on the draft Council decision on the conclusion, on behalf of the Union, of the Common Aviation Area Agreement between the European Union and its Member States and the Republic of Moldova

The European Parliament,

 having regard to the draft Council decision (14205/2019),

 having regard to the draft Common Aviation Area Agreement between the European Union and its Member States and the Republic of Moldova (08185/2012),

 having regard to the request for consent submitted by the Council in accordance with Articles 100(2) and Article 218(6), second subparagraph, point (a)(v), and Article 218 (7) of the Treaty on the Functioning of the European Union (C9-0192/2019),

 having regard to Rule 105(1) and (4) and Rule 114(7) of its Rules of Procedure,

 having regard to the recommendation of the Committee on Transport and Tourism (A9-0084/2020),

1. Gives its consent to the conclusion of the agreement;

2. Instructs its President to forward its position to the Council and the Commission and to the governments and parliaments of the Member States and the Republic of Moldova.

 


 

EXPLANATORY STATEMENT

This Agreement establishes an EU/Moldova Common Aviation Area as part of the EU Eastern Partnership and wider EU neighbourhood policy. The existing bilateral agreements on air traffic services between the EU Member States and Moldova are to be superseded by the new agreement.

 

Procedure

 

This agreement has been negotiated by the Commission as authorised by the Council in June 2011 and it was signed on 26 June 2012, subject to its conclusion at a later date, in accordance with Decision 2012/639/EU[1]. Following the accession of Croatia into the EU the relevant Protocol on the accession of the Republic of Croatia to this Agreement was signed on 22 July 2015[2].

 

Moreover, this agreement also takes into account the entry into force of the Treaty of Lisbon as well as the legal modifications following the ruling of the European Court of Justice[3].

 

In order to conclude the Agreement the Council needs the consent of the European Parliament as required by Article 218 TFEU.

 

In accordance with Rules 105 and 114(5), (7) and (8) of Parliament’s rules of procedure, the committee responsible shall submit a recommendation for the approval or rejection of the proposed act. Parliament shall then take a decision by means of a single vote, and no amendments to the Agreement may be tabled. Amendments in committee shall be admissible only if their aim is to reverse the recommendation proposed by the rapporteur.

 

Main provisions of the Agreement

 

This Agreement is part of the EU neighbourhood policy. It builds upon and replaces the framework of bilateral air transport agreements between the EU Member States and Moldova through the establishment of the Common Aviation Area between the EU and its Eastern Partnership Partners. It provides for gradual market opening in terms of access to routes and capacity on a reciprocal basis, ensures level playing field for economic operators based on the EU principles and provides for alignment of the Moldavian aviation legislation with EU legislation on issues such as safety, security and air traffic management.

 

 

 

Rapporteur’s position

 

This comprehensive Agreement covers not only air traffic rights, to allow for direct flights between any EU airport and Moldova but also wide range of aviation issues, such as passenger rights, air traffic management, economic regulation, competition or social aspects. Once ratified, it will lead to the alignment of the Moldavian standards in air transport with the EU framework and, as a result, it will deliver mutual benefits to both sides of the Agreement. Furthermore, as part of the EU neighbourhood policy, it is an important instrument in deepening the economic relationship with Moldova. In the light of the above, your Rapporteur suggests that the TRAN Committee should give a favourable recommendation on the conclusion of the Agreement.
