on the draft Council decision on the conclusion, on behalf of the European Union, of the Agreement between the European Union and the Republic of Korea on certain aspects of air services

The European Parliament,
– having regard to the draft Council decision (05210/2021),
– having regard to the draft agreement between the European Union and the Republic of Korea on certain aspects of air services (15082/2019),
– having regard to the request for consent submitted by the Council in accordance with Article 100(2) and Article 218(6), second subparagraph, point (a)(v), and Article 218(7), of the Treaty on the Functioning of the European Union (C9‑0120/2021),
– having regard to Rule 105(1) and (4) and Rule 114(7) of its Rules of Procedure,
– having regard to the recommendation of the Committee on Transport and Tourism (A9-0251/2021),
1. Gives its consent to conclusion of the agreement;
2. Instructs its President to forward its position to the Council, the Commission, and the governments and parliaments of the Member States and of the Republic of Korea.
EXPLANATORY STATEMENT
The EU-Korea Agreement:
The agreement between the European Union and the Republic of Korea on certain aspects of air services is a Horizontal Aviation Agreement negotiated by the European Commission on behalf of EU Member States and the Republic of Korea, following the judgements of the Court of Justice in the so-called “Open Skies” cases . The Agreement allows any EU airline to fly to the Republic of Korea from any of the twenty two EU Member States, which currently have a bilateral air services agreement with the Republic of Korea. In addition to the new routes’ opportunities for the EU carriers, the agreement is beneficial for both sides by bringing legal certainty to the commercial operations and ensuring non-discriminative approach to the airlines flying between the two respective territories.
Procedure:
On 5 June 2003 the Council authorised the Commission to open negotiations with third countries on the replacement of certain provisions in existing bilateral air services agreements with an agreement at Union level. The agreement with Korea was signed on 25 June 2020 and, in order to conclude the Agreement, the Council needs the consent of the European Parliament as required by Article 218 TFEU.
In accordance with Rules 105 and 114(5), (7) and (8) of Parliament’s rules of procedure, the committee responsible (TRAN) shall submit a recommendation for the approval or rejection of the proposed act. Parliament shall then take a decision by means of a single vote, and no amendments to the Agreement may be tabled. Amendments in committee shall be admissible only if their aim is to reverse the recommendation proposed by the rapporteur.
Rapporteur’s position:
Civil aviation is a major strategic sector in the European Union, providing mobility solutions and jobs to European citizens and it is also a lifeline for the European tourism sector. This agreement replaces or complements the existing bilateral air services agreements between Member States and the Republic of Korea, which should further improve the connectivity between European Union and Asia, increase competition and provide for legal certainty for the airlines. On the basis of the foregoing, the rapporteur recommends that the Committee on Transport and Tourism give its approval for the conclusion of this agreement.
