EXPLANATORY STATEMENT

This proposal, adopted by the Commission on 6 December 2017, seeks to amend the Common Provisions Regulation (CPR) in order to allow the performance reserve (6% of the resources allocated to the ERDF, ESF and CF Investment for Jobs and Growth Goal, to the EAFRD and to the EMFF) to be used for structural reforms instead of for the ‘specific priorities’ set out in Partnership Agreements. In particular, the proposal seeks to insert Articles 22(1a), 22(8) and 23a into the CPR, setting out the principles and procedures for using cohesion policy monies for structural reforms. In addition, consequential amendments affect the CPR’s provisions on its objective, definitions and reporting obligations accordingly.

The co-rapporteurs have given the proposal their fullest consideration, and have come to the conclusion that the proposal should be rejected.

Whilst the European Parliament did not originally support the concept of a performance reserve when the current cohesion package was adopted, the co-rapporteurs consider that it is important that the funds in the performance reserve are spent as originally intended, on cohesion projects, and are not diverted to structural reforms. This does not mean that structural reforms are not important: in other contexts, the Committee on Regional Development has supported an increase to the budget for structural reforms. However, local authorities and stakeholders are in most cases relying on the 6% set aside in the performance reserve in order to fund projects which are already planned up until the end of this programming period.

The Committee on Regional Development has held a number of consultations on this proposal, including exchanges of views in committee with Commission Vice-President Dombrovskis, the Commission services (both the Structural Reform Support Service and DG REGIO), the European Economic and Social Committee, the Committee of the Regions, the Council Presidency and the European Court of Auditors. The co-rapporteurs have the overall impression that support for the proposal is very weak across the board, with very few stakeholders supporting the proposed optional diversion of the performance reserve to fund structural reforms.

SHORT JUSTIFICATION

The Rapporteur takes note of the Commission proposal to open the possibility to Member States to fully or partially allocate the performance reserve embedded in the regulation to support structural reform commitments by the Member States. The decision to use the performance reserve for structural reforms would be completely to the discretion of the Member States, which are asked to make an official proposal for this reallocation including measures for the reform implementation, milestones, targets and a timetable. The Commission would assess the proposal and adopt a decision by an implementing act

The possibility to use the performance reserve for structural reforms clearly undermines its original purpose and the purpose of cohesion policy, as the performance reserve was set up to allocate funds to ESIF-programmes that have reached their milestones. As the Commission will undertake a review of these programmes in 2019, programmes have been striving to achieve their milestones and have calculated with the funds from the performance reserve. If now Member States can decide to use the reserve for a different purpose, cohesion programmes may face financial insecurity and delays in implementation. The incentive for ESIF-programmes to be successful would vanish.

In addition, the amending regulation subordinates cohesion policy under the European Semester, although it has its own objectives laid down in the treaty.

The choice of direct management for the support of structural reforms with money that was supposed to go to cohesion policy would also breach with the cohesion policy’s principle of co-financing.

Further, the Commission does not clearly define structural reforms in its proposal, which makes the reallocation of money from the performance reserve more unclear.

Finally, the Commission justifies its proposal stating that is shall serve as a pilot project for the next MFF. However, the results from this pilot phase will not be able to be taken up in the design of the next MFF.

Considering all this, the Rapporteur proposes to reject the Commission proposal, as it is the best way of guaranteeing an efficient, autonomous and successful cohesion policy.

SHORT JUSTIFICATION

The Rapporteur takes note of the Commission proposal to offer the possibility to Member States to allocate, fully or partially, the performance reserve foreseen in the Common Provisions Regulation (CPR) to support structural reform commitments by the Member States. The decision to use the performance reserve for structural reforms would be completely at the discretion of the Member States, which must submit an official proposal for this reallocation, including measures for the reform implementation, milestones, targets and a timetable. The Commission would assess the proposal and adopt a decision by an implementing act.

The European Semester aims at enabling Member States to coordinate their economic policies by:

• ensuring sound public finances (avoiding excessive government debt)

• preventing excessive macroeconomic imbalances in the EU

• supporting structural reforms, to create more jobs and growth, and by

• boosting investment. 

Member States authorities set out their plans on how to use funding from the European Structural and Investment Funds between 2014 and 2020 in the Partnership Agreements, with subsequent approval by the European Commission.

It is Member States’ responsibility to propose concrete programmes and projects on which European Structural and Investment Funds will be spent.

The performance reserve aims at facilitating the focus on performance and attainment of the objectives of the Union strategy for smart, sustainable and inclusive growth, and consists of 6 % of the total allocation for the Investment for growth and jobs goal, as well as for the EARDF and for measures financed under shared management for the EMFF Regulation, established for each Member State.

SHORT JUSTIFICATION

In an attempt to refute the criticism that EU Cohesion Funds strategic justification of - and accountability for- spending have been inadequate, an increased performance orientation was introduced in the 2014-2020 programming period. A performance framework was defined for each operational programme, detailing the investments' expected results and how progress towards these goals would be measured.

By 2019, a performance review will take place and the programmes and priorities that will have achieved the milestones and targets set, will gain access to the associated performance reserve (6 % of the resources allocated through the European Regional Development Fund, the European Social Fund and the Cohesion Fund), while the ones that have seriously failed to achieve milestones may face penalties.

The Rapporteur is unpleasantly surprised by the Commission’s proposal, which in short, invites Member States to voluntarily concede, wholly or partly, the management of the performance reserve funds to the Commission’s eagerness to implement horizontal structural reforms linked to the European Semester.

First, she is of the opinion that Cohesion Policy and the European Semester do not share or serve the same goals. Ex-ante and macro-economic conditionalities represent a major risk to the achievement of sustainable, fair and balanced growth. The European Parliament has repeatedly underlined, that “an interaction with the European Semester should not impede the achievement of the Cohesion policy’s proper objectives as stipulated in the Treaties”[1]. Diverting another 21 billion euro to cater for objectives strictly linked to the European economic governance process constitutes a clear deviation from the Cohesion Policy’s main purpose, to “reduce disparities in the level of development between regions”[2].

To redirect such a significant amount of funds will disturb the implementation and affect negatively the potential of the policy impact. Key and complementary Cohesion Policy principles such as, solidarity in practice, fair and just redistribution of wealth, and the very same performance incentive-reward logic, will be severely undermined.

From a procedural point of view, the Rapporteur expresses grave reservations. The proposal comes too late and is extremely unclear. The relevant changes will have a retroactive effect, could provoke budgetary disruptions on the agreed national annual tranches and may disturb already planned spending on specific projects.

The Rapporteur denounces that other EU funding instruments support structural reforms focusing on the European Semester in the current programming period. A reallocation of cohesion funds to the benefit of i.e. the Structural Reform Support Programme (SRSP) has already taken place, while the Commission is now proposing a substantial increase of the SRSP financial envelope. Moreover, the balance could worsen in the future programming period 2021-2027. The Commission, while proposing a new Reform Support Programme of €25 billion budget, financed under the Flexibility instrument and separate to the EU Structural and Investment Funds, plans in parallel, a 7% cut on the overall Cohesion portfolio[3].

While shared management creates the impression of co-ownership, the decision of a Member State to use partially or in full the performance reserve to support structural reforms will signify a shift to direct management. Consequently, any proposal to undertake reform commitments will fall under the exclusive assessment, approval and management of the Commission.

By way of conclusion, the Rapporteur regrets that the proposal comes in full contradiction with recent Commission statements in the EP plenary (March 2018)[4]. Since the Commission declared no intention to change the dates regarding the performance assessment and the allocation of the performance reserve, amending at this stage the orientation and management of the performance reserve would present a clear case of double standards.

Taking into consideration all the above, the Rapporteur considers that ITRE Committee should call on REGI Committee, as the committee responsible and on ECON and BUDG Committees, as associated committees, to reject the Commission proposal.

SHORT JUSTIFICATION

The Rapporteur takes note of the Commission proposal to open the possibility to Member States to fully or partially allocate the performance reserve embedded in the regulation to support structural reform commitments by the Member States. The decision to use the performance reserve for structural reforms would be completely to the discretion of the Member States, which are asked to make an official proposal for this reallocation including measures for the reform implementation, milestones, targets and a timetable. The Commission would assess the proposal and adopt a decision by an implementing act

The proposal of the European Commission intends to divert the amount allocated for the performance reserve to structural reforms. The current Common Provision Regulation (CPR) sets out in the Partnership Agreements that these allocations shall be used for specific priorities.

The rapporteur in the Committee for Agriculture and Rural Development considers that the funds allocated to the performance reserve should be spent as initially intended, since they target projects funded through the European Agriculture and Rural Development Fund.

Since using the money allocated to the performance reserve for structural reforms could divert this away from investments in agriculture and rural development, the rapporteur proposes to reject the Commission proposal amending the CPR.
