on the draft Council decision on the conclusion, on behalf of the Union, of the Multilateral Agreement between the European Community and its Member States, the Republic of Albania, Bosnia and Herzegovina, the Republic of Bulgaria, the Republic of Croatia, the former Yugoslav Republic of Macedonia, the Republic of Iceland, the Republic of Montenegro, the Kingdom of Norway, Romania, the Republic of Serbia and the United Nations Interim Administration Mission in Kosovo(1)* on the establishment of a European Common Aviation Area (ECAA)

The European Parliament,

–  having regard to the draft Council decision (15654/2016),

–  having regard to draft Council Decision on the signature and provisional application of the Multilateral Agreement between the European Community and its Member States, the Republic of Albania, Bosnia and Herzegovina, the Republic of Bulgaria, the Republic of Croatia, the former Yugoslav Republic of Macedonia, the Republic of Iceland, the Republic of Montenegro, the Kingdom of Norway, Romania, the Republic of Serbia and the United Nations Interim Administration Mission in Kosovo* on the establishment of a European Common Aviation Area (08823/2/2006),

–  having regard to the request for consent submitted by the Council in accordance with Article 100(2) and Article 218(6), second subparagraph, point (a) of the Treaty on the Functioning of the European Union (C8-0098/2017),

–  having regard to Rule 99(1) and (4) and Rule 108(7) of its Rules of Procedure,

–  having regard to the recommendation of the Committee on Transport and Tourism (A8-0260/2017),

1.  Gives its consent to conclusion of the agreement;

2.  Instructs its President to forward its position to the Council, to the Commission and to the governments and parliaments of the Member States and of the Republic of Albania, Bosnia and Herzegovina, the Republic of Bulgaria, the Republic of Croatia, the former Yugoslav Republic of Macedonia, the Republic of Iceland, the Republic of Montenegro, the Kingdom of Norway, Romania and the Republic of Serbia, and to the United Nations Interim Administration Mission in Kosovo.

EXPLANATORY STATEMENT

Background on the Multi-lateral Agreement

The aim of this Agreement is the creation of a European Common Aviation Area (ECAA), integrating the EU’s neighbours in South-East Europe in the EU's internal aviation market which consists of EU Member States as well as Norway and Iceland. The ECAA agreement, by creating a single aviation market, should deliver substantial economic benefits for air travellers and the aviation industry, covering 36 countries and more than 500 million people. At the same time, the agreement offers the same high standards in term of safety and security across Europe, through the uniform application of rules.

The agreement creates an open framework accessible for European neighbour countries which wish to fully integrate into the European aviation community. This means that the Western Balkan States individually and step by step integrate into the European aviation market on the basis of the transitional arrangements which are part of the Agreement. The ECAA is based on the principles of free market access, freedom of establishment, equal conditions of competition, and common rules including in the areas of safety, security, air traffic management (by extending Single European Sky and including the operation of SESAR), social and environment. The ECAA partner countries commit to align their aviation legislation with the Union acquis.

A common, multilateral main text forms the basis of the ECAA, which is applicable to all signatories. This common text is complemented by a series of Protocols accommodating for specific needs of each country joining the ECAA, including the particular transitional arrangements (setting out, inter alia, conditions on traffic rights and participation in the EASA). Finally, the Annex to the agreement lists the Union aviation acts that are to become applicable within the ECAA.

Proposal for conclusion of the Agreement

The Agreement has been preliminarily applied since its signature on 9 June 2006, under the transitional arrangements for each ECAA partner country. Since then the EU has supported partner countries to fulfil their international obligations in the area of air safety, inter alia, by pre-accession measures carried out by the EASA in the IPA 3 programme on aviation safety in the Western Balkans partner countries. It should be added that since this agreement has been negotiated, passenger numbers between the EU and the Western Balkans, direct city connections, and the number of operation carriers have seen a significant increase,(1) which demonstrates the Agreement’s practical relevance.

Once the Agreement is concluded, assessments of its implementation progress under the first phase of the transition arrangements can be formalized for each partner country. This should open up the way for the ECAA partner countries to further advance on their path towards full application of the Agreement.

Procedure

The ECAA Agreement was signed on 9 June 2006, subject to its conclusion at a later date, in accordance with Decision 2006/682/EC of the Council and of the Representatives of the Member States of the European Union meeting within the Council, which authorized its signature and provisional application.(2)

The European Parliament at the time had approved the conclusion of the agreement.(3)

The ratification process has been completed by all Member States on 23 January 2014.

Subsequently, the Commission on 23 November 2015 presented an amended proposal for a Council decision to conclude the Agreement,(4) in order to take into account the entry into force of the Treaty of Lisbon and the fact that Bulgaria, Croatia and Romania had become EU Member States in the meantime.

In order to conclude the ECAA Agreement,(5) Council needs the consent of the European Parliament as required by Article 218 TFEU. In accordance with Rules 99 and 108(7) of Parliament’s rules of procedure, the committee responsible shall submit to a recommendation to approve or reject the proposed act. Parliament shall take a decision by means of a single vote, and no amendments to the agreement itself may be tabled. Amendments in committee shall be admissible only if they aim to reverse the recommendation proposed by the rapporteur.

Conclusion

In the light of the abovementioned state-of-play, your Rapporteur suggests that the TRAN Committee should give a favourable recommendation on the conclusion of this Agreement.
