DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council position at first reading with a view to the adoption of a directive of the European Parliament and of the Council amending Council Framework Decision 2004/757/JHA in order to include new psychoactive substances in the definition of 'drug' and repealing Council Decision 2005/387/JHA

The European Parliament,

–  having regard to the Council position at first reading (10537/1/2017 – C8‑0325/2017),

–  having regard to the reasoned opinions submitted, within the framework of Protocol No 2 on the application of the principles of subsidiarity and proportionality, by the United Kingdom House of Commons and the United Kingdom House of Lords, asserting that the draft legislative act does not comply with the principle of subsidiarity,

–  having regard to the opinion of the European Economic and Social Committee of 21 January 2014[1],

–  having regard to its position at first reading[2] on the Commission proposal to Parliament and the Council (COM(2013)0618),

–  having regard to Article 294(7) of the Treaty on the Functioning of the European Union,

–  having regard to the provisional agreement approved by the committee responsible under Rule 69f(4) of its Rules of Procedure,

–  having regard to Rule 67a of its Rules of Procedure,

–  having regard to the recommendation for second reading of the Committee on Civil Liberties, Justice and Home Affairs (A8-0317/2017),

1.  Approves the Council position at first reading;

2.  Notes that the act is adopted in accordance with the Council position;

3.  Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;

4.  Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;

5.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

SHORT JUSTIFICATION

The proposal for a directive amending Framework Decision 2004/757/JHA dates back to 2013 and it forms part of a package of two draft legislative acts whose aim is to improve the currently applicable system for addressing at EU level the threat posed by new psychoactive substances (NPS).

The European Parliament adopted its first reading position during the previous term (17 April 2014).

Work on the NPS package was especially lengthy and arduous, and gained new impetus when the Commission replaced its proposal for a regulation with a new text.

Four years later, and after intensive inter-institutional negotiations, last May the two co-legislators finally reached an overall political agreement on the NPS package that incorporated the main points in Parliament’s negotiating mandate. The agreement was endorsed by COREPER on 31 May 2017 and by the LIBE Committee on 8 June 2017.

Since the Council’s position adopted on 25 September fully reflects the agreement reached in interinstitutional negotiations, your rapporteur recommends that it be endorsed by the European Parliament without amendments, so that this directive (together with the draft regulation on NPS) can be adopted swiftly and enter into force as soon as possible.
