DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the draft Council decision on the Association of the Overseas Countries and Territories with the European Union including relations between the European Union on the one hand, and Greenland and the Kingdom of Denmark on the other (Decision on the Overseas Association, including Greenland)

The European Parliament,

 having regard to the Council draft (08656/2021),

 having regard to Article 203 of the Treaty on the Functioning of the European Union, pursuant to which the Council consulted Parliament (C9‑0189/2021),

 having regard to Rule 82 of its Rules of Procedure,

 having regard to the report of the Committee on Development (A9-0244/2021),

1. Approves the Council draft;

2. Calls on the Council to notify Parliament if it intends to depart from the text approved by Parliament;

3. Asks the Council to consult Parliament again if it intends to substantially amend the text approved by Parliament;

4. Instructs its President to forward its position to the Council, the Commission and the national parliaments.


 

EXPLANATORY STATEMENT

On 14 June 2018 , the Commission submitted to the Council a proposal for a Council Decision on the Association of the Overseas Countries and Territories with the European Union including relations between the European Union on the one hand and Greenland and the Kingdom of Denmark on the other (COM (2018) 461 final). The Council Decision will establish the rules and procedures governing the EU's association with the OCTs, including Greenland, for the period 2021-2027.

 

In line with the consultation procedure, the European Parliament adopted on 31 January 2019 a resolution on the Commission’s initial proposal. The file was later put on hold in the Council pending finalization of the negotiations on the Multiannual financial framework  2021-2027 and the regulation establishing the neighbourhood, development and international cooperation instrument - Global Europe.

 

When resuming its work on the draft Council Decision, the Council made a number of changes and decided on 21 May 2021 to consult the European Parliament for the second time.

 

After a careful analysis, the rapporteur believes that this revised version responds to the main recommendations formulated by the European Parliament in its resolution adopted in January 2019:

 It includes more extensive reference to the Agenda 2030 and the attainment of the SDGs; it recognises that gender equality and women’s empowerment are vital for achieving the SDGs;

 It recognises that the contribution of civil society to OCTs can be enhanced by strengthening civil society organisations in all spheres of cooperation;

 It includes additional provisions and strengthened language on the protection of human rights including women and children’s rights;

 It encourages and support OCT’s participation in Union programmes;

 It increases the climate target from 20% to 25% and includes strengthened language on the protection of nature and the environment;

 It describes with more clarity the different proposed areas of cooperation;

 It increases the number of annual trilateral consultations between the Commission, the Member States to which they are linked and the OCTs;

 Where relevant, it encourages OCTs to express their views in the context of the design and impact assessment of EU free trade agreements with third countries;

 It clarifies the destiny of the reflows from the OCT’s Investment Facility managed by the European Investment Bank.

 

Other changes respond to the need to clarify the scope of certain articles, to take into account EU positions in the international agenda and to align with the various external instruments for the sake of coherence.

 

Annex II of this draft Decision (concerning the definition of the concept of ‘originating products’ and methods of administrative cooperation) corresponds almost entirely to the text of Annex VI of the current OCTs Decision (Council decision amending Council Decision 2013/755/EU of 25 November 2013 on the association of the overseas countries and territories with the European Union), for which the European Parliament was consulted in 2019 (2019/0162 (CNS), the only change being the addition of paragraph (2) to Article 45.

 

Considering that the revised version of the Council’s draft decision responds to the European Parliament main recommendations formulated in 2019 and understanding the need to avoid any further delays in the programming of the financing assistance provided to the OCTs, the Chair proposes that this proposal be adopted without amendment, in accordance with Rule 52 of the Rules of Procedure.
