament should be upheld.
